CITY OF NORTH BATTLEFORD
SASKATCHEWAN
BYLAW NO. 1675
A BYLAW OF THE CITY OF NORTH BATTLEFORD IN THE
PROVINCE OF SASKATCHEWAN, TO PROHIBIT THE
OPERATION
OF
ALL
TERRAIN
VEHICLES,
SNOWMOBILES, MOTOR VEHICLES, MOTORCYCLES,
MOTOR
BIKES
AND
MINI-BIKES
IN
PARKS,
PLAYGROUNDS OR PUBLIC RESERVES IN THE CITY OF
NORTH BATTLEFORD.
WHEREAS it is deemed advisable to prohibit the operation of all terrain vehicles,
snowmobiles, motor vehicles, motorcycles, motor bikes, mini- bikes and other like
vehicles in parks, playgrounds or public reserves in the City of North Battleford;
NOW THEREFORE pursuant to Subsection 157(c) of The Urban Municipality Act, 1984,
the Council of the City of North Battleford in open meeting assembled enacts as follows:
1.
Interpretation
In this Bylaw the expression:
a)
"City" shall mean the City of North Battleford.
b)
"Council" shall mean the Council of the City of North Battleford.
c)
"Mini-bike" and "Motor bike" shall mean a vehicle propelled by motor power but
is not licensed or capable of being licensed under the provincial statutes.
d)
"Motorcycle" and "Motor Vehicle" shall have the same meaning as defined in
The Highway Traffic Act of the Province of Saskatchewan.
e)
"Snowmobile" means a snowmobile as defined in The Snowmobile Act.
f)
"All Terrain Vehicle" means an all terrain vehicle as defined in The All Terrain
Vehicles Act.
2.
No person shall drive or operate an all terrain vehicle, snowmobile, motorcycle,
motor bike, any motor vehicle or a mini-bike or other like vehicle whether it is
licensed or not or whether it is capable of being licensed or not on, or in any of the
following without the permission of the City:
a)
Any boulevard, park or playground within the corporate limits of the City.
b)
Any public reserve either owned or leased and controlled by the City.

c)
Any vacant land owned or leased and controlled by the City except land areas
specifically designated by resolution of Council permitting the operation of all
terrain vehicles, snowmobiles, motorcycles, motor vehicles, mini-bikes, motor
bikes or other like vehicles.
3.
In addition to prohibitions set out in Section 2 hereof, no person shall drive or
operate a mini-bike or motor bike in any public parking lot or parking area within the
City.
4.
a)
Members of the City Detachment of the Royal Canadian Mounted Police are
hereby authorized and empowered to seize and impound for a period of up to
thirty (30) days any all terrain vehicle, snowmobile, motorcycle, motor vehicle,
motor bike, mini-bike or other like vehicle being driven or operated in
contravention of this Bylaw.
b)
No impounded all terrain vehicle, snowmobile, motorcycle, motor vehicle,
motor bike, mini-bike or other like vehicle shall be released unless the
impounding charge, if any, and storage charges are first paid.
c)
Impounding and storage charges are to be established by resolution of
Council.
5.
Any person who contravenes any of the provisions of this Bylaw is guilty of an
offence and liable, on summary conviction:
a)
for the first offence to a fine of not less than $50.00 nor more than $100.00 and
in default of payment to imprisonment for a term not exceeding thirty (30) days;
and
b)
for a second or subsequent offence to a fine of not less than $100.00 nor more
than $200.00 and in default of payment to imprisonment for not more than sixty
days.
c)
Where damage is done to property by an unlawful act under this Bylaw, the
presiding Judge of the Magistrates' Court or the Justice of the Peace may
adjudge payment of all damages occasioned by the lawful act and the same
shall be applied for the reparation and reconstruction of the property damaged
or destroyed.

6.
That Bylaw No. 1184 is hereby repealed.
7.
This Bylaw shall come into force and take effect on the day of the final passing
thereof.
