#2021-18 Bylaw to Regulate Burning in the Town of Duck Lake
TOWN OF DUCK LAKE
BYLAW NO 2021-18
A BYLAW OF THE TOWN OF DUCK LAKE, IN THE PROVINCE OF SASKATCHEWAN, TO
REGULATE BURNING IN THE TOWN OF DUCK LAKE
WHEREAS the Council of the Town of Duck Lake has deemed it expedient to enact a Bylaw for
the purpose of prescribing regulations governing the Town of Duck Lake, in the Province of
Saskatchewan. The purpose of such regulations are to ensure:
1.
the safety, health, protection and well-being of people, and the safety and protection of
property; and,
2.
preventing fires;
NOW THEREFORE the Council of the Town of Duck Lake enacts the following:
1.
No person shall set or start an outdoor fire within the Town of Duck Lake, unless it is
done so in a fire-pit, constructed and used in accordance with this Bylaw.
2.
Outdoor fire pits may be constructed and used, for recreational purposes only,
providing that:
a) the fire pit must be fully contained within heavy gauge steel, concrete or cinder
blocks,
b) the walls of the fire pit must extend above grade level by a minimum of eight (8)
inches;
c) the fire pit must be located a minimum of twenty-five (25) feet from any buildings
and a minimum of fifteen (15) feet from any property line; and
d) when in use, the fire pit must be attended by a responsible adult person until the
fire has been fully extinguished. The height of the flames must be kept at a
manageable height, and a source of water must be kept close enough and be of
sufficient volume to fully extinguish the fire.
e) no burning in the open air shall be permitted except between the hours
of 7:00a.m. and midnight, after which time all open-air fires are to be
extinguished.

No person shall burn anything in a fire pit other than solid fuel products. Without limiting
the generality of that prohibition, no person may burn garbage, recyclables, household
waste, lawn clippings, leaves, or any other compostable material in a fire pit.

Nothing in this Bylaw permits or authorizes a person to use a fire pit in a manner that
creates a nuisance to any other person.
5.
No incinerator shall be constructed, installed or used within the corporate limits of the
Town of Duck Lake.
Burning barrels or any other similar device used for the burning of any household or yard
refuge are prohibited.
Exterior solid fuel burning Hydronic heating Systems shall not be allowed in any
residential, commercial or industrial areas within the limits of the Town of Duck Lake.
6.
No fireworks shall be discharged from any location within the boundaries of the Town of
Duck Lake, without first having obtaining a permit (as per Schedule "A") to do so from
the Fire Chief.
7.
No person shall block entrances or exists to a church, school, rink, hotel, restaurant,
or other building used by the public. No person shall block, bar, bolt, or lock entry or
exits in any manner other than with standard panic hardware or a form of quick acting
hardware during the time when the building is being publicly used.
8.
Whenever flammable liquids or vapors are suspected to emanate from underground or
above ground tanks or piping that could cause a hazardous condition, the Town may
require drilling of test holes, the testing of tanks and piping, the excavation of tanks and
piping, or any other procedure deemed necessary in order to expose and correct the
hazardous conditions. If an underground leak is suspected The Saskatchewan
Environmental Services Branch shall be notified.
9.
As for fire prevention procedures for schools, and other institutions, the person in
charge of every school, care home, business or other organization shall establish a
procedure according to approved practice to be followed in the event of fire or an alarm
of fire. This procedure shall include the duties of the staff in the event of fire and shall
include evacuation routes for the other occupants of the building. The person in charge
shall instruct the staff and occupants in the procedure established and shall post the
appropriate procedure in a conspicuous place in each area of occupancy.
10.
No person, industry, company, or manufacturer shall discharge or permit to be
discharged into any sanitary sewer, sewer connection, catch basin, ditch, lane or street,
any flammable liquid or hazardous chemical whether by itself or in combination with any
other liquid or solid.
11.
During times when conditions are dry and the risk of fire spreading is high, the Fire Chief
and the Town Administrator or a Council member shall have the authority to declare and
enforce a Fire Ban throughout the Town, either in full or for specific types of burning.
12.
Any person or corporation who contravenes a provision of this Bylaw is committing an
offence and liable on conviction to payment of a fine of not less than

13.
All fines and costs imposed under this Bylaw are a debt, owed by the person who set a
fire and the owner of the property on which the fire was located, to the Town and may be
recovered by the Town in a court of competent jurisdiction or may be collected by the
Town in the same manner as a tax may be collected or enforced, with any unpaid fines
being added to the tax roll of the property owner.
14.
Bylaw #2015-4 is hereby repealed.
