RURAL MUNICIPALITY OF GOOD LAKE No. 274 BYLAW No. 09-2020 The Council of the Rural Municipality of Good Lake No. 274 in the Province of Saskatchewan, enacts as follows: Short Title 1. This Bylaw may be cited as "The Fireworks Bylaw" a bylaw to regulate the use of Fireworks and to provide for public safety in the use of Fireworks. Definitions 2. In this Bylaw, including this section: (a) "Council" means the Council of the Rural Municipality of Good Lake No. 274. (b) "Municipality" means the Rural Municipality of Good Lake No. 274. (c) "Fireworks" means any fireworks as defined in the Explosive Regulations C.R.C. c. 599; such as squibs, firecrackers, rocket, torpedoes, roman candles, sparklers and other pyrotechnics of all descriptions and also including the singular thereof. (d) "Public Fireworks Display" means the discharge of high or low hazard fireworks by a community organization for the entertainment of the public at large at a designated time and place and which has been approved in writing by the Municipality in advance of the display. General Prohibition 3. (a) No person shall set off any fireworks in a manner that would create a danger, nuisance, annoy, disturb, injure or otherwise endanger or detract from the comfort, repose, health or safety of another person or property. (b) In any case no person shall set off any fireworks between the hours of 11:00 p.m. and 8:00 a.m. daily without prior written approval from the Municipality. (c) No person under the age of eighteen (18) years shall set off any fireworks. (d) No person shall set off any fireworks in or into any highway, street, lane square or other public place except as permitted by this Bylaw. (e) No person shall set off any fireworks in or into any building, doorway, motor vehicle or other places where such setting off might create a danger to any person or property. (f) At the conclusion of a public fireworks display, all unused fireworks and debris shall be immediately removed and disposed of by the person authorized to conduct the fireworks display. Council Discretion 4. At the discretion of Council upon application the Council may by resolution, grant an exemption to any person, corporation or organization from any of the provisions of this bylaw with respect to setting off fireworks. Penalties 5. Any person, corporation or organization who contravenes any provision of this Bylaw is guilty of an offence and is liable on summary conviction to: (a) a minimum fine of Five Hundred Dollars ($500.00) and a maximum fine not in excess of One Thousand Dollars ($1,000.00), (b) costs as may be awarded by the Court hearing the matter.
