## BYLAW 2025-06
A Bylaw to Regulate the operation of All Terrain Vehicles in the Town of Kamsack
The Council of the Town of Kamsack in the Province of Saskatchewan enacts as follows:
## Title
1. This Bylaw may be referred to as "The ATV Bylaw."
## Authority
2. "The Act" which regulates this bylaw is This All Terrain Vehicle Act and the All Terrain Vehicles Regulations.
## Definitions
3. In this Bylaw:
- a) "All Terrain Vehicle" means all terrain vehicles as defined in The All Terrain Vehicles Act.
- c) "Public Land" means public land as defined in The All Terrain Vehicles Act.
- b) "Highway" means a highway as defined in The Traffic Safety Act.
5. "Private Land" means land other than public land.
- f) "Vehicle" means a vehicle as defined in The Traffic Safety Act.
7. "Provincial Highway" means a provincial highway as defined in The Highways and Transportation Act.
- g) "Municipality" means the Town of Kamsack.
9. "Immediate Family" shall mean their parents or grandparents or siblings.
10. "Residence" shall mean a property within the Town of Kamsack.
## Qualified Person:
4. A "Qualified Person" shall:
- a) Be at least 16 years of Age;
- c) Have a minimum of $200,000 third party liability insurance. This document must be available with the person driving the ATV if requested at the time of the stop.
- b) Hold a valid driver's license;
- d) Must have a helmet and appropriate protective eye wear.
6. Must not be intoxicated.

## Now therefore:
5. No person shall operate an All Terrain Vehicle on any Public Lands within the corporate limits of the Municipality.
6. No person shall operate an All Terrain Vehicle on any Private Lands that is not owned by the person or that person's immediate family with in the corporate limits of the Municipality without written consent of that person whose lands the vehicle is located on.
7. All Terrain Vehicles must be trailered, or trucked, into and out of the Municipality.
8. The use of All Terrain Vehicles is approved while in operation of snow removal or landscaping on private or Town owned property but the qualified driver must go by the most direct route between the person's residence and the place where the work is being completed;
9. Any applicable sections of The All Terrain Vehicles Act and corresponding regulations shall apply to the operations of All Terrain Vehicles in the Municipality.
10. The provisions of this bylaw shall not apply to:
- b) The use of All Terrain Vehicles during a declaration of local emergency within the Municipality;
- a) A member of the Royal Canadian Mounted Police, Conservation Officer, Auxiliary Police, or Bylaw Enforcement Officers while exercising their duties as an officer of the law;
- c) The use of All Terrain Vehicles during events approved by the Municipality;
- e) Town employees, including those in the Kamsack Volunteer Fire Department, in the exercise of their duties for the Town.
- d) A land surveyor or contractor registered in the Province of Saskatchewan in the performance of duties of surveying land or construction work with in the Municipality;
11. No person shall operate an All Terrain Vehicle greater than twenty (20) kilometers per hour within the Municipal limits.
12. No section of this Bylaw shall supersede or preside over any section of The Traffic Safety Act and corresponding Regulations, or The All Terrain Vehicles Act and corresponding Regulations.

13. Every person who contravened a provision within this bylaw is guilty of an offense and liable on summary conviction as set out in the All Terrain Vehicles Act and corresponding Regulations.
## Coming into Force
14. This Bylaw shall come into force and take effect on the day of final passing thereof.
