## BYLAW NO. 8-2023
## A BYLAW TO REGULATE AND CONTROL THE OPERATION OF ALL TERRAIN VEHICLES WITHIN THE RURAL MUNICIPALITY OF EXCEL NO. 71
The Council of the Rural Municipality of Excel No. 71, in the Province of Saskatchewan, enacts as follows:
1. This bylaw may be cited as "The ATV Bylaw".
2. In this bylaw, the following definitions apply:
- a) "Act" means The All Terrain Vehicles Act;
- b) "ATV" means all terrain vehicle as defined in The All Terrain Vehicles Act;
- c) "Driver's Licence" means a driver's licence issued pursuant to The Traffic Safety Act;
- d) "Designated Officer" means a person who has been assigned duties to administer or enforce all or part of this bylaw;
- e) "Highway" means highway as defined in The Traffic Safety Act;
8. f "Immediate Family" of a person means the spouse, parent, step-parent, guardian, child, step-child, brother, sister, step-brother or step-sister of the person;
- g) "Municipality" means the Rural Municipality of Excel No. 71;
- h) "Owner" means the owner of the ATV; and
- i) "Provincial Highway" means a provincial highway as defined in The Highways and Transportation Act.
3. Pursuant to Section 9 of the Act, the operation of ATV's shall be permitted within the travelled and untraveled portion of the whole or any part of a highway, other than a provincial highway, within the municipality.
4. No person shall operate an ATV unless they hold an existing driver's licence.
5. No person under the age of 16 shall operate an ATV.
6. Exceptions to Section 3. and Section 4. of this bylaw are listed in Section 5 of the Act.
7. No person shall operate an ATV on any portion of a provincial highway unless it is for the sole purpose of crossing the provincial highway by the most direct and shortest route of travel available.
8. No person shall operate an ATV on private land that is not owned by them or a member of their immediate family or crown land without the permission of the owner or occupant of the land.
9. Operators must strictly adhere to all rules of the road and follow requirements as set out in The Traffic Safety Act.
10. Bylaw No. 2-2016 is hereby repealed.
11. This bylaw shall come into force on the day of its final passing.
