THE ATV BYLAW RURAL MUNICIPALITY OF PERDUE NO. 346 BYLAW NO. 1-2021 The council of the Rural Municipality of Perdue No. 346, in the Province of Saskatchewan enacts as follows: Short title This Bylaw may be referenced as "The ATV 2021 Bylaw" PART I PURPOSE AND DEFINITION Purpose 1. The purpose of this Bylaw is to provide for responsible, legal all-terrain vehicle use within the Rural Municipality of Perdue No. 346 by: a) regulating the operation of all-terrain vehicles within the municipality pursuant to The All Terrain Vehicles Act. b) establishing an Inter-Jurisdictional All Terrain Vehicle Use Agreement with other jurisdictions where possible; c) provide for reasonable opportunities for family sport and recreational activities relating to responsible all terrain vehicle use within the municipality. Definitions 2. For the purpose of this Bylaw, the following terms and words shall have the following meanings: a) "administrator" shall mean the Administrator of the Rural Municipality of Perdue No. 346. b) "act" shall mean the All Terrain Vehicles Act. i) "all-terrain vehicle" means a propelled vehicle that:is designed primarily for the movement of people or goods on prepared surfaces; and ii) has wheels and or track in contact with the ground; and includes: iii) a restricted use motorcycle; a mini-bike; and an all terrain vehicle; But does not include: a golf cart; a snowmobile as defined in The Snowmobile Act; an agricultural implement or special mobile machine as defined in The Traffic Safety Act; or any vehicle that is required to be registered pursuant to The Traffic Safety Act. c) "ATV" shall have the same meaning as all terrain vehicle. d) "authorized person" means a person who is in charge of a vehicle with the express or implied consent of the owner of the vehicle. e) "crown land" means any land, other than a highway, owned by Her Majesty the Queen in the right of Saskatchewan. f) "driver's license" means a driver's license issued pursuant to The Traffic Safety Act. g) "council" shall mean the council of the Rural Municipality No. 346. h) "designated officer" shall mean a person who has been assigned duties to administer and or enforce all or part of this bylaw. i) "highway" means highway as defined on The Traffic Safety Act. j) "immediate family" of a person means the spouse, parent, step-parent, guardian, child, step-child, brother, sister or step-brother or step-sister of the person. k) "municipality" shall mean the Rural Municipality of Perdue No. 346. l) "municipal land" shall include but not be limited to: i) The traveled and untraveled portion of all streets, roads, lanes and highways in the municipality (except provincial highways. ii) all public reserves. iii) all other lands owned, operated or under the care of the municipality. m) "owner" shall mean the owner of the ATV. n) "provincial highway" means a provincial highway as defined in the Highways and Transportation Act. ATV OPERATION 3. No person shall operate an ATV unless they hold an existing driver's license issued pursuant to The Traffic Safety Act. 4. Notwithstanding to section 3 a person who under 17 years of age may operate an ATV within the municipality provided that the operator of the ATV is accompanied on an ATV designated for the transportation of two or more passengers by someone in possession of a driver's license issued pursuant to The Traffic Safety Act. 5. Section 3 does not apply to a person operating an ATV on private land owned or occupied by them or a member of the immediate family. 6. No ATV shall be operated on any portion of a provincial highway unless it is for the sole purpose of crossing the highway by the most direct and shortest route of travel available. 7. No person shall operate an ATV on private land that is not owned by them or a member of their immediate family or crown land without the permission of the owner or occupant of the land. 8. Operators must strictly adhere to all rules of the road and follow requirements as set out in The Traffic Safety Act.
