BYLAW NO. 7/2023
A BYLAW OF TOWN OF PENSE TO FIX THE RATES TO BE CHARGED FOR THE USE AND CONSUMPTION OF
WATER AND TO FIX THE RATES TO BE CHARGED BY WAY OF RENT OR SERVICE CHARGE FOR THE USE OF
SEWER
COUNCIL of the Town of Pense, in the Province of Saskatchewan, enacts as follows:
1.
The charges to be paid by the water consumer whose water service has been turned on shall be those set out
in Schedule "A" attached; provided, however, that the minimum shall be payable in every case whether or not
any water is consumed.
2.
Persons who own or occupy premises drained or that are by bylaw required to be drained into the sewer shall
pay for such services a rental rate or service charge in accordance with Schedule "B" attached.
3.
An infrastructure charge for water plant and wastewater lift station upgrades shall be applied as set forth in
Schedule "C" attached.
4.
Accounts for water service and/or sewer service shall cover a period of one month and shall be invoiced on
the first business day of the following month. Accounts shall be paid within thirty days from the date on
which such accounts are invoiced. If an account is not paid within thirty days, the water service may be cut
off. When the water service is cut off, it shall not be turned on until all arrears have been paid, together with
a disconnect fee of $50.00 and reconnect fee of $50.00 to cover the expenses of turning off the water and
turning it on again; provided that if it is required to turn on the water service outside the employees' regular
working hours, the fee shall be set at $100.00 per hour.

All rates, costs or charges that remain unpaid after December 31 in any year, shall be transferred to the tax
roll of the owner and may be levied and collected in like manner as municipal rates and taxes are by law
recoverable. This process may occur whether the service was supplied to the owner or tenant of the land or
building, if the municipality has provided prior notice to the owner or tenant that the charges for utility
services to the parcel are in arrears and if the municipality has:
i) sent a registered letter to each of the owner and tenant respecting the unpaid charges and the
consequences of the unpaid charges at least 30 days before the amounts are to be added to the tax
roll;
The costs of the registered letter/s and an administration fee of $25.00 per utility account to notify the owner
and tenant, as listed above will be added to the utility account for which the notifications are being sent.
6.
A penalty of 3.0% per month will be applied to all utility accounts that remain outstanding 30 days past the
date of issue.
7.
Bylaw No 2/2021 is hereby repealed.
THE rates, charges, tolls or rents contained in this bylaw shall come into force and take effect on the day of approval
being issued by the Local Government Committee.
