BYLAW NO. 03/2016 A BYLAW OF THE CITY OF MELVILLE, PROHIBITING, CONTROLLING AND REGULATING THE KEEPING OF CERTAIN LIVESTOCK, ANIMALS, ETC.WITHIN DESIGNATED AREAS OF THE CITY The Council of The City of Melville enacts as follows: 1. DEFINITIONS (a) Livestock shall mean any animal belonging to a species of animal, other than canine or feline, that is usually raised in captivity for the purpose of the production of offspring, the production of offspring, the production of animal products as defined by The Animal Products Act, or for the commercial sale of the animal or any part of it whether it is edible or inedible including fertilized ova, fish and bees; whether or not that animal is actually being raised in captivity for any of those purposes. (b) Poultry shall mean any bird raised in captivity for the purpose of: (1) The production of offspring (2) The production of any animal products as definite by The Animal Products Act; or (3) Commercial resale of the bird or any part of it whether edible or inedible, any by-product of the bird including fertilized or unfertilized ova 2. REGULATIONS (a) No person shall keep any bees, livestock, poultry, pigeons and any animal reared for the bearing of fur, (excepting Chinchillas and rabbits), within the limits of the City of Melville except the following areas, namely - (1) The E ½ of Section 28, Township 22, Range 6, West of 2nd and M. - South of Highway #15 East (2) The E ½ of Section 33, Township 22, Range 6, West of 2nd and M.- Agri Park (3) Block E, Plan 101778846 - South of Highway #15 (4) All that area of the City of Melville lying South of the Main Line of the Canadian National Railway. (b) This section shall not prohibit the operating of Hatcheries wherever permitted by the Zoning Bylaw of the City of Melville, nor the sale of the product of hatcheries by merchants in Melville where such product comes directly from this hatchery. (c) This section shall not prohibit the keeping of poultry by persons engaged in the processing and preparation of dressed poultry for sale to the wholesale trade in and beyond the City of Melville. 3. PENALTIES (a) Any infraction or contravention of this Bylaw shall be subject to the penalties as set out in The General Penalty Bylaw of the City of Melville. 4. REPEAL (a) Bylaw 10/70 is hereby repealed. INTRODUCED AND READ A FIRST TIME this 5th Day of April, 2016. READ A SECOND TIME this 5th Day of April, 2016.
