## BYLAW NO. 2022-13 BURNING BYLAW
## A Bylaw of the Town of Midale, in the Province of Saskatchewan to Regulate the Burning of Refuse,
## Operation of Fuel Burning Equipment and Backyard Fire Pits
The Council of the Town of Midale, in the Province of Saskatchewan, enacts as follows:
## SHORT TITLE
- This bylaw shall be referred to as the "Burning Bylaw".
## PURPOSE
2. The purpose of this bylaw is to regulate the burning of refuse, operation of fuel burning equipment, and backyard fire pits within the Town of Midale.
## DEFINITIONS
3. All terms and expressions used in this bylaw shall have the same respective meaning as outlined in The Environmental Management and Protections Act, 2010 and The Municipalities Act.
## PROVISIONS
- (a) Incinerators
No person shall cause or permit to be caused the burning of trash, refuse, garbage, industrial waste, or any other waste material in any manner or in an incinerator within the Town of Midale.
- (b) Barbecues
- the barbecue is used in a reasonable and safe manner;
Residential outdoor barbecues using propane, natural gas, or charcoal for the purpose of cooking are permitted as long as:
- ii. the lit barbecue is a sufficient distance from all combustible materials;
- iii. the lit barbecue is not left unattended;
- iv. any ashes or hot coals are disposed of in an appropriate manner.
4. (c) Fire Pits
- a. a minimum of three (3) meters (10 feet) clearance from buildings, property lines, or other combustible material;
- i. Fire pits are only allowed upon receiving a Town of Midale Fire Pit Permit, approved by the Fire Chief, as set out in Schedule "A" of this bylaw, and are to be located in back yards only with the following regulations:
7. the burning area is not to exceed one (1) meter (3 feet) in width, height or diameter when measured between the widest points;
- ii. At least one (1) responsible adult shall be in attendance to monitor and control the fire and have available means to extinguish the fire should an emergency situation develop.
- C. the fire pit or fireplace shall be made of non-combustible material.
- ili. The fire pit shall be used in a manner which does not cause any inconvenience to neighbours.

- iv. The only material permitted for burning shall be clean wood products with no preservatives, or prefabricated burning logs.
## PENALTIES
- Any issues of non-compliance are to be reported to the Town Office.
5. Any person who violates or fails to comply with any of the provisions of this bylaw is guilty of an offence and liable upon summary conviction to the penalties as set out in the General Penalty bylaw of the Town of Midale.
## REPEAL OF PREVIOUS BYLAW
6. Bylaw No. 09-96, Bylaw No. 99-01 are hereby repealed.
## COMING INTO FORCE
7. This Bylaw shall come into force and take effect upon final passing thereof.
