BYLAW NO. 27/99
A BYLAW OF THE CITY OF MELVILLE TO PERMIT AND REGULATE THE OPERATION
OF SNOWMOBILES IN CERTAIN AREAS WITHIN THE CITY OF MELVILLE.
The Council of the City of Melville, in the Province of Saskatchewan, enacts as follows:
1.
This Bylaw shall be known and may be cited as "The Snowmobile Bylaw".
2.
Wherever in this Bylaw the following words or terms are used, they shall, unless the context
otherwise provides, be held to have the following meaning:
a)
"Acts" shall mean The Snowmobile Act and the Highway Traffic Act.
b)
"Operator" shall mean a person who uses or operates, or is in actual physical control of
a snowmobile.
c)
"City" shall mean within the corporate limits of the City of Melville, Province of
Saskatchewan.

The purpose of this Bylaw is to approve the location of a Snowmobile Trail, known as the
Perimeter trail, within the limits of the City of Melville.
4.
The designated route for the Perimeter trail as shown on the map attached hereto as Schedule
"A" to this Bylaw, shall be an authorized route for snowmobiles coming into or leaving the
City.
a)
No person shall operate a snowmobile within the City of Melville except on the
Perimeter trail as shown on Schedule "A".
b)
No person shall operate a snowmobile on the Perimeter trail unless the operator holds
a valid driver's license, has a trail permit and the snowmobile is registered.
c)
No person shall operate a snowmobile on the Perimeter trail between the
hours of 11:00 p.m. and 7:00 a.m.
c)
No person shall operate a snowmobile on the Perimeter trail at a speed in excess of 50
kilometres per hour.
d)
No person shall operate a snowmobile on the Perimeter trail except in single file.
e)
No person shall operate a snowmobile on that part of the Perimeter trail which goes on
3rd Avenue, Dielschneider and 1st Avenue (Highway 15) in the opposite direction of
the normal traffic flow.
5.
Members of the Royal Canadian Mounted Police, the Special Constable and the Bylaw
Enforcement Officer are hereby authorized and empowered to impound for a period up to
thirty (30) days any snowmobile being driven in contravention of this bylaw. No impounded
snowmobile shall be released unless the impounding charge and storage charge are paid.
6.
Charges:
a)
impounding charge is $100.00
b)
storage charge is - $2.00 for each day impounded
7.
Any person who contravenes Section 3 (a) to (f) of this bylaw is guilty of an offence and liable
on summary conviction:
a)
for the first offence to a fine of up to $500.00 and in default of payment of the fine the
person convicted may be committed to jail or to a public lock up for any time
determined by a Judge of the Provincial Court or Justice of the Peace not exceeding
thirty (30) days, unless the fine is sooner paid.
b)
for a second or subsequent offence to a fine of up to $1,000.00 and in default of
payment of the fine the person convicted may be committed to jail or to a public lock
up for any time determined by a Judge of the Provincial Court or Justice of the Peace
not exceeding thirty (30) days, unless the fine is sooner paid.
8.
The owner of the snowmobile is liable for a contravention of any provision of this bylaw in
connection with the operation of the snowmobile unless he proves that at the time of the
offence the snowmobile was not being operated by him nor by any other person with his
consent.
9.
Bylaw No. 4/96 is hereby repealed.
10.
This bylaw shall come into force and take effect on the date it is approved by the Highway
Traffic Board of Saskatchewan.
