## BYLAW NO. 06-2023
Sections 8 & 23, Municipal Act
A BYLAW OF THE TOWN OF FOAM LAKE TO PROVIDE FOR THE MANAGEMENT OF SEWER AND WATER SERVICES, AND TO FIX THE RATES TO BE CHARGED FOR THE USE AND CONSUMPTION OF WATER, AND, TO FIX THE RATES TO BE CHARGED BY WAY OF RENT OR SERVICE CHARGE FOR THE USE OF THE SEWER.
WHEREAS the Council may regulate the distribution and use of water in the municipality and may fix the price for the use thereof and the times of payment; and
WHEREAS it is deemed necessary that the properties or premises drained or required by Bylaw to be drained into the sanitary sewer system be charged a reasonable rent or service charge for the use of said sewer;
NOW THEREFORE the Council of the Town of Foam Lake, in the Province of Saskatchewan, enacts as follows:
## Definitions:
- a) Quarterly Billing Period means the periods of March 13th to June 12", June 13"h to September 12", September 13"h to December 12", December 13th to March 12" of any year.
- b) Interim Billing Period means a period not encompassing a three mohth period.
- c) Consumer means a person, or corporate body, which uses the sewer and water services.
2. a) All consumers desiring to be supplied with water from the municipal water supply system shall make application to the officials of the municipality.
- b) All owners of mobile home residences are required to have a water meter installed in the interior of the premises, or otherwise protected from freezing; and that said owners are responsible for the cost of plumbing arising out of such installation.
- a) Each application shall be accompanied by the payment of a utility deposit in the sum of One Hundred and Fifty dollars ($150.00) for a 5/8 meter only; where the meter size is in excess of 5/8", the deposit shall be the cost of the meter; said utility deposit to be held by the municipality against consumption charges and to be applied against the final billing on a premises.
- b) All premises shall be installed with outside reading devices.
8. The municipality may, by Bylaw ration or limit the amount of water furnished to any or all consumers should circumstances warrant such action.
5. If the water supply is shut off from the premises of a consumer for infringement of the provisions of this Bylaw, the same shall not be turned on until all penalties, fees, rates, charges and arrears, if any, have been paid.
6. Water meters shall be read quarterly and at the time that a consumer vacates a premise.
7. Where a person damages a curb stop or other appurtenance, that person shall bear the cost of repair or replacement of the item.
8. a) Where a consumer requests that services be shut off at the curb stop in order to carry out repairs to plumbing, there shall be no charge to turn the service off and on again.
- b) Where a consumer or owner requests that service be shut off, they shall pay to the municipality the sum of Thirty dollars ($30.00).
- c) Where a consumer or owner requests that services be turned on, they shall pay to the municipality the sum of Thirty dollars ($30.00).
- d) Where a consumer, having vacated one premise, requests services to be turned on at a second premises, the municipality shall not turn on said services until all fees and rates are paid on both the premises.
9. The municipality may order the running of water in premises to prevent freezing, in which case the consumer shall be charged the Minimum Charge only.
10. Where a consumer or owner requests that an existing service be replaced for any other reason than for repair and maintenance, that consumer/owner shall bear the cost of replacement
11. The charges to be paid by the consumer whose water & sewer service has been turned on shall be those set forth in Schedules "A" and "B" hereof, or as amended from time to time; provided however, that the Minimum Charge shall be payable in every case whether or not any water is consumed.
12. Persons who own or occupy premises drained, or that are by Bylaw required to be drained into the municipal sewer, shall pay a rental rate or service charge as set forth in Schedules "A' and "B" hereof, or as amended from time to time.
13. a) Subject to clause b) hereof, accounts for water and or sewer services shall be billec month next following such periods.
- b) Where a consumer has used services for less than a quarterly billing period, an interim account shall be rendered on or before the first day of the month following vacating of the premises.
- c) Accounts rendered are due and payable as stated in Section 13. Hereof, unless it is proven that a meter is faulty in recording consumption, in which case Minimum Charge applies.
14. If an account is not paid within a period of thirty (30) days after the account is rendered, the water service shall be shut off. When the water service is so shut off, it shall not be resumed until all arrears have been paid together with a reconnection fee of Fifty dollars ($50.00).
15. All premises that have an auxiliary water supply shall install a check valve on the water source to prevent any possibility of water from these sources from entering the town water system and causing contamination.
16. Bylaw No. 03-2023 is hereby repealed.
17. THE rates, charges, tolls or rents contained in this bylaw shall come into force and take effect on the day of approval being issued by the Local Government Committee.

This bylaw will come into effect upon approval of the Saskatchewan Municipal Board.
## SCHEDULE "A" of Bylaw No. 06-2023
1. FIVE YEAR WATER & SEWER RATES SCHEDULE, for Residential and Commercial premises,
- a) Where consumption is metered, the minimum Water & Sewer Rates every quarter, 5000 gallons or less are as followed:
- b) Where a premise is a mobile home or trailer situated in an Approved Trailer Park, water consumption must be metered, the rate for use of water shall be as in #1 of Schedule "A".

- a) Where consumption is metered, Water & Sewer Rates over 5000 gallons are as followed per quarter:

## Residential:
- a) Subject to subsection b) hereof, the fees for Service Connections shall be shared on a 50/50 cost per lineal foot of street width for standard ¾ inch connections and shall be not less than $1,000.00,
- b) Where Service Connections are larger than the standard ¾ inch size, the fee shall be the actual cost borne by the owner requesting the service at 100%.
## Commercial:
- Service connections shall be at the discretion of Council with a minimum connection fee of not less than $1,000.00.
