TOWN OF MAPLE CREEK BYLAW NO. 2020-MC-21 A BYLAW OF THE TOWN OF MAPLE CREEK TO ESTABLISH REGULATIONS AND TO FIX THE RATES TO BE CHARGED FOR THE USE AND CONSUMPTION OF WATER AND TO FIX THE RATES TO BE CHARGED BY WAY OF SERVICE FOR THE USE OF SEWER. The Council of the Town of Maple Creek, in the Province of Saskatchewan, enacts as follows: 1. This Bylaw may be cited as the Water Bylaw. 2. The charges to be paid by the water consumer whose water service has been turned on shall be those set out in Schedule "A" attached; however, the minimum or flat rate shall be payable in every case whether or not any water is consumed. 3. Persons who own or occupy premises drained or that are by bylaw required to be drained into the sewer shall pay for such services a rental rate or service charge in accordance with Schedule "B" attached. 4. Accounts shall be paid within a period of thirty days from the date on which such accounts are rendered. If an account is not paid within the period of thirty days, the water service may be shut off. When the water service is shut off, it shall not be turned on until all arrears have been paid, together with a fee of $100.00 to cover the expenses of shutting off the water and turning it on again. Notwithstanding the foregoing, if it is required that water service be turned on outside Town employees' regular working hours of 8 a.m. to 5 p.m. Monday to Friday, the fee shall be $200.00. 5. No water user shall: a. Lend, sell or dispose of the water service; b. Give away the water service or permit it to be taken; c. Use any water service other than for his/her own benefit; d. Use their water service to supply water to another residence; or e. Alter, modify or tamper with the water meter. 6. Residential and commercial residents desiring to be supplied with water from the Town's water supply system shall make written application as set out in Schedule "C" attached. Any purchaser who has entered into an executed agreement for sale or a rent-to-own purchase agreement or any such agreement must provide a notarized copy of said agreement to the Town of Maple Creek. 7. In the case of non-occupancy, if water services are turned off at the curb stop, all other utility charges will be waived. Requests to shut off the water supply at the curb must be made in writing as per Schedule "D" and payment of fees as prescribed in Schedule "A". 8. Utility billings shall be processed quarterly: a. First Quarter January, February & March Estimated Reading Second Quarter April, May & June Estimated Reading Third Quarter July, August & September Actual Reading Fourth Quarter October, November & December Estimated Reading b. Estimated billings in the first, second and fourth quarter shall be calculated based on previous consumptions. TOWN OF MAPLE CREEK BYLAW NO. 2020-MC-21 c. Actual water meter readings for the third quarter billing shall commence during the month of September. Every meter shall be read except that instance where a water reading is unavailable because of the absence from Town of the user. The reading of the meter may be left until the quarter following the users return to Town. 9. There shall be a flat rate for water service as set out in Schedule "A" for each quarter of a year. The charge shall be prorated for periods of less than three months. The service charge shall be the minimum amount charged for water service in each quarter. 10. There shall be a flat rate for sewer service as set out in Schedule "B" for each quarter of a year. The charge shall be prorated for periods of less than three months. The service charge shall be the minimum amount charged for sewer service in each quarter. 11. Outdoor watering of lawns and gardens is restricted as per Schedule "E" attached; however, the Town shall have the right to further ration or restrict the quantity of water furnished to any and/or all consumers by resolution of Council at any time should circumstances seem to warrant such action. 12. Notwithstanding Section 11, a property owner who plants new lawn or lays sod may apply to obtain a permit as per Schedule "F" attached to allow for watering daily and outside of the restricted times; however, Council reserves the right to withdraw such permits at any time that more stringent water restrictions may be implemented as circumstances may warrant. Such permits will not be issued for existing lawns. 13. In the case of default in the payment of any water rates or water deposit by the owner or occupant within thirty (30) days after the utility bills have been mailed, an official of the Town authorized to do so, may, without giving notice, shut off the water supply from any land or premise in respect of which the payment of any said rates or meter deposits are in arrears or default. 14. If the water supply is shut off from the premises of a user for infringement of the provisions of this bylaw, same shall not be turned on until all penalties, fees and arrears have been paid. 15. A monthly penalty of 1.5% compounded (19.5% yearly) will be added to all outstanding water and sewer accounts. 16. Any persons or businesses charged as per the rates set out in Schedule "B" attached hereto for sewer cleaning done by the Town of Maple Creek which remain unpaid for a period of one (1) month from the date of billing, shall have these charges added to their sewer charges. 17. If the person to whom a public utility service is supplied is the owner of the land or building to which a public utility service is supplied, the sum payable by him for the public utility service and all rates and costs imposed pursuant to any bylaw passed pursuant to this Part are a lien on the land and building which has priority over all other liens or charges save that of the Crown and are a charge on the goods and chattels of the debtor and may be levied and collected in the same manner as taxes are recoverable. Water and sewer charges that are in arrears 90 days or more from the date of billing may be added to the taxes of the assessed owner(s) of the property. 18. Any person who contravenes any of the provisions of Section 5 of this Bylaw shall be liable upon summary conviction to a fine of not less than $50.00 and not more than $1,000.00. Any person who contravenes any of the provisions of Sections 13 and 14 shall be subject upon summary conviction to a fine of $50.00 for the first offence, $100.00 for the second offence and $500.00 for each subsequent offence. 20. Bylaw No. 2014-MC-18 is hereby repealed. 21. The rates, charges, tolls or rents contained in this bylaw and attached schedules shall come into force and take effect on the date of approval being issued by the Saskatchewan Municipal Board. Odd numbered addresses shall be allowed to use water for outdoor purposes on odd numbered calendar days. 2. Even numbered addresses shall be allowed to use water for outdoor purposes on even numbered calendar days. 3. No outside watering shall be permitted between the hours of 9:00 am and 6:00 pm regardless of whether it is an even or odd numbered day. 4. Notwithstanding the foregoing, Council reserves the right to permanently or temporarily alter the watering restrictions set out herein by resolution at any time that it is deemed as necessary or advisable to do so. 5. The Mayor or any other member of Council may further restrict the use of water in emergencies such as fire or other emergency where abnormal amounts of water are required. 6. Water restrictions shall apply to a new lawn except in those cases where a valid permit to water has been duly authorized by the Town of Maple Creek. 7. The water restrictions set out herein shall be in effect January 1 to December 31 of each year. 8. The Town Administrator or his/her designate are hereby authorized to give information to the RCMP for the purpose of fines imposed under this bylaw. TOWN OF MAPLE CREEK BYLAW NO. 2020-MC-21 SCHEDULE "F" NEW LAWN WATERING PERMIT Watering permits may be issued at the Town Office at a cost of $60.00 for a 14-day permit. No more than two (2) such permits will be issued to any property owner in any given year. The permit shall be printed on 11" x 17" paper and be substantially of the following design, including the Town logo watermark, and must bear the original signature of an authorized representative of the Town of Maple Creek.
