## RURAL MUNICIPALITY OF LEASK NO. 464 BYLAW 14-2025 ## A BYLAW TO REGULATE THE OPERATION OF ATV'S WITHIN THE RM BOUNDARIES The Council of the RM of Leask No. 464 in the Province of Saskatchewan enacts as follows: TITLE: 1. This Bylaw shall be known as "The ATV Bylaw 14-2025" PURPOSE 2. The purpose of the Bylaw is to regulate the operation of all terrain vehicles pursuant to Section 11 of The All Terrains Act. ## DEFINITIONS "Act" shall mean The All-Terrain Vehicles Act, 3. For this bylaw, the following terms and words shall have the following meaning: "All -terrain Vehicle" and/or "ATV" means a self-propelled vehicle that: i. Is designed primarily for the movement of people or goods on unprepared surfaces: and Has wheels in contact with the ground, and includes: ili. A 4 wheeled quad; iv. A side by Side An all-terrain cycle; vi. Dirt Bikes vii. (All Terrain Act Sec 2(1)(b)) King in the right of Saskatchewan, (All Terrain Act Sec. 2(1)(d)) 'Crown Land" means any land, other than a highway, owned by His Majesty the d. "Drivers license" means a driver's license issued pursuant to The Traffic Safety Act, (All Terrain Act Sec. 2(2)(e)) (All Terrain Act sec. 2(2)(g)) e. "Highway" means highway as defined in The Traffic Safety Act, "Immediate family" of a person means spouse, parent, guardian, child, brother or sister of the person, "Supervised" is constantly capable of communicating visually or verbally with the "Municipality" shall mean the RM of Leask No. 464, person operating the all-terrain vehicle. (All Terrain Act Sec. 1(1)(g)) PROVISIONS at 25 km/hr. within lake subdivisions within the Municipality of Leask No. 464. 4. It shall be lawful to operate an ATV on any Municipal roadways at 40 km/hr. or NO OPERATING ON HIGHWAY 5. No person shall operate an all-terrain vehicle on the travelled portion of a highway. (All Terrain Vehicles Act Sec. 7) ## PROHIBITIONS i. Any public or private land, 6. All operators of an ATV must hold a valid driver's license; or a. Be of the age of 12 years or more having successfully completed an ATV training course, whether the person operating an ATV is on: shortest route of travel available to him, or ii. A highway for the purpose of crossing the highway by the most direct and iii. The untraveled portion of a highway, b. While the person is operating an ATV: i. That is equipped with not more than two wheels, ii. On an enclosed racetrack or trail on private land, and iii. During the course of an event carried out, promoted or sponsored by a person or organization. (All-terrain Vehicle Act, Sec. 16) ## PERMISSION 7. No person shall operate an ATV without permission on private land not owned or occupied by him or a member of his family; and on crown land used or occupied by otherwise that the crown (All-Terrain Vehicle Act Sec 6 (a) &amp; (b)) ## OPERATING ON HIGHWAY 8. No person shall operate an all-terrain vehicle on the traveled portion of a highway. Does not apply to any person operating an all-terrain vehicle on the travelled portion of the whole or any part of a highway, other than a provincial highway, in respect of which a municipality has passed a bylaw pursuant to Subsection 9. (All-terrain vehicle Act Sec. 7) PERMITTED OPERATION ON HIGHWAYS 9. The Council of a municipality may, by bylaw, permit the operation of any all-terrain vehicles or class or classes of all-terrain on the travelled portion of the whole or any part of a highway, other than a provincial highway, in the municipality. (All-terrain Vehicle Act Sec. 9) ## PROHIBITIONS a. Without due care and attention, ## 10. No person shall operate an ATV: reasonably be expected to be in the area, b. Without reasonable consideration for other persons in the area or who might at a speed not greater than 25km/hr. within the lake subdivisions. c. At a speed greater than is reasonable and safe in the circumstance and in any case d. Off a roadway where up to a maximum 25/km/hr. is available designed by the original manufacturer of the all-terrain vehicle for the e. With a passenger on the all-terrain vehicle unless the all-terrain vehicle was transportation of passengers, vehicle, f. With a passenger being towed on any type of equipment attached to the all-terrain g. At night without using prescribed lights, using the seatbelts in a properly adjusted and securely fastened manner while the h. Fitted with seatbelts installed by the manufacturer of the all-terrain vehicle without vehicle is in operation, i. In a manner that is detrimental to the environment. (All-terrain Vehicle Act, Sec. 16) ## RULE OF OPERATION <!-- image --> 11. Every operator of an ATV shall: When approaching an oncoming vehicle, pass the vehicle to the right, b. Yield the right of way to vehicles approaching from his right, c. When overtaking another vehicle, pass the vehicle on the left, d. Yield the right of way to all pedestrians that are approaching so close as to present - e. Except when overtaking another vehicle, maintain a safe following distance behind any other vehicle, lights if the vehicle is equipped with them or hand signals as described in Where circumstances warrant, signal his intentions to turn abruptly by using signal The Traffic Safety Act, - g. On being requested or signaled to do so by a CSO using emergency device of emergency light or a visible hand signal, immediately stop the all-terrain vehicle. ## EQUIPMENT 12. The operator of, and any passenger in or on an ATV that is being operated shall wear a helmet and protection for the eyes of the type and in the manner prescribed. ## LIABILITY/INSURANCE 13. Every person operating an all-terrain vehicle on any road surface shall produce proof of financial responsibility to any CSO upon request. (All-terrain vehicle Act; Sec. 14) 14. When a loss, damage or injury is caused to a person by an all-terrain vehicle, the person operating it at the time is liable for the loss, damage or injury, if it was caused by his negligence or improper conduct. The owner of the vehicle is held to the same liable as the operator.
