## The Resort Village of Fort San
## Bylaw No. 89-3
- A Bylaw To License and Regulate The Running At Large of Animals
The Council of the Resort Village of Fort San, in the Province of Saskatchewan, enacts follows:
1. FOr the purpose of this bylaw the expression:
2. (a) "Dog" shall mean either a male or female dog,
3. (b) "Village" shall mean the Resort Village of Fort san,
4. (C) "Running at Large" shall mean when the dog is beyond the boundaries of the land occupied by the owner, possessor, or harbourer of the said dog or beyond the boundaries of any lands where it may be with the permission of the owner or occupant of the said land and when it is not under control by being;
5. (i)
6. in direct and continuous charge of a person competent to control it, or
7. (ii) securely confined within an enclosure, or
8. (iii) securely fastened so that it cannot roam at. will.
2. (a) Every person within the Village who owns, possesses, or barbours dog over three months old shall obtain a license from the Village Clerk.
10. (b) or the life of the dog he license shall be in effect from Jantary I to December 3. of the year in which His issued and shall be obtained or OF before January 3t amenced Bylaw No. 98-1 Br.
11. (C) The license fee shall be:
12. (i) for each dog: $10.00
13. (ii) for each neutered dog: $5.00
14. (a) The sum payable for a license required after July 1 shall be sixty percent of the fee for a full year.
3. A person residing in the Village who owns, possesses, or harbours a dog, and neglects or refuses to obtain a license therefor shall be deemed guilty of an infraction of this bylaw.
4. No dog shall run at large in the Village.
5. A person who owns, possesses, or harbours a dog found running shall be deemed guilty of an infraction of this bylaw.
6. Any person may take any dog found running at large contrary to the provisions of this bylaw to the Village pound, where shall be kept for seventy two hours unless the owner, possessor, or harbourer redeems the dog by paying to the Village Clerk the the sum of $10.00 for each twenty four hour period, or portion thereof, for the care and keep of each dog.
7. The Clerk or Poundkeeper may sell any dog which is not redeemed within seventy two hours of impounded, that the purchaser obtains a license if he is a resident of the Village.
20. (b) The Clerk or Poundkeeper, or at his request, any other person, may destroy any dog which has not been redeemed within seventy two hours.
- A person who contravenes any of the provisions of sections 3 or 5 of this bylaw shall be guilty of an offence and upon conviction shall be liable to a penalty of:
- (i) violation of Section 3
- (ii) violation of Section 5

- A violator of this bylaw, upon being served with a Notice f Violation, may, during office hours, within 30 days, voluntarily pay at the Village office the penalty provide herein and, upon payment, that person shall not be liable to prosecution for the offence.
- The Notice of violation shall be in Form "1", which is attached hereto and forms a part of this bylaw.
