## BYLAW NO. 285.
## A BYLAW TO CONTROL DOGS IN THE TOWN OF OGEMA

The Council of the Town of Ogema, in the Province of Saskatchewan, enacts as follows:
1. In this Bylaw:
- a. owner" includes:
1. Every person within the Town of Ogema who owns, possesses or harbours a dog.
## but does not include:
- ii. a veterinarian registered pursuant to The Veterinarians Act, 1987, who is keeping or harbouring a dog (dangerous dog) for the prevention, diagnosis or treatment of a disease of or an injury to a dog or dangerous dog.
- ili. an Urban Municipality or the Saskatchewan Society for the Prevention of Cruelty to Animals in respect of an animal shelter or impoundment facility operated by it.
- b. "dangerous dog" shall mean :
- ii. any dog that, without provocation, has bitten, inflicted injury, assaulted or otherwise attacked a person or domestic
5. i.. * any dog without provocation, in a vicious or menacing manner, chases or approaches a person or domestic animal in an apparent attitude of attack;
- iii. any dog which is owned primarily or in part for the purpose of dog fighting or is trained for fighting.
- c. «Pet Enforcement Officer" shall mean any individual appointed by the Town of Ogema for the purpose of enforcing this bylaw.
- a. No owner shall keep, possess or harbour a dangerous dog within the boundaries of the Town of Ogema
- b. Any person who contravenes Subsection (a) of Section 2 of this bylaw is guilty of an offence and liable to a fine of $500.00.
3. a. No person shall harbour or keep more the two (2) dogs in the Town of Ogema in one dwelling unit regardless of the ownership of the dogs..
- C. A dwelling unit in this Section shall mean "a single room or series of rooms of complementary use which are located in a building in which food preparation, eating, living, sleeping an sanitary facilities are provided for the exclusive use of the occupants thereof; which has a private entrance directly from outside the building or from a common hallway or stairway inside the building; and in which all occupants have access to all the habitable areas and facilities of the unit.
- b. No person or persons shall harbour any dogs other than in a dwelling unit or on the property the dwelling unit is located.
- d. Young puppies may be kept with the mother for a period not exceeding 90 days following birth.
- e. Any person who contravenes Subsection (a) of Section 3 is guilty of an offence and liable to a fine of $100.00 for every dog harboured or kept exceeding two.
- f. The dog licence fee shall be set by resolution of Council in January of each year...
