VILLAGE OF DRAKE
BYLAW 2023-07
A BYLAW TO PROVIDE ANIMAL CONTROL
The Council of the Village of Drake in the Province of Saskatchewan enacts as follows:
PART I - GENERAL
1. SHORT TITLE:
This bylaw shall be known as the "Animal Control Bylaw"
2. PURPOSE
The purpose of this Bylaw is to promote the safety, health and welfare of people and the protection of
people and property in the Village of Drake, and to ensure the humane treatment and control of
animals.
3. DEFINITIONS
For the purpose of this bylaw, the expression:
Administrator means the Administrator for the Village of Drake, or any person authorized to act
on his/her behalf;
Aggressive Dog means:
(i) Any dog that, without provocation, in a vicious or menacing manner, chases or
approaches a person or domestic animal in an apparent attitude of attack;
(ii) a Dog with a known propensity, tendency, or disposition to attack without provocation,
cause injury or otherwise threaten the safety of humans or Domestic Animals;
(iii) a Dog which has, without provocation, bitten, inflicted injury, assaulted, pursued, or
otherwise attacked a human or Domestic Animal;
(iv) a Dog which is owned primarily or in part for the purpose of Dog fighting or has been
or is being trained for Dog fighting;
Animal means includes dogs, cats, exotic animals, and all domestic animals.
Animal Control Officer means any person appointed by council for the purpose of bylaw
enforcement, and any other person or agency appointed by council to restrain, receive, or
impound dogs.
Animal Control & Rescue Services or ACRS means the Rescue place which the Village of
Drake appointed by the Council for the Village of Drake for the purpose of retaining impounded
dogs and cats pursuant to this Bylaw.
At large means, in reference to a Domestic Animal other than a spayed or neutered Cat, that the
animal is not in or upon the premises of its Owner and is not under the care and control of its
Owner, and, in the case of Dogs, that the Dog is not secured on a leash to its Owner while off the
property of its Owner;
Business days shall mean any working day (Monday to Friday inclusive) excluding statutory and
other holidays (i.e., New Year's Day, Family Day, Good Friday, Easter Monday, Victoria Day,
Canada Day, Civic Holiday, Labour Day, Thanksgiving Day, Remembrance Day, Christmas
Day, Boxing Day) and any other day on which the province has elected to be closed for business.
Cat means any animal of the species felis domesticus irrespective of sex or age;
Council means the Council of the Village of Drake;
Dangerous Dog means a Dangerous Dog as defined in Division 5 of the Municipalities Act;
Designated officer shall mean that person designated by the council of the municipality;

Diseased Animal means any domestic animal indicating symptoms of distemper, parvovirus,
rabies, or other contagious disease that can be spread to human or animal populations;
Dog means any animal of the species canis familiaris irrespective of sex or age;
Dog Owner means any person who owns or has in his or her possession a Dog, or any person
harbouring or allowing a Dog to remain about his or her house or premises;
Domestic Animal means any animal tamed and kept as a domestic pet, and includes a Dog or
Cat but does not include a Farm Animal, Exotic Wildlife and Wildlife as defined in this Bylaw;
Enclosure means a fence or structure at least 1.8 metres in height suitable to confine an
Aggressive Dog and prevent the entry of young children;
Exotic Wildlife means a vertebrate animal of any species, excluding fish, that is not native to
Saskatchewan but is considered a wild species in its natural habitat area whether raised for
domestic ownership or not;
Farm Animal means any cattle, horse, sheep, goat, swine, donkey, mule, or llama; any fowl or
poultry; any rabbit, hare, mink, or otter; and includes without limitation any other animal raised
for food or for the use of humans;
Neutered Male Dog/Cat means any Dog/Cat of the male sex certified by a veterinarian as unable
to reproduce;
Owner means any person who owns or has in his or her possession a Domestic Animal, or any
person harbouring or allowing a Domestic Animal to remain about his or her house or premises;
Animal Control & Rescue Services means that person, corporation, society, or organization may
from time to time be appointed by the Council for the Village of Drake for the purpose of retaining
impounded dogs and cats pursuant to this Bylaw.
Running at large means:
(i) being on public property unaccompanied by any person; or
(ii) being on public property accompanied but not under the "complete" control of a person by
means of a leash suitable to the size and strength of the animal; or
(iii) being on private property unaccompanied or accompanied by any person but not under the
complete control of a person by means of a leash suitable to the size and strength of the animal
where the property owner has not given permission to the owner of the animal.
Spayed Female Dog/Cat means any Dog/Cat of the female sex certified by a veterinarian as
unable to reproduce;
Village means the lands within the municipal boundaries of the Village of Drake;
Veterinarian means any certified member of the Canadian Veterinarian Association.
Wildlife means a vertebrate animal of any species, excluding fish that is wild by nature in
Saskatchewan and includes any exotic wildlife found in Saskatchewan.
4. QUARANTINE OF SICK ANIMALS:
Notwithstanding any other provision of this Bylaw, where any cat or dog is suspected of having
rabies or other life-threatening disease it shall be isolated and may not be claimed, destroyed or
otherwise disposed of except after notice to the Medical Health Officer for the Village and then only
in compliance with the directions of the Medical Health Officer.
5. LIABILITY:
No liability whatsoever shall attach to the Village, the Bylaw Enforcement Officer, Animal Control
Officer, Animal Control & Rescue Services, or other person acting under this Bylaw and in good
faith, arising out of the capture, seizure, restraining, impounding, failure to contact the owner, sale
or destruction of any cat or dog.

PART II - LICENCES
1. LICENCES
Every person who owns, possesses, or harbours a dog and/or cat within the Village shall cause
such dog and/or cat to be registered with and obtain a licence for it from the Village Administrator
and the Village Administrator is hereby authorized to register dogs and record with the
registration of the dog the name and address of the owner, and to issue licences in conformity
with this Bylaw.
a) All licences issued under this Bylaw shall expire on December 31st following the date of
issue and shall be in a form and of a size which can conveniently be attached to a dog
collar.
b) A dog owned by a sightless person and used as a guide, shall be registered, and licensed
as provided in this Bylaw but without charge.
c) The annual licence fee for each dog or cat shall be as set out in Schedule "A".
2. WEARING OF TAGS
Every person to whom a licence has been issued under this Bylaw shall cause his/her dog or cat
to wear a collar to which shall be attached the licence tag issued by the Village Office. Upon
satisfactory proof that the licence tag originally issued has been lost, the Village Office shall
issue a replacement tag for a fee of $5.00.
PART III - REGULATION OF ANIMALS:
1. DUTIES OF OWNER
A person who has ownership, possession, or control of an animal:
(a) shall ensure that the animal has an adequate source of food and water;
(b) shall provide the animal with adequate medical attention when the animal is wounded or ill;
(c) shall provide the animal with reasonable protection from injurious heat or cold; and
(d) shall not confine the animal to an enclosure or area:
i. with inadequate space,
ii. with unsanitary conditions,
iii. with inadequate ventilation, or
iv. without providing an opportunity for exercise, so as to significantly impair the
animal's health and well-being.
2. ANIMALS:
a) No dog or cat shall run at large in the Village, and for the purpose of this Bylaw, a dog or cat
shall be deemed to be running at large when it is beyond the boundaries of the land occupied by
the owner, possessor or harbourer of the said dog or beyond the boundaries of any lands where
it may be with the permission of the owner or occupant of the said land and when it is not under
control by being:
i) in direct and continuous charge of a person competent to control it by means of a leash; or
ii) securely fastened so that it cannot roam at will; or
iii) securely confined within an enclosure.
b) When an animal is found to be running at large its owner shall be deemed to have failed or
refused to comply with the requirements of this Bylaw and is guilty of an infraction thereof.
c) On a complaint made to the Village of Drake Administration Office, Animal Control Officer,
Bylaw Officer that any animal has been causing a disturbance, the Animal Control Officer,
Bylaw Officer upon being satisfied of the truth of the complaint, may notify the owner of such
animal to abate the nuisance within 48 hours after receipt of the notice. The notice shall be in
writing and shall be served personally to the owner or at the known address of the owner.
d) Upon receipt of a third complaint within 30 days of a second complaint the Village shall provide
a letter to the owner outlining any, or all, of the following sanctions:
i) Issue an additional fine;
ii) An order that the animal in question be delivered to the Bylaw Officer, or Animal Control
Officer within a specified period of time for removal of the animal from the Village.
Any owner receiving a notice providing an order for the animal's removal from the Village
must do so within the specified period within said notice. The Animal Control Officer or
Bylaw Officer may enter onto the land surrounding any building in relation to the
apprehension of an animal subject to an order. Once apprehended the animal shall be seized
and subject to the provisions as outlined in Part IV, Sections 2 & 4.

e) No owner of an animal shall permit the animal to be or become a nuisance by barking or howling
or by making any other offensive noise to the annoyance or discomfort of any person at any time
of the day or night. For the purpose of this section, an animal is creating a disturbance if a person
not situated on the property where the animal is located can easily hear the disturbance.
f) No owner or keeper of a dog or cat shall permit their dog(s) or cat(s) on any school ground,
playground, baseball diamonds, Village parks or posted area.
g) No person shall allow a cat or dog off leash in any public areas within Village boundaries.
h) If any animal defecates on any public park, playground, public area, or private property other
than the property of its owner, the owner of the animal shall remove the defecation immediately
and dispose of it in a sanitary fashion. This shall not apply to a person who owns and is physically
reliant on a guide dog trained and used to assist such a person.
i) The owner of a cat shall not permit the cat to urinate on, defecate on, or otherwise damage or
interfere with any property other than the property of the owner of the cat.
j) No owner of an animal shall fail to immediately remove any defecation of the animal from
private or public property, other than the property owned or occupied by the owner.
k) No owner of an animal shall fail to dispose of all defecation from the animal whether located on
the owner's property or otherwise, in a sanitary manner so as to prevent odor and sanitation
complaints.
l) Any Animal in Distress within the Village of Drake shall be subject to The Animal Protection
Act, 2018.
m) Every Owner of an un-spayed female Dog or Cat in heat shall confine the Dog or Cat within the
Owner's premises, within premises under the Owner's possession and control, or within an
Enclosure contained within the Owner's property provided that such property is fenced or
secured so as to prevent any Dog or Cat from gaining access.
n) A person who owns, possesses, or harbours a dog or cat found running at large shall be deemed
guilty of an infraction of this Bylaw.
3. INTERFERENCE:
No person shall:
a) Untie, loosen or otherwise free an animal which has been tied or otherwise restrained;
b) Negligently or willfully open a gate, door or other opening in a fence or enclosure in which an
animal has been confined and thereby allow an animal to run at large in the Village;
c) No unauthorized person shall remove from a dog a collar or licence tag.
d) Tease, entice, bait or throw objects at a dog confined within its owner's property
4. ANIMAL IN DISTRESS
For the purpose of this Bylaw, an animal is in distress if it is
a) subjected to the conditions that, unless immediately alleviated, will cause the animal death or
serious harm;
b) subjected to conditions that cause the animal to suffer acute pain;
c) not provided food and water sufficient to maintain the animal in a state of good health;
d) not provided appropriate medical attention when the animal is wounded or ill; unduly exposed
to cold or heat; or
e) subjected to conditions that will, over time, significantly impair the animal's health or
wellbeing, including;
(i) confinement in an area of insufficient space,
(ii) confinement in unsanitary conditions,
(iii) confinement without adequate ventilation,
(iv) not being allowed an opportunity for adequate exercise, and
(v) conditions that cause the animal extreme anxiety or distress.
f) Any Animal in Distress within the Village of Drake shall be subject to The Animal Protection
Act, 2018.

PART IV - SEIZURE, IMPOUND AND DESTRUCTION OF ANIMALS:
1. SEIZURE OF CATS:
a) When a Bylaw Enforcement Officer, Animal Control Officer, Animal Control & Rescue Services
observes or receives a complaint of a cat causing a nuisance, they may:
(i) seize and impound any cat found causing a nuisance.
(ii) in the event a cat is trapped, immediately deliver the cat and trap into the custody of the
Animal Control & Rescue Services
2. SEIZURE OF DOGS
a) No owner shall permit any dog to be running at large in the Village of Drake.
b) The Village Council is authorized to appoint an Animal Control Officer, Animal Control &
Rescue Services or Bylaw Enforcement Officer to restrain and impound any dog found running at
large in the Village of Drake
c) A designated officer, Animal Control & Rescue Services, or Animal Control Officer or Bylaw
Enforcement may seize and impound any dog that is at large.
d) A designated officer, such as an Animal Control Officer, Animal Control & Rescue Services or
Bylaw Enforcement Officer may enter onto the land surrounding any building in pursuit of any
cat or dog which is found at large.
e) When any dog is captured, impounded or in violation by running at large, the Village of Drake
shall post a notice on the Notice Board at the Town Office, Facebook Village group, and website
maintained by the Village of Drake, giving a description of the said dog or cat.
f) The Village of Drake shall charge fines as prescribed in "Schedule "A"" before the release of the
said dog,
g) Pound Fees shall be all charges that the Animal Control & Rescue Services may impose, as
prescribed in "Schedule "A"
3. INTERFERENCE WITH ENFORCEMENT
No person, including the person who is the owner of a cat or dog which is being impounded or has
been impounded, shall interfere with an Animal Control Officer, Animal Control & Rescue Services
or Bylaw Enforcement Officer, who is impounding any dog in accordance with the provisions of this
Bylaw.
4. IMPOUND OF CATS AND DOGS
a) The Animal Control & Rescue Services shall keep all impounded dogs for a period no less
than three (3) business days, which begins at 9am on the first business day after impounding
occurs.
b) During this period, the owner may reclaim the cat or dog from the pound upon payment to the
Animal Control & Rescue Services of the fees set out in Schedule "A" of this Bylaw.
c) No unlicensed cat or dog which is impounded shall be released to its owner until a license has
been purchased.
d) If a dog impounded is wearing a valid license tag, the Animal Control & Rescue Services shall
immediately notify the owner, by telephone or in writing, of the seizure of the cat or dog at the
telephone number or address shown in the records.
e) No liability whatsoever shall attach to the Village, any designated person, or the Animal Control
& Rescue Services by reason of the failure of the owner to receive such notice.
f) No unlicensed cat or dog which has been seized or impounded shall be released to its owner or
to any other person, until the impound fee and housing fee have been paid and a licence has been
purchased for it.
g) If a dog or cat is not reclaimed within the period set out in Subsection (a), or if the owner of a
dog or cat fails or refuses to comply within this period, the Animal Control & Rescue Services
may rehome or dispose of the dog or cat.
h) The owner who reclaims a dog from the pound is deemed to have been the owner of the cat or
dog at the time the cat or dog was at large.
5. DESTRUCTION OF CATS AND DOGS:
a) Where a cat or dog which has been seized and impounded is not claimed by the owner within three
(3) business days as set out in this Bylaw, or where the owner has failed or refused to comply with
the terms of this Bylaw within the same period for the redemption of said cat or dog, the Manager
may authorize the disposal of said cat or dog as set out in Schedule "E" of this Bylaw.
b) The disposal of unclaimed or unredeemed cats and dogs shall be by either the:
(i) sale at an amount sufficient to cover the impound fee, housing fee and any other costs,
(ii) humane destruction by a competent person.

c) Where a cat or dog is injured before or after being seized or in the opinion of the Animal Control
Officer, Animal Control & Rescue Services, should be destroyed without delay for humane reasons
or for reasons of safety to persons or animals, the Animal Control Officer, Animal Control &
Rescue Services may destroy the cat or dog in a humane manner as soon after seizure as he or she
may determine without permitting the owner to reclaim or redeem said cat or dog or without
offering for sale.
d) The Village shall keep an accurate record of all cats and dogs seized and destroyed under the
provisions of this Bylaw for a period of three years, as set out in Schedule "D" and Schedule "E"
of this Bylaw.
e) As per the Municipality Act Division 5 section 379
(i) "An Animal Control Officer, Animal Control & Rescue Services or designated officer may
destroy any animal that he or she finds injuring or viciously attacking a person or domestic
animal.
(i) An Animal Control Officer, Animal Control & Rescue Services or designated officer who,
acting in good faith, destroys an animal pursuant to subsection (i) is not liable to the owner
for the value of the animal.
6. AGGRESSIVE DOGS
a) No person shall keep or own any diseased domestic animal or Aggressive Dog within the Village
unless the diseased animal or Aggressive Dog is kept sufficiently secure so as to prevent it from
endangering the safety of any person or other animal.
b) No Owner of an Aggressive Dog shall permit or allow the Dog to be on any public place or any
other place that is not owned or controlled by that person, unless the Dog is secured on a leash to
its Owner and muzzled to prevent it from biting another animal or a human.
c) Every Owner of an Aggressive Dog shall, at all times while the Dog is on the premises owned or
controlled by such person, keep the Dog securely confined either indoors, or outdoors in an
Enclosure that is kept locked at all times except when the Dog is being placed in or taken from the
Enclosure.
d) Every person who owns, keeps, or has custody or control of an Aggressive Dog shall immediately
notify the Administrator, Council Member or the R.C.M.P. when that Dog is at large.
e) Any Aggressive dogs who is at large and becomes a danger to the public will be controlled in
accordance with Division 5 of the Municipalities Act.
7. DANGEROUS DOGS
The control of dangerous dogs shall be in accordance with Part XII - Division 5 of the Municipalities
Act of the Province of Saskatchewan.
AN ANIMAL IS DANGEROUS WHERE IT IS PROVED THAT:
(i) the animal, without provocation, in a vicious or menacing manner, chased or approached a
person or domestic animal in an apparent attitude of attack;
(ii) the animal has a known propensity, tendency or disposition to attack without provocation, to
cause injury or to otherwise threaten the safety of persons or domestic animals;
(iii) the animal has, without provocation, bitten, inflicted injury, assaulted or otherwise attacked a
person or domestic animal;
(iv) the animal is owned primarily or in part for the purpose of animal fighting or is trained for
animal fighting.
8. RESPECTING OTHER ANIMALS
a) No person shall herd, graze, keep or own Exotic Wildlife, Farm Animals or Wildlife in the
limits of the Village.
b) No person shall:
(i) buy, own or harbours an animal or hybrid of an animal listed in Schedule "B" for any
purpose, except as permitted by the Zoning Bylaw;
(ii) operate a pet store that owns, buys, trades, exhibits, harbours, rents or sells an animal or
hybrid of an animal listed in Schedule "B"; or
(iii) trade, exhibit, harbours, rent or sell an animal or hybrid of an animal listed in Schedule "B"
c) Any person found guilty of an infraction of any of the provisions of this bylaw shall be liable to
the penalties provided in Schedule "C'

Part V Offences and Penalties
1. PENALTIES
a) Except as otherwise provided in this Bylaw, every person who contravenes any provision of
this Bylaw is guilty of an offence and liable on summary conviction to a fine of at least the
minimum amount listed in Schedule "C".
b) Any person convicted of an offence under PART IV No 8 shall, within ten days thereafter,
deliver all animals of the kind listed in Schedule "B" owned, kept or harboured by that person
to the Animal Control Officer or Animal Control & Rescue Services and they shall become
the property of the Village and shall be donated to an approved agency or humanely
euthanized.
2. CHARGES MAY BE ADDED TO PROPERTY TAXES
a) If a person owes the Village for costs incurred by the Village with respect to a dangerous animal,
the Village may add the amount owing to the tax roll of any parcel of land for which the person
is the assessed person.
b) If an amount is added to the tax roll of a parcel of land pursuant to subsection (a), the amount:
(i) Is deemed for all purposes to be a tax imposed pursuant to The Municipalities Act from the
date it was added to the tax roll; and
- forms a lien against the parcel of land in favour of the Village from the date it was
added to the tax roll.
3.
APPOINTMENT OF DESIGNATED OFFICERS
a)
The Animal Control Officer Animal Control & Rescue Services shall be designated officers
for the purposes of this Bylaw
b)
The Animal Control Officer Animal Control & Rescue Services are authorized to delegate
enforcement of this Bylaw to City employees.
4.
REPEAL
Bylaw No. 2021-04 is hereby repealed.
5.

Schedule "B"
The following is a list of animals the keeping of which is prohibited within the Village of Drake:
(a)
all Arachnids dangerous to humans (such as scorpions and tarantulas, except
tarantulas of the genera Aphonopelma, Avicularia and Grammostola);
(b)
all Artiodactylus Ungulates (such as goats, sheep, cattle, pigs and llamas);
(c)
all Bats;
(d)
all Canids, except the domestic dog;
(e)
all Felids, except the domestic cat;
(f)
all Mustelids (such as skunks, weasels, otters and badgers) except the domestic
ferret;
(g)
all non-human Primates (such as gorillas and monkeys);
(h)
all Perissodactylus Ungulates (such as horses, donkeys, mules and asses);
(i)
all Procyonids (such as raccoons, coatis and cacomistles);
(j)
all Raptors, diurnal and nocturnal (such as eagles, hawks and owls);
