## BYLAW NO. 01-2018
## A BYLAW TO PERMIT THE OPERATION OF ALL TERRAIN AND SNOWMOBILE VEHICLES WITHIN THE BOUNDARIES OF THE HAMLET OF PARKVIEW
The Council of the Rural Municipality of Marquis No. 191 in the Province of Saskatchewan enacts as follows:
## DEFINITIONS
1. In this Bylaw:
2. "Administrator" means the Administrator of the Municipality or in their absence the person acting on behalf of the Administrator.
3. is designed primarily of the movement of people or goods on unprepared surfaces; and
- b) 'All Terrain Vehicle' means a self-propelled vehicle that:
5. has wheels in contact with the ground;
## and includes:
- a golf cart
- ili. snowmobiles
- ii. an all-terrain cycle
- iv. a restricted use motorcycle
- V. a mini-bike
## but does not include:
- An agricultural implement or special mobile machine as defined in The Traffic Safety Act; or
- c) "Crown Land" means any land, other than a highway, owned by Her Majesty the Queen in the right of Saskatchewan
- ii. Any vehicle that is required to be registered pursuant to The Traffic Safety Act.
- d) "Driver's license" means a driver's license issued pursuant to The Traffic
- "Highway" means highway as defined in The Traffic Safety Act.
- f) "Municipality" means the Rural Municipality of Marquis No. 191
The Council of the Rural Municipality of Marquis No. 191 in the Province of Saskatchewan enacts as follows:
1. Under the provisions of The All-Terrain Vehicle Act and the Snowmobile Act, All Terrain Vehicles may be operated on any street within the limits of the Hamlet of Parkview.
2. All-Terrain Vehicles shall leave the hamlet limits using only the most direct route and returning to a residence by the most direct route unless the operator of the All Terrain Vehicle is performing one of the following acts:
- i) Removing snow from streets, lanes. driveways or parking lots
- 1) Spraying lots with a pesticide, if the All Terrain Vehicle is being operated by a licensed pesticide applicator
5. iii) Taking part in a parade, ceremony or special occasion
3. No person shall operate an All Terrain Vehicle within the Hamlet of Parkview in such a manner as to create a nuisance or undue annoyance to residents or other persons in the Hamlet.
4. No person shall operate an All Terrain Vehicle upon any property in such a manner that is dangerous to other persons or property.
5. No person shall operate an All Terrain Vehicle to travel two (2) abreast on a street.
6. No person shall operate an All Terrain Vehicle who is under the age of sixteen (16) years.
1. No person shall operate an All Terrain Vehicle without a valid Driver's License.
8. All Terrain Vehicles while driving in the Hamlet of Parkview must not exceed 30 kilometers per hour and must operate in a safe and courteous manner.
9. No person shall operate an All Terrain Vehicle at night without using prescribed lights.
10. The operator of and any passenger on an All Terrain Vehicle that is being operated shall wear a helmet.
11. No person shall operate an All Terrain Vehicle on: a) a highway, whether traveled or untraveled portion of it; b) any public land; unless there is, in respect of the operation of the All Terrain Vehicle, a subsisting contract of automobile insurance within the meaning of Part VI of The Saskatchewan Insurance Act insuring the owner and every person who operates the vehicle in an amount of not less that the prescribed amount against liability imposed by law on the insured named in the contract or that other person for loss or damage:
- a) resulting from the ownership, use or operation of the All Terrain Vehicle;
- b) resulting from the bodily injury to or the death of any person and damage to property
12. Every person operating an All Terrain Vehicle on: a) a highway, whether the traveled or untraveled portion of it; b) any public land: shall produce proof of financial responsibility as required by section 14 to any peace officer requesting that proof either at the time of the request or within forty-eight (48) hours, or any longer period of time as the peace officer may allow, at any time and

place that may be designated by the peace officer making the request.
13. A person who contravenes the provisions of this Bylaw is guilty of an offense and liable upon summary conviction to a fine of not more than One Thousand ($1,000.00) Dollars.
14. This Bylaw shall not apply to any provincial highway as defined in the Highways Act.
15. This Bylaw shall come into force and take effect on April 10, 2018
