CITY OF MELVILLE
BYLAW NO. 20/2010
A BYLAW OF THE CITY OF MELVILLE IN THE PROVINCE OF
SASKATCHEWAN TO PROHIBIT THE OPERATION OF MINI BIKES,
TRAIL BIKES OR ALL-TERRAIN VEHICLES WITHIN THE BOUNDARIES
OF THE CITY OF MELVILLE.
THE COUNCIL OF THE CITY OF MELVILLE, IN COUNCIL ASSEMBLED, ENACTS AS
FOLLOWS:
1. For the purpose of this bylaw, the term "Public Property" shall include but not be
limited to all streets, roads, lanes, waterways, parks, public reserves, publicly
owned parking lots, grounds of City owned buildings and City owned property.
2. No person shall drive or operate a mini bike, trail bike, or an all-terrain vehicle on
public property within the boundaries of the City of Melville. This section shall not
apply to:
a)
maintenance vehicles of the City or contractors of the City.
b)
special events organized by other groups provided application is
made to and approved by City Council.
3. Members of the Royal Canadian Mounted Police are hereby authorized and
empowered to impound for a period not less than five (5) days and not more than
thirty (30) days a mini bike, trail bike or all-terrain vehicle, being driven in
contravention of this bylaw. No impounded mini bike, trail bike or all-terrain
vehicle shall be released unless the impounding charge and storage charges are
first paid.
4. Any person who contravenes any of the provisions of this bylaw is guilty of an
offense and liable, upon summary conviction:
a) For the first offence to a fine of not less than Fifty ($50.00) dollars nor more than
Two Hundred ($200.00) dollars;
b) For a second and subsequent offence to a fine of not less than One Hundred
($100.00) dollars nor more than Three Hundred ($300.00) dollars;
c) Where damage is done to a property by an unlawful act under this bylaw, the
presiding Judge shall adjudge payment of all damages occasioned by the
unlawful act and the same shall be applied for the repair and reconstruction of
the property damaged or destroyed.
5. This bylaw shall into force and effect immediately after the final passing thereof.
