CITY OF MELFORT
BYLAW NO. 2013-02
A BYLAW TO PROVIDE FOR THE REMOVING AND CLEARING OF SNOW, ICE, DIRT
AND OTHER OBSTRUCTIONS FROM THE SIDEWALKS AND PRIVATE PROPERTY
WITHIN CERTAIN SPECIFIED AREAS OF THE CITY
The Council of the City of Melfort, in the Province of Saskatchewan, enacts as follows:
1.
For the purpose of this Bylaw, the words "occupant" and "owner" shall have the meaning
given thereto by The Cities Act.
2.
The Owner and/or the Occupant of every building, lot or parcel of land situated in the area
specified in Schedule "A" attached and forming a part of this Bylaw, shall remove down to
the hard compacted portion of the surface of the sidewalk all snow, ice, dirt and other
obstructions from the sidewalks in front of and about the premises.
3.
Sidewalks shall be cleared, as specified in Section 2 above, on business days within 24 hours
of a snowfall.
4.
A person cleaning a sidewalk or boulevard within the area designated by Schedule "A' is
permitted to place snow or ice in the gutter.
5.
Except as allowed in Section 4, no person shall deposit or permit, employ or direct any other
person to deposit on or in any street or lane within city limits any snow, ice, dirt or other
obstruction that has been removed from private property.
Penalties

Every person who contravenes any provision of this Bylaw, or fails to comply therewith, or
with any notice or order given hereunder, shall be guilty of an offence and liable to a penalty
of $50.00 per offence or incident.

(1)
Any person convicted of a breach of this Bylaw shall forfeit and pay at the discretion
of the Provincial Magistrate or Justice of the Peace having jurisdiction in the City of
Melfort the penalties as provided in the Bylaw, and upon default of payment thereof
the person convicted may be committed to jail, the guard room of the Royal Canadian
Mounted Police, or to a public lockup for any time determined by the provincial
Magistrate or Justice of the Peace, not exceeding thirty (30) days, unless the penalty
and the costs of committal and conveyance of the person convicted to jail, guard
room or lockup, are sooner paid.
(2)
(a)
A violator of this Bylaw, upon being served with a notice or order, may
voluntarily pay the penalty prescribed in Section 6 of this Bylaw at the Office
of the City Treasurer at City Hall, Melfort, Saskatchewan.
(b)
Where the Treasurer receives voluntary payment of the prescribed amount,
the person receiving the notice of violation shall not be liable to prosecution
of the alleged contravention.
(c)
Nothing in this section shall be construed to prevent any person from
exercising his right to defend a charge of contravention of this Bylaw.
(3)
(a)
Where a person fails to do anything required by this Bylaw, the City of
Melfort may, in default of its being done by that person, do the thing at the
expense of the person in default, and the City may recover the expenses of
doing so with costs by adding the expenses to, and thereby they form part of,
the taxes on the land on which or with respect to which the work was done.
(b)
Any persons against whom remedial action is taken pursuant to subsection
3(a) shall also be liable to prosecution for contravention of the Bylaw.
Enactment
8.
This Bylaw shall come into force and take effect on the date of the final passing thereof.
9.
Bylaw No. 2007-26 is hereby repealed.
