BYLAW NO. 1-2022 A BYLAW TO PROVIDE FOR THE HARBOURING OF ANIMALS IN HAMLETS 1 The Council of the Rural Municipality of Wellington No. 97 in the Province of Saskatchewan, enacts as follows: 1. Short Title 1.1 This bylaw may be cited as "Hamlet Animal Bylaw". 2. Purpose 2.1 The purpose of this bylaw is to set out the animals and quantity of animals allowed to be kept within the hamlets, as well as the requirements a resident living within a hamlet must follow in order to harbour these animals. 3. Definitions 3.1 In this bylaw: a. Administrator means the person appointed as administrator pursuant to section 110 of The Municipalities Act or his/her duly authorized representative or designate. b. Council means the Reeve and Councillors of the Municipality elected pursuant to the provisions of The Local Government Election Act, 2015. c. Designated Officer means an employee or agent of the Municipality appointed by Council to act as a municipal inspector for the purposes of the Bylaw. d. Hamlet means Tyvan, Cedoux and Colfax. e. Livestock means horses, cattle, sheep and goats. f. Municipality means the Rural Municipality of Wellington No. 97. g. Neighbour(s) means: 1. a landowner whose property, whether vacant or occupied, touches the property of the resident wanting to harbour animals, as well as 2. a landowner whose property, whether vacant or occupied, is directly across the back alley from and/or directly across the street from the resident wanting to harbour animals. h. Poultry means domestic non-flying fowls, specifically chickens, geese and ducks but does not include roosters. 4. Harbouring of Animals 4.1 The animals allowed to be kept/harboured within the red solid outlined areas on the attached hamlet maps are: (a) poultry 4.2 The animals allowed to be kept/harboured within the green dashed outlined areas on the attached hamlet maps are: (a) poultry, and/or (b) livestock BYLAW NO. 1-2022 A BYLAW TO PROVIDE FOR THE HARBOURING OF ANIMALS IN HAMLETS 2 5. Limits and Requirements 5.1 Residents shall be allowed to keep/harbour at one time: (a) 5 (five) poultry (b) 2 (two) horses (c) 2 (two) cattle (d) 2 (two) goats (e) 2 (two) sheep 5.2 Poultry cannot exceed a combination of five. 5.3 Livestock listed from b to e under 5.1 above may be kept in addition to poultry. Livestock listed from b to e under 5.1 above cannot exceed a combination of two. 5.4 Residents must obtain a signed Consent (Schedule A) from surrounding neighbours acknowledging they have no issues with the animals being kept in close proximity of their property/residence. All signed consent documents must be presented to the Administrator in order to receive a permit allowing the resident to keep the animals. 5.5 All livestock shall be kept within a barn, or shed with a fenced area as required. All poultry shall be kept within an enclosed poultry coop and enclosed poultry run. Free range grazing is not permitted. 5.6 Grain and or pelleted feed must be kept in a sealed, water-tight, rodent proof container. 5.7 No person shall herd livestock or poultry at any time within the limits of the hamlets. 5.8 Under the previous Bylaw 00-04 allowing for the harbouring of livestock and poultry (which is identified within the green dashed area on the Tyvan hamlet map), these residents will be grandfathered in with respect to the harbouring of the animals they currently have. If the property ownership changes, the new owners will be subject to the requirements under this bylaw, Bylaw No. 1-2022. 6. Complaints 6.1 If any complaints regarding the animals being kept should arise, residents must first try to mediate the issue. 6.2 If the steps taken under 6.1 above are unsuccessful, a written complaint must be submitted to the RM Office, whereby the owner of the animals in question will be sent a written warning. Once an owner has received one written warning, the next complaint will result in the owner losing the privilege of keeping the animals on their property and will be required to re-home the animals. 7. Contraventions 7.1 If the Designated Officer finds that a person is contravening this Bylaw, the Designated Officer shall, by written order, require the owner of the animals to remedy the contravention. Orders given under this Bylaw shall comply with Section 364 of The Municipalities Act and shall be served in accordance with Section 390 (1)(a), (b) or (c) of The Municipalities Act. Poultry: (indicate how many**) Livestock: (indicate how many**) _______ chickens, _______ horses, _______ cattle, _______ geese, _______ goats, _______ ducks _______ sheep Total ________ Total ________ I acknowledge and agree I do not have any issues with the above animals being kept in close proximity to my property/residence. It is understood: - Livestock means horses, cattle, sheep and goats. - Neighbour(s) means: 1. a landowner whose property, whether vacant or occupied, touches the property of the resident wanting to harbour animals, as well as 2. a landowner whose property, whether vacant or occupied, is directly across the back alley from and/or directly across the street from the resident wanting to harbour animals. - Poultry means domestic non-flying fowl, specifically chickens, geese and ducks but does not include roosters. - ** The total number of poultry which can be kept is five, in any combination, as long as it doesn't exceed five. The total number of livestock which can be kept is a maximum of two with the option to keep a total of five poultry and only within the green/dashed area outlined on the Tyvan hamlet map (available on the RM's website, BYLAW NO. 1-2022 A BYLAW TO PROVIDE FOR THE HARBOURING OF ANIMALS IN HAMLETS 5 www.rmofwellington.ca, or by contacting the RM office). - All livestock shall be kept within a barn, or shed with a fenced area as required.
