BYLAW 07-2020
A BYLAW TO REGULATE AND CONTROL THE USE AND CONSUMPTION OF WATER
FROM THE TOWN OF KYLE WATERWORKS AND CONTROL AND REGULATING THE
DISCHARGE OF SEWAGE FROM THE TOWN OF KYLE SEWAGE SYSTEM AND TO FIX
RATES AND CHARGES FOR THE TOWN OF KYLE WATER AND SEWAGE SYSTEMS.
Council of the Town of Kyle, in the Province of Saskatchewan, enacts as follows:
1. This Bylaw shall be cited as "The Water and Sewer Management Bylaw".
2. Persons wishing to be supplied with water from the water system must make
application to the Administrator of the Town of Kyle.
3. The utility consumer deposit shall be refunded upon service being discontinued
provided all water and sewage charges have been paid in full.
4. A water service shall not be activated until a water meter, as supplied by the
municipality, has been installed in a safe and accessible location. The
installation must be done by a qualitied trades person at the expense of the
consumer or by the Public Works maintenance personnel at the Town's
expense.
5. The Town of Kyle shall have the right to limit the amount of water furnished
to any consumer should circumstances be deemed to warrant such action.
6. No person shall discharge into any drain, sewer or sewerage system operated
by the Town of Kyle, any harmful matter, substance or thing, whether liquid or
solid, that would be injurious to health, life or property, that would injure,
pollute or damage any stream , watercourse, drain, sewer, sewerage system or
sewage treatment plant.
7. The charges to be paid by the water consumer whose water service has been
turned on shall be those as set forth in Schedule 'A' attached hereto, provided
however, that the minimum rate stated in Schedule 'A' shall be payable in
every case, whether or not water is consumed.
8. Water consumption, only, will be invoiced to the Rural Municipality of
Lacadena #228 in accordance with sections 5 and 6 for the operation of the
water stand as set out in Schedule 'A' attached.
9. Persons who own or occupy premises drained, or that are by bylaw required to
be drained into the town of Kyle's sewage system shall pay for such services a
rental rate or service charge in accordance with Schedule 'B' attached hereto;
provided however, that the minimum rate stated in Schedule 'B' shall be
payable in every case whether or not sewage is drained, provided water services
to the premises is activated.
10. Water meters shall be read monthly by Remote Meter Read System at the end
of the month.
11. Meters not able to by read by Remote Meter Read System will receive a
minimum billing as those set out in Schedule 'A' attached.
12. a. Invoices for water and sewer will be sent out monthly, and are due and
payable upon receipt.
b. Invoices, not paid in full within ninety (90) days of billing date, will be
issued a final notice by regular mail indicating that unless satisfactory

payment arrangement are made within ten (10) days of that notice, the
Town of Kyle may discontinue water service without any further notice.
Further that the Town of Kyle will not be held responsible for any
damages or inconvenience incurred should the discontinuance of water
service be performed.
c. Interest of 1.5% per month will be charged on past due accounts.
d. All outstanding accounts that are over 90 days old and not paid by
December 31 of the current year may be transferred to the tax roll or to a
collection agency.
13.
a. When the water service is cut off for non-payment, a disconnection fee of
Fifty dollars ($50.00) shall be added to the individual water account. If
the disconnection is at a time other than the municipal employees'
regular working hours, the disconnection fee shall be One Hundred and
Fifty dollars ($150.00) and added to the individual water account.
b. When water service is disconnected for non-payment, same shall not be
turned on until all penalties, fees, rates, charges, and arrears have been
paid, including a reconnection fee of Fifty dollars ($50.00). In the event
that reconnection to the said service is at a time other than the
municipal employees' regular working hours, the reconnection fee shall
be One Hundred dollars ($100.00).
c. Property owners who request a water turn off for periods of time where
the residence is vacant will have only the water and sewer rates stopped.
d. Property owners who own a habitable residence and/or have a water
meter installed or the ability to install a water meter and have a
temporary or longer absence from that residence shall be charged the
monthly fee for the SLRWPU Operating charge of $10.00 and SLRWPU
Mainline charge of $25.00 and the Town of Kyle Debenture charge of
$10.00 as set out in Schedule "C".
e. Commercial property with water and sewer service will be subject to
SLRWPU and Town of Kyle Debenture charges as in (d) above.
f. Derelict or abandoned buildings are exempt at the discretion of the
Administrator or Council.
14. Any person who tampers with and causes any loss, damage, injury or tampers
with any public utility service provided by a municipality or to any property
used in providing the public utility service, whether owned by the municipality
or not, is liable to the owner for that loss, damage or injury. (The Municipalities
Act 30)
15. Any person who contravenes any provision of this bylaw for which no other
penalty is provided will be guilty of an offence and liable upon summary
conviction to penalties provided under the general penalty bylaw of the
municipality.
16. Bylaw 12-2018 and Bylaw 12-2019 are hereby repealed.
The rates, charges, tolls or rents contained in this bylaw shall come into force and
take effect on the day of approval being issued by the Local Government
Committee, or 1st day of April 2020 whichever is the later.
