## TOWN OF NOKOMIS BYLAW NO. 2021-06 A BYLAW OF THE TOWN OF NOKOMIS, IN THE PROVINCE OF SASKATCHEWAN, TO FIX THE RATES TO BE CHARGED FOR THE USE AND CONSUMPTION OF WATER, BY WAY OF SERVICE CHARGE FOR THE USE OF SEWER, AND BY WAY OF SERVICE CHARGE FOR INFRASTRUCTURE The Council of the Town of Nokomis in the Province of Saskatchewan enacts as follows: ## 1. PROVISIONS - 1.1 The charges are to be paid by the water consumer whose water services has been turned on shall be those set out in Schedule "A," which is attached hereto and forms part of this Bylaw, provided, however, that the minimum shall be payable in every case whether or not any water is consumed. - 1.2 The bulk water rates for the Pipe Stand located at 102 1s* Ave West shall be those set out in Schedule "A," which is attached hereto and forms part of this Bylaw. - 1.3 Persons who own or occupy premises drained or that are, by bylaw, required to be drained in the sewer shall pay for such services a service charge in accordance with Schedule "B," which is attached hereto and forms part of this Bylaw. - 1.4 Persons who own or occupy premises drained into the waterworks and sanitary sewer system shall pay an infrastructure fee in accordance with Schedule "B," which is attached hereto and forms part of this Bylaw. All collected infrastructure fees are dedicated solely for utility upgrades, repairs and loan payments. - .5 All persons connected to waterworks service and/or sanitary sewer service shall be billec quarterly and payable within 60 days of the date of billing or services will be disconnecter without further notice. - 1.7 There shall be allowed a discount of 5% on minimum fees/services that are prepaid for the year in advance, providing that such payment is made by March 31t in each year. - 1.8 Landlords shall be responsible for the payment of all utilities including infrastructure fees for he premises that they own if rented out. ## 2. SEVERABILITY - 2.1 A decision of the court that one or more of the provisions of this Bylaw are invalid in whole or in part does not affect the validity, effectiveness or enforceability of the other provisions or parts thereof with respect to this Bylaw. 3. REPEAL - 3.1 Bylaw No. 2018-02 being a Bylaw for fixing rates for 2019-2022 to be charged by way of rent or service charges for the use of water, water meters and sewer, against persons who own or occupy premises connected to water and sewer or may be required by Bylaw to be connected to the system is hereby repealed. ## 4.
