## BYLAW NO 7-10
## A BYLAW TO PROHIBIT ANIMALS IN DESIGNATED AREAS
The Council of the Rural Municipality of Beaver River # 622 in the Province of Saskatchewan enacts as follows:
1. This bylaw may be referenced as the "Animal Control Bylaw"
2. For the purpose of this bylaw, the expression:
3. (a) "administrator" shall mean the administrator of the municipality;
4. (C) "designated officer" shall mean that person designated by the council of the municipality;
5. (b) "council" shall mean the council of the municipality;
6. (d) "designated area" shall mean
7. (e) "domestic animal" shall mean
8. (i) That portion of Reserve MR1 Plan 79B02314 described as Waterfront and Beach Area adjacent to The Shores Subdivision
9. (i) any cattle or other animal of the bovine species, and horse or other animal of the equine species, any sheep, goat or swine or any inter-species hybrid of those animals; or
10. (ii) any animal that is tamed for domestic purposes including a dog or cat;
11. (f) "municipality" shall mean the Rural Municipality of Beaver River # 622.
3. A person who owns, possesses or harbours a domestic animal found within the prohibited areas shall be deemed guilty of an infraction of this bylaw.
4. Where the Designated Officer believes that a person has contravened any provision of this Bylaw, he may serve upon such person a Bylaw Violation Notice as provided by this section either personally or by mailing or leaving same at his last known address and such service shall be adequate for the purpose of this Bylaw.
5. Such notice shall be deemed to have been served:
15. (b) on the day of actual delivery, if the notice is served personally; or
16. on the expiration of twenty-four hours after it is posted, if the notice is mailed;
17. (c) on the business day following the transmission, if given by facsimile.
6. A Bylaw Violation Notice shall be in such form as determined in Schedule # 7/10 and shall state the section of the Bylaw, which was contravened, and the amount, which is provided in Schedule #7/10 (A) that will be accepted by the Municipality in lieu of prosecution.
7. Upon production of a Bylaw Violation Notice issued pursuant to this section within twenty (20) days from the issue thereof, together with the payment of the fee as provided in Schedule # 7/10 (A)to the Administrator of the Municipality, the person to whom the ticket was issued shall not be liable for prosecution for the contravention in respect of which the ticket was issued.
8. Where any person contravenes the same provision of this Bylaw two or more times within one twelve month period, the specified payment payable in respect of the second or subsequent contravention is double the amount shown in Schedule # 7/10 of this Bylaw in respect of that provision.
9. Notwithstanding the provisions of this section, a person to whom a Bylaw Violation Notice has been issued pursuant to this section may exercise his right to defend any charge of committing a contravention of any of the provisions of this Bylaw.
