## A BYLAW TO REGULATE ## THE RUNNING AT LARGE OF CATS AND DOGS ## BYLAW NO. 2018-07 The Council of the Village of Mortlach in the Province of Saskatchewan, under the provision of subsection 100(1) of The Municipalities Act, enacts as follows: ## Interpretation 1. For the purpose of this bylaw the expression: - a) "dog and cat" shall mean either male or female over six months old; - b) "Municipality" shall mean the Village of Mortlach: - c) "Running at large" shall mean when the cat or dog is beyond the boundaries of the land occupied by the owner, possessor, or harbourer of the said cat or dog, or beyond the boundaries of said lands where it may be with the permission of the owner or occupant of the said land and when it is not under control by being: 4. in direct continuous charge of a person competent to control it; or 5. securely confined within its enclosure; - (111) securely fastened so that it cannot roam at will. ## Infraction of a Bylaw 2. A person residing in the municipality who owns, possesses, or harbours a cat or dog, and neglects to or refuses to confine or securely fasten same is deemed guilty of an infraction of this bylaw. 2. No person shall keep more than 3 dogs or 3 cats within the limits of the municipality. 3. (b) A person who owns, possesses, or harbours more cats or dogs as specified in 5(a) shall be deemed guilty of an infraction of this bylaw. 4. (a) No cat or dog shall run at large in the municipality. - (0) A person who owns, possesses, or harbours a cat or dog found running at large shall be deemed guilty of an infraction of this bylaw. 5. (a) Any person may take any cat or dog found running at large contrary to the provisions of this bylaw to the municipal pound, where it shall be kept for three days unless the owner, possessor, or harbourer redeems the cat or dog by paying the Poundkeeper any charges requested by the Municipal Pound. 7. The Poundkeeper may sell any cat or dog which is not redeemed within three days. 6. a) ## Penalties (Note: For a penalty clause, you may use either clause a), or b). 9. a) (1) A person found guilty of an infraction of any of the provisions of sections 3. 4, or 6 of this bylaw shall be liable on summary conviction to a penalty - (2) The Notice of Violation shall be in Form "A", attached to and forming part of this bylaw. - (1) A person found guilty of an infraction of any provision of this bylaw shall be liable to penalties provided by the Municipal Pound in Moose Jaw, Saskatchewan. - (2) The Notice of Violation shall be in Form "B", attached to and forming part of this bylaw. - c) (1) A person who contravenes any of the provisions of this bylaw or fails to comply therewith, or with any notice or order given thereunder shall be guilty of an offence and upon conviction, shall be liable to a penalty of $100.00 for each offence. 6. A violator of this bylaw, upon being served with a Notice of Violation, may, during office hours, voluntarily pay the penalty at the Municipal Office, and upon payment as so provided, that person shall not be liable to prosecution of the offence. - (3) The Notice of Violation shall be in Form "C", attached to and forming part of this bylaw. 8. This bylaw shall come into force and take effect upon approval by the Minister of Municipal Affairs. This bylaw will replace any and all previous Cat and Dog at large - (i) Section 3- $ 100.00 - (ii) Section 4- $ 150.00 Read a first time this 11 day of September, 2018.
