CITY OF MELVILLE
BYLAW NO. 14/2018
A BYLAW OF THE CITY OF MELVILLE, SASKATCHEWAN TO AMEND
ZONING BYLAW NO. 04/2013 BY ESTABLISHING REGULATIONS TO
ALLOW FOR CANNABIS RETAIL OUTLETS AND CANNABIS PRODUCTION
FACILITIES
The Council of the City of Melville, in open meeting assembled, enacts as follows:
That Bylaw No. 04/2013 of the City of Melville approved on the 8th day of October, 2013
be amended as follows:
1. Part 2 - Definitions
addition of the following:
Cannabis - cannabis as defined in The Cannabis Act (Canada).
Cannabis Production Facility - the federally licensed large-scale growing of
cannabis plants and harvesting material from those plants, or the large-scale
manufacturing, packaging and labelling of cannabis products destined for sale to
consumers, and the intra-industry sale of these products, including to provincially
authorized distributors, or both.
Cannabis Retail Outlet - the premises specified in a retail cannabis permit where
the retail sale of cannabis is authorized by The Cannabis Control Act
(Saskatchewan). This includes the sales of dried cannabis, cannabis plant seeds,
cannabis plants, fresh cannabis, edibles containing cannabis, and cannabis
concentrates.
2. Part 5 - Special Provisions
Addition of the following provisions:
5.11 CANNABIS RETAIL OUTLET
5.11.1 A Cannabis Retail Outlet shall:
a) Comply with all applicable Municipal, Provincial, and Federal Regulations; and
b) Be separated from the nearest site line of a public education facility,
playground, child daycare centre, library or municipal recreation centre by a
minimum distance of 150 metres.
3. Part 6 - Zoning Districts, Schedule F: Central Commercial District (C1) addition
of the following type of development within section1 Permitted Uses:
e. Cannabis Retail Outlet
4. Part 6 - Zoning Districts, Schedule G: Highway Commercial District (C2) addition
of the following type of development within Section 1 Permitted Uses:
o. Cannabis Retail Outlet
5. Part 6 - Zoning Districts, Schedule H: Industrial District (M)
addition of the following type of development within section 1 Permitted Uses:
s. Cannabis Production Facility
6. This Bylaw shall come into force on the date of the final reading.
INTRODUCED and READ A FIRST TIME this 16th Day of July, 2018.
READ A SECOND time this 7th Day of August, 2018.
READ A THIRD TIME AND PASSED by consent of members present this 7th Day of
August, 2018.
