Traffic Bylaw 1 CITY OF HUMBOLDT BYLAW NO. 05/2016 A BYLAW TO SUPPLEMENT THE TRAFFIC SAFETY ACT REGULATING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF HUMBOLDT AND PRESERVING ORDER THEREIN The Council of the City of Humboldt, in the Province of Saskatchewan, enacts as follows: 1. Short Title: This Bylaw may be cited as the Traffic Bylaw. 2. Application: All of the provisions and enactments set forth in this Bylaw shall relate to and be in full force and effect within the limits of the City of Humboldt. 3. Interpretation (a) In this Bylaw, unless the context otherwise requires, the expression(s): 1. "Act" means The Traffic Safety Act, being Chapter T-18.1 of the Statutes of Saskatchewan including any amendments or replacements thereto. 2. "Animal", "Motor Vehicle", "Motorcycle", "Owner", "Parking", "Power Unit," "Semi-Trailer", "Stop", "Traffic Lane", "Trailer", "Truck", and "Vehicle", shall have the meaning given to them in The Traffic Safety Act and amendments thereto. 3. "Boulevard" shall mean that portion of a street located between the sidewalk and the adjacent street whether marked with a curbstone or not, or that portion of a street located between the sidewalk and the street line. 4. "City" shall mean the City of Humboldt. 5. "Bylaw Officer" shall mean the Bylaw Officer for the City of Humboldt and anyone authorized by the Bylaw Officer to act on his behalf. 6. "City Manager" shall mean the administrative head of the City appointed pursuant to Section 84 of The Cities Act. 7. "Council" shall mean the Council of the City of Humboldt. 8. "Curb" shall mean the lateral boundaries of a roadway whether or not marked by curbing. 9. "Dangerous Goods" shall mean any product, substance or organism included by its nature or by the regulations in the schedule to the Transportation of Dangerous Goods Act (Canada). 10. "Disabled Person" shall mean a person whom has a limitation on their physical functioning, mobility, dexterity, or stamina. 11. "Disabled Person's Parking Area" shall mean all that portion of any street or other public place that has been designated by sign or other marking for the exclusive parking of vehicles displaying a Disability Parking Permit issued by the Saskatchewan Abilities Council, or other disabled person's vehicles. 12. "Disabled Person's Vehicle" shall mean any vehicle which displays a special license plate depicting thereon the international symbol of the disabled or displaying a Disability Parking Permit issued by the Saskatchewan Abilities Council, or other competent governmental jurisdiction. Traffic Bylaw 2 13. "Driver" shall mean any person who drives, operates or is in charge of a vehicle on a street and includes an operator. 14. "Driveway" means a private right-of-way, paved or unpaved, that provides access for vehicles and pedestrians from a boulevard, curb, or sidewalk to a lot or a carport, garage, parking pad, loading berth, or structure located on the lot. 15. Double Parking" shall mean the standing of a vehicle, whether occupied or not, parallel to a vehicle parked beside a curb for any reason other than delay due to traffic signs or signals. 16. "Fire Lane" means that area designated by signs or markings as a fire lane. 17. "Heavy Vehicle" means a motor vehicle with or without load which alone or together with any trailer, semi-trailer or other vehicle being towed weighs 5,455 kilograms or more, or a total length greater than 6.7 meters. 18. "Highway Intersection" shall mean that area bounded by property lines, real or produced, of two or more provincial highways which meet or cross each other. 19. "Holiday" shall mean any statutory holiday or any civic holiday declared by City Council. 20. "Impound" shall mean and include the seizure, removal and detention of a vehicle. 21. "Intersection" shall mean the area where two or more streets meet or cross each other. 22. "Lane" shall mean a street intended primarily to give access to the rear of property and intended primarily for the use of vehicles and shall include alleys. 23. "Loading Zone" shall mean the portion of a street adjacent to the curb designated by signs and/or markings for the exclusive use of vehicle loading or unloading passengers or goods. 24. "Lug Vehicle" shall mean any truck, portable engine or traction engine having metal spikes, lugs, or cleats projecting from the face of the wheels or tires thereof, or having a metal track tread. 25. "Member of the RCMP" shall mean any member of the Royal Canadian Mounted Police, acting within the scope of his or her duties as a peace officer. 26. "Parade" shall mean any group of pedestrians marching or walking along a street and numbering fifty (50) or more or any group of vehicles numbering ten (10) or more (except funeral processions) standing or moving on any street. 27. "Parallel Parking" shall mean parking a vehicle on a street parallel to the curb with the wheels of the right side of the vehicle within 30 centimeters of the curb. 28. "Pedestrian" shall mean any person afoot and shall include the occupant of a baby carriage or wheel chair. 29. "Person" shall mean any individual man, woman, or child, and shall include a corporation, or association. 30. "Power Turn" shall mean the maneuvering of a vehicle in such a manner as to cause the rear of the vehicle to depart from its ordinary line of progress by the sudden use of acceleration and/or braking. Traffic Bylaw 3 31. "Property Line" shall mean the line marking the boundary between any roadway and the lots abutting thereon. 32. "Public Place" shall mean any place, building or location to which the public has access by right, or by invitation, expressed or implied and for greater certainty but not to restrict the generality of the foregoing, shall include dance halls, theatres, skating and hockey rinks, curling rinks, churches, church halls, meeting halls, restaurants, beer parlors, bowling alleys, hotels, motels, stores and malls. 33. "Sidewalk" shall mean that portion of a street used exclusively for pedestrians. 34. "Sidewalk Crossing" shall mean that portion of a sidewalk which is reduced in elevation and designed for the passage of vehicular traffic across the sidewalk. 35. "Street" shall mean that portion of every highway, road, street, avenue, lane, drive, place, alley, square, thoroughfare, or way intended for use by the general public for the passage of vehicles or pedestrians, and includes any portion of a provincial highway within the boundaries of the City of Humboldt. 36. "Traffic" shall mean the movement of pedestrians, vehicles, buses or other means of moving either singly or together while using any street. 37. "Traffic Control Device" shall mean any sign, traffic island, marking or device that is placed marked or erected under the authority of this Bylaw for the purpose of regulating, warning, directing or guiding traffic. 38. "Traffic Light Signal" shall mean a lighted device operated manually, electrically or mechanically, for the purpose of directing, warning or regulating traffic. 39. "Traffic Marker" shall mean and include a cone made of rubber or other material, or other object used or intended to be used for the purpose of directing or restricting traffic on a street. 40. "U-Turn" shall mean a vehicle that has turned or is turning to proceed in the opposite direction. For the purposes of this Bylaw the turn need not be completed to constitute a U-turn. 41. "Works & Utilities Director" shall mean the Director of Works & Utilities for the City of Humboldt and anyone acting or authorized by the Works & Utilities Director to act on his behalf. (b) Wherever in this Bylaw the expression of "vehicle", "vehicular" and "vehicular traffic" is used it shall mean and be held to include for the purpose of prosecution under this Bylaw, the driver or operator. (c) Subject to Section (a) hereof, other words and expressions used in this Bylaw shall have the same meaning as given to them in The Traffic Safety Act. Section 4 Traffic Signs and Devices Authorized 4.1 Installation of Traffic Control Devices: The Works & Utilities Director is hereby authorized to install and maintain Traffic Control Devices for the purposes of the control, warning, guidance, information and direction of Traffic in conformity with this Bylaw, and the Uniform Traffic Control Devices of Canada Manual. 4.2 Inventory of Signs: The Works & Utilities Director shall keep a list of the locations of all Traffic Control Devices within the City of Humboldt, and the information shall be open to inspection at the office of the Works & Utilities Director during normal business hours. Traffic Bylaw 4 4.3 Non-Regulatory Signs: The Works & Utilities Director may authorize the erection and maintenance of any warning or direction sign, traffic marker, signal, light, or other device at any location on any Street or public parking lot, within the City that it deems necessary to warn, guide, direct or inform traffic, or for the direction of traffic or parking of vehicles. 4.4 Parking Control: In accordance with the provisions of this Bylaw, the erection of any signs, traffic markers, or signals and the painting of curbs for the purpose of controlling and regulating the parking of vehicles is hereby authorized. 4.5 Loading Zones: All loading zones as set out in Schedule "A" attached hereto and forming a part of this Bylaw are established as loading zones and the erection of "loading zone" signs for the said streets is hereby authorized. Section 5 Infractions, Restrictions and Prohibitions 5.1 No person shall erect any sign, traffic marker, signal or light or any advertising sign or device on any Street or boulevard except where authorized by a Member of the RCMP, or the Works & Utilities Director, or pursuant to authorization obtained under any other bylaw of the City of Humboldt. 5.2 No person shall deface, injure, knock down, remove, obscure or interfere with any warning or direction sign, Traffic Control Device, traffic marker, barricade, signal or light placed, erected or maintained pursuant to the provisions of this Bylaw. 5.3 Stop Signs: The provisions of The Traffic Safety Act shall apply to all Traffic approaching and facing a stop sign, erected and maintained in accordance with section 4.1. 5.4 Yield Signs: The provisions of The Traffic Safety Act shall apply to all Traffic approaching and facing a yield sign, erected and maintained in accordance with section 4.1 5.5 'U' - Turns (a) No person shall cause a vehicle to make a U-Turn between intersections or at the intersection of a street with a lane or alley in the City. (b) No person shall cause a vehicle to make a U-Turn at the intersections designated "No U-turn Intersections in Schedule "B". (c) No person operating a vehicle shall perform a U-Turn until it is safe to do so. 5.6 'No Left Turn' Signs: The provisions of The Traffic Safety Act shall apply to all Traffic approaching and facing a 'no left turn" sign, erected and maintained in accordance with section 4.1 5.7 Traffic Lights: The provisions of The Traffic Safety Act shall apply to all Traffic approaching and facing a Traffic Light Signal, erected and maintained in accordance with section 4.1 5.8 Other Regulatory or Warning Signs: The provisions of The Traffic Safety Act shall apply to all Traffic approaching and facing such signs, erected and maintained in accordance with section 4.1 5.9 Obedience of Signs: No operator of a vehicle and no pedestrian shall disobey the instructions of any traffic control device unless otherwise directed by a Member of the RCMP. Traffic Bylaw 5 5.10 Loading Zones: No person or driver of a vehicle shall remain in a loading zone, as set out in Schedule "A", for a period exceeding five (5) minutes, for the purpose of embarking or disembarking passengers or for the purpose of loading or unloading goods, provided that on the expiration of the five (5) minute period the onus of proving the embarking or disembarking of passengers or the loading or unloading of goods shall rest with the driver of any vehicle found in such loading zone. 5.11 Lug Vehicles (a) Lug Vehicles shall not be propelled, operated or driven on any City Street, Lane, or highway. (b) Operation, driving, or propelling a Lug Vehicle fitted with pads or tracks on a Street, Lane, or highway within the City, that results in any damage being incurred to a street, lane, or highway shall be the responsibility of the Lug Vehicle owner, and the Lug Vehicle owner shall be liable to compensate the City for the damages incurred, or to amend or repair the damage to the satisfaction of the Works & Utilities Director. 5.12 Chalk Marks (a) In order to determine the time which a vehicle or recreational vehicle has been parked in a location where parking is restricted to a specific time, any person authorized to enforce this Bylaw may place an erasable chalk mark on the tread base of the tire of the parked or stopped vehicle or recreational vehicle without such person or the City incurring any liability for doing so. (b) No person shall remove an erasable chalk mark while the vehicle or recreational vehicle remains parked in the location where it was marked. 5.13 Parking (a) Stop at Curb: Every driver of a vehicle shall draw up to the right-hand curb before stopping unless such stop is necessary to avoid collision or for the purpose of immediately reversing the vehicle to place it at the curb. (b)Parallel Parking: No person shall park any vehicle on any street except on the right- hand side thereof having regard to the direction in which the vehicle was proceeding, with the right front and rear wheels not more than thirty (30) centimeters from the curb, or where there is no curb with the right front and rear wheels as near to the right-hand limit of the street as is practicable; and where a parking stall has not been designated; a clear space of at least sixty (60) centimeters shall be maintained in front and/or behind any vehicle or vehicles previously in a parking position. (c) Two Hour Parking: No person shall park a vehicle for a period longer than two hours on any street or area as set out in Schedule "C" as attached hereto and forming a part of this Bylaw. (d) Exception to 2 hour Parking: The provisions of clause 5.13(c) shall not apply to the following days or times: (i) After the hour of 5:30 p.m. and before 9:00 a.m. of the next day following; (ii) A holiday as defined in the Interpretation Act, R.S.S. 1995 Chapter 1-11.2. (e) Limited Parking: No person shall park a vehicle on the 1st Street Service Road from 1st Street to Block D between the hours of 7:00 a.m. to 11:00 p.m. (f) Disabled Person's Parking Area: No person shall park a vehicle, other than a Disabled Person's Vehicle anywhere within a disabled person's parking area, as set out in Schedule "D" as attached hereto and forming a part of this bylaw. Traffic Bylaw 6 (g) Restricted Night Parking: No person shall leave a vehicle unless in charge of the driver, between 4:00 a.m. and 8:00 a.m. on any of the streets or portions thereof as set out in Schedule "E" attached hereto and forming a part of this Bylaw. (h) No Parking: No person shall park within the City in contravention of the following provisions: (i) No person shall park a vehicle at any time on any street or portion of a street, or public place as set out in Schedule "G" attached hereto and forming a part of this Bylaw. (ii) No person shall park a vehicle at any time on any street, or portion of street, designated as a School Bus Loading and Unloading Zone as set out in Schedule "I" attached hereto and forming a part of this Bylaw. (iii) No person shall park a vehicle at any time on any street, portion of street, parking lot or portion of parking lot as set out in Schedule "H" attached hereto and forming a part of this Bylaw unless specific written authorization has first been obtained from the City Manager or his appointee. (iv) No motor vehicle shall be parked on any street, lane, or public lands within the City of Humboldt unless it displays license plates valid for the current year or a valid permit in lieu thereof. (v) No person shall park a vehicle whether occupied or unoccupied within a "fire lane". (vi) Subsection (v) shall not apply to any person operating a law enforcement or emergency vehicle while attending to an emergency. (vii) No person shall park a vehicle at any time on any sidewalk or boulevard or any portion thereof. (viii) No person shall park a vehicle within any area in any park, playground, public reserve or City owned property, or any property which the City, or any Board appointed by the City controls, manages, or supervises, and which area has been designated by the Works & Utilities Director as a no parking area. (ix) No person shall park a vehicle on any Sidewalk Crossing, or any public or private driveway crossing so as to obstruct the crossing, and the passage of vehicles through the crossing. (i) Temporary Street Closures: Any portion of a street may be temporarily closed to vehicular traffic by a Member of the RCMP or by resolution of Council of the City of Humboldt in order that pedestrians may have the exclusive use thereof. (i) Notwithstanding any other provisions of this Bylaw, the Works & Utilities Director, and/ or a Member of the RCMP shall have the authority to temporarily prevent parking on any street or portion thereof whenever in his judgment it may be necessary in order to avoid traffic congestion, danger or accident. (ii) Notwithstanding any other provisions of this Bylaw, the Works & Utilities Director shall have authority to temporarily prevent parking and/or prohibit traffic on any street or portion thereof to allow any work to be carried out by or on behalf of the City, Traffic Bylaw 7 such work to include but not be restricted to the snow removal, cleaning, repairing, or maintenance of such street. (iii) Notwithstanding any other provisions of this Bylaw, Council may by bylaw prohibit parking on the whole or any portion of the frontage of any lot which abuts a street. No person shall park along any portion of any street so marked by painting on the curb and/or placing of signs. (iv) A Member of the RCMP and/or Works & Utilities Director shall have the authority to have or cause to have signs, warning devices, pavement markings, barricades or barriers to be erected, placed or painted upon the roadway right-of-way or a street for the legal control, warning, guidance, direction or information of traffic on the streets, highways and lanes in the City of Humboldt. All such signs, warning devices, pavement markings, painting, barricades, or barriers erected, placed or painted upon any such street or right-of-way shall be deemed to have been authorized by the Works & Utilities Director and/ or A Member of the RCMP. (v) No person shall park a vehicle on any street or portion thereof on which parking has been temporarily prohibited by a Member of the RCMP or the Works & Utilities Director under the provisions of this Bylaw. (j) Parking at Intersection and Sidewalk Crossing: No person shall park a vehicle within six (6.0) meters of any street crossing or intersection or within 3.05 meters on either side of any sidewalk crossing. (k) Stopping in Lane: No person shall stop or park a vehicle in any lane except in the ordinary course of their business for the purpose of discharging or taking on cargo or passengers. (l) 48-Hour Limit: No person shall park a vehicle continuously on any street, or highway in the City or on municipality-owned property for a period exceeding 48 hours, except where permission by the City Manager has been granted to extend such parking time. (m) Blocking Private Driveway: No person shall park a vehicle on any street in such manner as to block an entrance to or exit from a private driveway. (n) Unloading Cargo: Notwithstanding the provisions of Section 5.13 (k), a farm truck or commercial vehicle may be parked in any lane for the purpose of taking on or discharging cargo, provided no such truck or vehicle shall be so parked for a period exceeding thirty (30) minutes at one time, unless written permission has first been obtained from the City Manager or a Member of the RCMP for an extension of such time limit. (o) Fire Hall Entrances: No person shall park a vehicle so as to block or obstruct a vehicular entrance to a Fire Hall. (p) Yellow Curbs: No person shall park a vehicle in any area where curbs have been painted yellow. (q) Double Parking: No person shall double park a vehicle, whether occupied or unoccupied, upon any street. (r) Fire Hydrants: No person shall park a vehicle within three (3) meters of any fire hydrant. Traffic Bylaw 8 (s) Private Property: No person shall park a vehicle at any time on any private property of which such person is not the owner, occupant, licensee, or permittee, except with the consent of the owner, occupant, licensee or permittee. (t) 48-Hour Non-Passenger Vehicle Limit: No person shall park a non passenger vehicle, motor home, fifth wheel trailer, travel trailer, recreational vehicle, boat, boat trailer, trailer, cargo trailer, or any similar vehicle, whether attached or unattached, on any street for more than forty-eight (48) hours at any time. Further, no person shall move such vehicle or permit a vehicle to be moved from one location to another in the same block so that the cumulative time parked in that block exceeds the 48 hour maximum parking time limit. (u) Storage of Trailers, Motor Homes and Recreational Vehicles: Non passenger vehicles, motor homes, fifth wheel trailers, travel trailers, recreational vehicles, boats, boat trailers, trailers, cargo trailers, or any similar vehicle, whether attached or unattached, may be stored on driveways on residential lots in compliance with the following provisions: (i) No vehicle mentioned in this section shall be parked on the driveway of any residential lot unless the end of the vehicle most closely located to the sidewalk on any Street, is setback a minimum of two (2) metres from the inside edge of the sidewalk; (ii) No vehicle mentioned in this section shall be parked on the driveway of any residential lot unless the end of the vehicle most closely located to the curb of any Street on which there is no sidewalk, is setback a minimum of two (2) metres from the inside edge of the curb; (v) Bus Parking: No person shall park a bus on any City street, other than for the purpose of allowing passengers to embark or to disembark, with the following exceptions: (i) school buses at schools or at other locations to which students have been transported for school related activities. (ii) Saskatchewan Transportation Company buses parked at its depot; (iii) any other circumstance where such parking has been permitted by the City Manager or his delegate. 5.14 Speed Limit (a) Speed Limit On Municipal Roads: No person shall drive a vehicle within the City of Humboldt except at a careful and prudent speed having regard to all the circumstances, but at no time shall the speed exceed forty (40) kilometers per hour unless otherwise posted. (b) Speed Limit On Provincial Highways: Nothing contained in this section shall apply to the routes of the Provincial Highways lying within the incorporate area of the municipal boundaries where the speed limit is governed by the provisions fixed by or under The Traffic Safety Act. (c) Specified Speed Limits: Unless otherwise posted, the following speed limits shall apply to the following locations: (i) No person shall operate a vehicle on 5th Avenue between 17th Street and the west grid road in excess of fifty (50) kilometers per hour. (ii) No person shall operate a vehicle on Peck Road South of Highway No. 5 to 4th Avenue in excess of fifty (50) kilometers per hour. (iii) No person shall operate a vehicle in any posted school zone in excess of thirty (30) kilometers per hour between the hours of Traffic Bylaw 9 8:00 a.m. and 5:00 p.m. from Monday to Friday, both days inclusive, school holidays exempted. 5.15 Heavy Vehicles (a) Heavy Vehicle Route: No person shall drive a Heavy Vehicle on any street or portion of a street except those set out in Schedule "F" attached hereto and forming part of this Bylaw. The streets or portions thereof as set out in Schedule "F" are hereby established as "Heavy Vehicle Route" and the erection of signs denoting the Street as a Heavy Vehicle route is hereby authorized. (i) This subsection shall not apply to any persons operating a Heavy Vehicle owned by the City of Humboldt while actually in use in the service of the City; and (ii) this subsection shall not apply to heavy vehicles being operated for the collection or delivery of goods within the City limits if such Heavy Vehicle is proceeding to or from a point of collection or delivery by the most direct route from the heavy vehicle route; and (iii) this subsection shall not apply to heavy vehicles proceeding to or from a garage for the purpose of repairs or servicing provided that the most direct route to and from the heavy vehicle route be observed. (b) Heavy Vehicle Parking: No person shall park a Heavy Vehicle on any street except: (i) On the Heavy Vehicle Route as set out in Schedule "F", and not for a period exceeding 24 hours. (ii) In the Commercial or Industrial area to permit the loading or unloading of merchandise, provided however that such loading or unloading of merchandise is restricted to such lengths of time as is absolutely necessary. (c) Authority to Weigh Vehicle: A Member of the RCMP or Bylaw Officer having reason to believe that the gross weight of vehicle and/ or its load is in excess of 5,455 kilograms, may weigh the same by means of a stationary scale and may require the person in charge of the vehicle to take the vehicle to the nearest scale. 5.16 Transportation of Dangerous Goods: (a) Prescribed Dangerous Goods Route: No person shall drive any vehicle carrying Dangerous Goods in the City of Humboldt except on the "Heavy Vehicle Route" as set out in Schedule "F". (b) Parking Prohibited: No person shall park any vehicle, trailer or tanker that is identified as carrying Dangerous Goods on any street within the City limits, even if such vehicle, trailer, or tanker is empty. However, vehicles identified as carrying Dangerous Goods are permitted to park and immediately unload at the proper locations that deal with these goods. (c) Dangerous Goods Vehicles to be Identified: All vehicles carrying Dangerous Goods shall be properly licensed and identified by appropriate placard, and the load properly secured. 5.17 Motorized Recreational Vehicles: No person shall drive a mini-bike, or a two or three- wheeled motorized vehicle that is not capable of being licensed under The Highway Traffic Act of the Province of Saskatchewan, on any street, sidewalk, park, playground, public reserve or on any property owned or controlled by the City of Humboldt. Traffic Bylaw 10 5.18 Parades (a) Parade to be Authorized: No parade shall be held in the City without written approval first being obtained from the City as to the hour and route of the parade. (b) Participation in Unauthorized Parade: No person shall organize or participate as a member of a parade unless such parade has been first duly authorized by the City. (c) Interference with Parade: No driver of a vehicle or any pedestrian shall cross through any parade or in any way obstruct or interfere with the same, except in the case of an emergency. 5.19 Sight Line Obstructions (a) Street Sight Lines to be Maintained: The owner or occupant of a lot which abuts the intersection of two Streets, shall not plant, grow, or allow the growth of any tree, shrub or plant, or build, permit to be built, or maintain any fence, item, or other structure which which exceeds a height of one (1) meter above the level of the edge of the nearest Street; and which is located within the triangular area formed by measuring from the corner of the lot property line nearest the intersection of the two Streets, to the linear point of 6 metres along the property line in either direction. (b) Lane Sight Lines to be Maintained: The owner or occupant of a lot which abuts the intersection of a street and a lane, shall not plant, grow, or allow the growth of any tree, shrub or plant, or build, permit to be built, or maintain any fence, item, or other structure which exceeds a height of one (1) meter above the level of the edge of the nearest Street and which is located within the triangular area formed by measuring from the corner of the lot property line nearest the intersection of the Street and the Lane, to the linear point of 3 metres along the property line in either direction. (c) Removal of Obstructions Authorized: Upon receiving a report from a Member of the RCMP, Bylaw Officer or the Works & Utilities Director, that a hedge, shrub, tree, fence, or other item situated on residential property near an intersection obstructs the sight lines of vehicular traffic in contravention of provisions 5.19(a) or 5.19(b), the City may order such hedge, shrub, tree, fence or other item be removed or shortened to such a height as may be deemed necessary by the City to remove the obstruction of traffic sight lines. 5.20 Miscellaneous Regulations for Vehicle Operation (a) Leaving Stationary Position: The driver of a vehicle when turning out from a stationary or driving position or entering the flow of traffic at the side of a street or from the curb shall yield the right-of-way to all traffic. (b) Stopping in Intersection: No driver of a vehicle shall stop any vehicle within an intersection except to avoid an accident. (c) Towing: No vehicle shall tow more than one motor vehicle at a time. (d) Fire Hoses: No person shall drive a vehicle over a fire hose while a fire is being tended or during any fire practice that may be in session. (e) No Splashing of Pedestrians: When water, mud or slush is lying on any street, the driver of every motor vehicle thereon shall so reduce the speed of his motor vehicle to avoid splashing any pedestrian. (f) Driving on Playgrounds and Parks: No person shall drive a vehicle upon or across a playground, park or public reserve which the City or any Board appointed by the City for that purpose controls, supervises or manages. (g)Unnecessary Noise: No person shall drive a motor vehicle upon a parking lot, Street, Lane, or other place in such a manner as to cause the tires to make excessive, unusual or unnecessary noise. Notwithstanding the generality of the foregoing, the squealing of tires shall be deemed excessive noise. Traffic Bylaw 11 (h)Throwing Gravel: No person driving a motor vehicle upon a parking lot, Street, Lane, or other place shall accelerate the vehicle to such an extent so as to cause the tires to slide, spin or throw gravel or other substance. (i) Stop Before Crossing: Every person driving a vehicle shall, before entering a street from a public or private driveway, bring the vehicle to a full stop before crossing a sidewalk or boulevard and shall not proceed until it is safe to do so. (j) Entering an Intersection: No person driving a vehicle shall enter an intersection unless there is sufficient space on the other side of the intersection to accommodate the full length of the vehicle without obstructing the passage of pedestrians or other cross traffic. Provided however, that these prohibitions shall not apply to any intersection where a Member of the RCMP is on duty directing traffic or to a vehicle in the intersection making a left hand turn where a traffic light signal is in operation. (k) Obstructing Traffic: No pedestrian or driver of a vehicle, whether making deliveries from the vehicle or not, shall obstruct, interfere with, or interrupt the free passage of traffic on any street, lane or driving lane of any street or sidewalk. (l) Power Turns: No operator of a vehicle may execute a Power Turn on any street, lane or parking lot in the municipality. (m) Backing a Vehicle: No driver of a vehicle shall back the vehicle around the corner of a lane or intersection. (n) No Weaving: No operator of a vehicle shall operate the vehicle in such a manner as to weave in and out of traffic faster than nearby vehicles, thereby interfering with the driving of other vehicles. (o) Boarding a Moving Vehicle: No person shall step off, or shall attempt to step off, or board, or catch, or hold on to any motor vehicle while it is in motion. (p) Horses and Cattle: No person shall allow horses, cattle or other livestock on any Street. Section 6 Emergency Control Measures 6.1 In the case of fire, accident, or other emergency situation, or in order to expedite traffic or safeguard pedestrians or prevent accidents or meet any unforeseen condition a Member of the RCMP is hereby authorized to direct traffic in such manner as he may deem necessary whether or not in conformity with the provisions of this Bylaw or The Traffic Safety Act. 6.2 Every person shall comply with any traffic signal or direction of a member of the RCMP given pursuant to this section. 6.3 The provisions of this Bylaw with respect to the rules of the road and parking shall not apply to emergency vehicles when such vehicles are being used in the course of emergency duty. Emergency vehicles shall be fire vehicles and apparatus, ambulances and police vehicles. Section 7 Impounding of Vehicles 7.1 Impound Authorized: In addition to any penalties or fees imposed pursuant to Section 8 hereof, any Member of the RCMP, the Works & Utilities Director or Bylaw Officer may remove or cause to be moved or removed, any vehicle that is unlawfully parked, placed, left or kept on any Street, public highway, public parking place, other public place, or City owned property. Traffic Bylaw 12 7.2 Any vehicle removed pursuant to Section 7.1: (a)Shall be impounded and stored at the City compound or any other place authorized by a Member of the RCMP, the City Manager, the Works & Utilities Director, or the Bylaw Officer, at the cost of the owner for a period of thirty (30) days after the date of removal of the vehicle unless the costs of any outstanding fines, and the costs of removal, impoundment, administration, and storage as set out in Schedule K, are sooner paid; (b) May be released to the owner on payment of the cost of removal, impoundment and storage, and any outstanding fines within 30 days after the date of the removal of the vehicle. 7.3 Recovery of Costs: If the vehicle is not redeemed within 30 days pursuant to Section 7.2: (a) the vehicle shall be dealt with as lost or unclaimed personal property; and (b) The City shall have the right to recover from the owner of the vehicle the costs of removal, impoundment, administration, and storage, including the actual cost of advertising, by: (i) action in a court of competent jurisdiction, (ii) sale of the vehicle by public tender (iii) by private sale of the vehicle where the vehicle cannot be disposed of by public tender. 7.4 Notwithstanding Sections 7.1-7.3, any person empowered pursuant to Section 7.1 to move or remove vehicles may cause the removal of a vehicle stopped or parked in contravention of Section 5.13(i)(v) within a temporarily closed Street and may deposit that vehicle at a location on a public highway or Street in proximity to the original location of the vehicle so moved. 7.5 Sale Proceeds: The proceeds from such sale shall be applied firstly on the costs owed to the City, and the balance remaining (if any) shall be paid to the owner, if there is any shortfall between the costs incurred and the proceeds of the sale, the amount of the shortfall shall be a debt due and owing from the owner and enforceable by the City in any manner allowed by law. Section 8 Penalties and Fees 8.1 A person who is guilty of a violation of any provision of this Bylaw is liable to a fine in the specified sum set out in Schedule "J" attached hereto. 8.2 A person who is guilty of a violation of any provision of this Bylaw, for which no penalty has been otherwise specified in Schedule "J", is liable to a fine in the specified amount of $100.00. 8.3 The penalties and fees set out in the attached Schedule "J" may be amended by resolution of Council, from time to time. Section 9 Seizure and Sale of Vehicles for Unpaid Fines: Any Member of the RCMP, or any person authorized by the City Manager may, in accordance with The Cities Act, seize and sell any vehicle owned by a person against whom a fine has been imposed and which remains unpaid. Section 10 Enforcement 10.1 Application of Act: The provisions of The Summary Offences Procedure Act and Regulations respecting summary offence ticket information and voluntary penalties shall apply where consistent with the provisions of this Bylaw. 10.2 Voluntary Payment: Where any person has committed or is alleged to have committed a breach of any of the sections of this Bylaw, a ticket in a form to be approved by Council may be served on such person. Such person may pay to the City Hall or deposit appropriate payment in night deposit box located at City Hall. Upon receipt of appropriate payment for the penalty as provided in Section 8, and in accordance with Schedule J hereof prior to any legal action commencing, there will be no prosecution Traffic Bylaw 13 respecting the alleged violation. 10.3 Service of Ticket: Service of such ticket may be made by attaching same to the vehicle in respect of which an offence has been committed or by mailing such ticket addressed to the registered owner of the vehicle concerned, or by personal service on the person who has committed the offence. Section 11 Amendment to Schedule: Any or all schedules to this Bylaw shall form part of this Bylaw and may be amended as necessary by resolution of Council. Section 12 All to Comply: A person who contravenes any of the provisions of this Bylaw or with any notice or order given hereunder has committed an offence and shall be liable to the penalty and fees as herein provided. Section 13 Owners Responsibility 13.1 In this section, the following words shall have the following meanings: (i) "Authorized Person" means a person who is in charge of a vehicle with the express or implied consent of the owner of the vehicle; (ii) "Owner" means, with respect to any vehicle, the person to whom a current certificate of registration or registration permit for a vehicle is issued; (iii) "Unauthorized Person" means a person who is in charge of a vehicle without the express or implied consent of the owner of the vehicle. 13.2 Where a vehicle is used in the commission of an offence against this Bylaw the Owner of the vehicle is liable for the offence, as well as any other person who may have actually committed the offence, unless the Owner proves to the satisfaction of the court that, at the time of the offence, the vehicle: (i) Was not being operated and had not been parked or left by the owner; and (ii) Was not being operated and had not been parked or left by any Authorized Person in charge of the vehicle. 13.3 Where at the time of the commission of any offence against this Bylaw the vehicle was not being operated and had not been parked or left by the Owner or by any Authorized Person in charge of the vehicle, the Unauthorized Person in charge of the vehicle is liable for the offence, as well as any other person who may have actually committed the offence, unless the Unauthorized Person in charge of the vehicle proves to the satisfaction of the court that, at the time of the offence, the vehicle: (i) Was not being operated, and had not been parked or left by that Unauthorized Person in charge of the vehicle; and (ii) Was not being operated and had not been parked or left by any person in charge of the vehicle with the express or implied consent of that Unauthorized Person in charge of the vehicle.
