## TOWN OF REDVERS ## BYLAW NO. 330/95 THE COUNCIL OF THE TOWN OF REDVERS IN COUNCIL ASSEMBLED ENACTS AS FOLLOWS: - NOISE BYLAW This bylaw may be cited as the "Redvers Noise Control Bylaw". ## E. DEFINITIONS - 12) "Motor vehicle" means a vehicle propelled or driven by any means other than by muscular power. - (1) "Council" means the Council of Redvers. - (3) "Noise" includes any loud outcry, clamour. shouting or movements, or any sound that is louc or harsh or undesirable, including the sound of exploding fireworks, firecrackers less than 3 inches in length and paper percussion caps. 4. {5) "Property" means real property and includes land. other thar a highway. together with al1 improvements which have been so affixed to the land as to make them in fact and in law part thereaf. - (4) "Person" includes any company; corporation, owner. - (8) "Signaling device" means a horn, gong, bell, siren or other device producing an audible Sound for the purpose of drawing people's attention to an approaching vehicle. including a bicycle. - (7) "Town" means the Town of Redvers. ## 3. Town or of persons in the vicinity. - (3) No hawker, huckster, peddler, newsvendor, or other person shall by his intermittent or reiterated cries disturb the quiet, peace, rest. i enjoyment, confori on convenience of individuals or the public. 6. {4) No person shall operate a snow vehicle. motorboat motorcycle which makes or causes noise in such a manner as to disturb the quiet, peace, rest, enjoyment: comfort on convenience of neighborhood of the Town or of persons in the vicinity. - (5) No persons in the Town shall on any day before 8:00 a.m. or after 10:00 reconstruct, alter, repair or densinsh construct, erect, structure or thing or excavate or fill in land in any manner which disturbs the quiet. comfort on convenience the neighborhood or of persons in the vicinity" ## EXCEPTIONS - {1) the ringing of bells or playing of musie by churches; religious establishments and schools. - The provisions of this Bylaw shall not apply to: - 12) the moderate use of musical instruments to call attention to an opportunity to contribute to a collection made for a charitable undertaking at any time. - {4) the sounding oF a factory whistle and similar devices at normal appropriate times. - (3) the playing = band, sounding whistles LiSC à signalling device. sounding of motor vehicles" horns or anplification equipment used in connection with any parade. - (5) the sounding of police whistles, signalling devices; or the sirens on any vehicle used by the police fire department or on any ambulance public service vehicle" - (6) of sound amplification equipment used by the police, fire department or any ambulance service or public service. - (8) the sounding of motor vehicle horns when used within reason. - (7) the use in a reasonable manner of any apparatus on mechanism for che amplification of the human music in a public park or any other commodious space in connection with any public election meeting, public celebrations or other reasonable gathering- - (9) notwithstanding any provisions of this bylaws person nay perform works of emergency nature For the preservation or protection of life, health or property. - {10) notwithstanding any provision of this bylan a person may detonate fireworks subject to provisions of Bylan No. 327/95. ## 5. PENALTY SECTION - {1) Every person who violates any of the provisions of this bylan on who suffers or permits any act or thing to be done in contravention or in viclation oF any of the provisions of this bylaw, who neglecis to do or refrains fron doing anything reguired to be done by any of the provisions of tris bylaw or who does any act which violates any of the provisions of this bylaw, is guilty of an offence against this bylaw and liable to penalties hereby imposed. - (2) What is a noise to disturb the comfort on repose of any person or persons so as to justify a prosecution under this Bylaw is a question of fact for the Court that hears a prosecution of an offence against this Bylaw. - < 3) By way of corroboration of other evidence, the court which hears prosecution of an offence against this Bylaw may infer from the evidence of = peace officer relating to the conduct of any person or persons that the comfort and repose of persons within the limits of the Municipality was disturbed. - (4) Any person who contravenes any provision of this Bylan is guilty of an offence and is liable en sunmary conviction to a fine not less than $50.00 nor greater than 3200.00. 5. The Council of the Town of Redvers in the Province of Saskatchewan enacts as follows: 1. Amend Bylaw 330/95 by adding the following at the end of "General Regulations" - (6) THAT Engine Retarder brakes will be prohibited.
