## A BYLAW OF THE NORTHERN VILLAGE OF PINEHOUSE TO FIX THE RATES TO BE CHARGED FOR THE USE AND CONSUMPTION OF WATER AND TO FIX THE RATES TO BE CHARGED FOR THE USE OF SEWER
Council of the Northern Village of Pinehouse, in the Province of Saskatchewan, enacts as follows:
## 1. DEFINITION
- a) In this Bylaw, the words Person, Persons, Customer, Customers, Consumer, Consumers, are synonymous and mean the person or persons, organization, corporations, etc responsible for the payments of charges for water and sewer services.
- b) Foreman - means the person employed by the Northern Village of Pinehouse, in the capacity of foreman of Public Works and Utilities, with responsibility for the administration of all public words and utilities under the jurisdiction of Council.
## 2. WATERWORKS SYSTEM
- 1) Every person requesting to have his premises connected to the waterworks system shall apply to the Northern Municipality for that service.
2. Every person requesting to receive water service shall apply to the Northern Municipality office for that service in a form as per Schedule "A" of this bylaw. No service will be given in and any existing service may be discontinued without notice, where no application has been submitted to the municipal office.
- 3) The charges to be paid by consumers whose water service has been turned on shall be those presently set forth in Schedule "B" hereto, or as amended from time to time.
- 4) Accounts for water service covering a period of one month shall be entered on or before the first day of each month. Such accounts shall be paid in full before the next billing date. In case an account is not paid within that period, the water service may be discontinued, and when so discontinued, shall not be resumed until all arrears have been paid, together with a fee of twentyfive dollars ($25.00) to cover the expense of turning it on again. The billing schedule may be varied at the discretion of Council.
- 5) The collection of the charges for water services, cut off, and the continuation of such service and sums collected from customers and the supervision of all books, accounts, and other records in connection with the water service shall be under the immediate control and direction of the Northern Municipality.
- 6) No person other than the Mayor, Foreman, or a person authorized by any of them, or member of the Fire Department, in case of a fire, shall open, close, or interfere with any hydrant, gate, or valve connected with the waterworks system, and no person shall in any way interfere with any other waterworks appliance outside of his premises.
- 7) No person shall turn water on in any premises, or open a curb stop, except for the Mayor, Foreman, or a person authorized by any of them. When water has been turned off for the non-payment of rates, or for failure to protect pipes to the satisfaction of the foreman, or for any other necessary or proper reason, no person shall turn it on again, who is not duly authorized to do so
8. All expenses in connection with laying the service pipe from the street line into any premises and repairing the same, introducing the water, shall be borne by the owner of such premises. All such work shall be carried out to the satisfaction of the foreman, and in accordance with his instructions.
9. For the purpose of making repairs to the mains or connecting or repairing service pipes or constructing extensions or new work or any other work, the Northern Municipality shall have the right to shut off the water from any customer without notice, and to keep it shut off as long as it may be necessary to enable the work to be completed. Whenever feasible, the customer shall be notified 24 hours in advance.
- 10) The Northern Municipality, the members of Council, and its employees shall not be liable for any damages resulting from the discontinuance of water supply with or without notice, to any building, boiler, or factory deriving its supply from the waterworks system.
- 11) The council shall have the right by resolution to discontinue the supply of water for fountains or jets, hoses, or sprinklers, or to limit the hours for using the same.
- 12) Every customer intending to vacate any premises supplied with water from the waterworks system, or who intends to discontinue the use of such water, shall give seven days notice to the Northern Municipal Office, and shall turn off the main valve on the inside of the building before leaving.
- 14) In premises, except dwelling and apartment blocks, where more than one (1) occupancy exists, each occupant shall be charged the full rate, as set out in Schedule "B" to this Bylaw.
- 13) No person, being tenant or occupant of any house or building supplied with water by the Northern Municipality shall sell or dispose of the water, or permit the same to be sold or disposed of to others, or wrongfully neglect to close water taps, or repair defective installations, or to do any act or thing which will result in the waste of water.
- 15) The rental or service charges payable, hereunder, shall be paid at the Northern Municipality office.
- 16) Approved heat tapes shall be installed from the building to the curb stop, in connection with all services, and connected to tape at the curb stop, and which is installed from the main stop to the curb stop, and shall be used to prevent freeze-ups. Any damage caused to the water line between the main stop and the building by failure to use tape for purposes intended, will be charged to the. property owner.
## SEWAGE SYSTEM
- Persons who own or occupy premises drained, or required by Bylaw to be drained into a sewer shall pay for such services at a monthly rental rate or service charge, in accordance with Schedule "C" hereto.
- 2) Rental rates for service charges imposed by this bylaw shall commence at, and from the time the sewage line is installed.
- 3) The rental or service charges payable hereunder shall be paid at the Northern Municipal office.
- 4) Accounts for the rent or service charge shall be billed and be payable in accordance with the provisions as set forth in subsection 2(4).
- 5) All expenses in connection with laying the service pipe from the street line into any premises and repairing the same shall be carried out to the satisfaction of the foreman, and in accordance with his instructions. The expense incidental to the removing of an obstruction or blockage from a sewer service connection from the main to the building shall be borne solely by the owner or occupant of the property.
- In premises, except dwellings and apartment blocks, where more than one (1) occupancy exists, each occupant shall be charged the full rate as shown in Schedule "C" to this Bylaw.
- No person shall discharge into the sewer lines any gasoline, grease, cooking grease or fats, inflammable or explosive substances.
4. GENERAL
- For the purpose of this bylaw, the payment by a consumer of any rates or levies charged hereunder shall constitute acceptance of a contract for the supply of such services between the Northern Municipality and such consumer, in accordance with this Bylaw and subsequent amendments, which may be enacted from time to time.
- 2) Any person found guilty of an infraction of any of the provisions of this Bylaw shall upon summary conviction, be liable to the penalties provided for in the General Penalty Bylaw of the Northern Muricipality.
5. REPEAL
2. Bylaws 02-01, 03-07 and 01-13 are hereby repealed.
6. COMING INTO FORCE
- 1) THE rates, charges, tolls or rents contained in this Bylaw shall come into force and take effect on the day of approval being issued by the Local Government Committee (Mayor and Council).

It is understood that if I do not make a payment within the 30 days before the next billing date, the service will be disconnected, and a charge of twenty-five ($25) dollars will apply for turning it on again.
I further agree to pay to the Northern Village of Pinehouse the sewer and water charge effective the date of this application.
I hereby further agree to pay to the Northern Village of Pinehouse written notice of at least seven (7) days of the date that the water and sewer service to the above mentioned building is to be discontinued, and that I am responsible for payment of the billing until the date given on the notice of termination of service.
