## RESORT VILLAGE OF SASKATCHEWAN BEACH ## BYLAW NO. 1/2023 A BYLAW TO REGULATE AND CONTROL THE OWNERSHIP OF ANIMALS The Council of the Resort Village of Saskatchewan Beach in the Province of Saskatchewan enacts as follows: This bylaw shall be referred to as the "Animal Control Bylaw" ## 1. In this bylaw: - a) "Administrator" shall mean the administrator of the municipality; - b) "Council" shall mean the council of the municipality; - c) "Municipality" shall mean the Resort Village of Saskatchewan Beach; - d) "Pet" shall mean any domesticated or tamed animal that is kept as a companion and cared for affectionately. - e) "Dog and Cat" shall mean any dog or cat, male or female unless otherwise stated; - f) "Cattery" shall mean a place where cats are bred or looked after; - g) "Domesticated" shall mean to accustom animals to live near the habitation of humans; to tame; - h) "Dovecote" shall mean a structure for housing pigeons; - i) "Even-toed hoofed mammals" shall mean mammals having reduced number of functional toes and that rest their weight equally on the third and fourth toes of each foot - Examples include but are not restricted to pigs, deer, cattle, antelope, camels, llamas, sheep, goats, giraffes; - j) "Fur farm" shall mean a place where animals are bred for fur; - k) "Kennel" shall mean a breeding or boarding establishment for dogs; - 1) "Odd-toed hoofed mammals" shall mean mammals having a reduced number of toes, each encased in a protective horny sheath or hoof and the weight is carried mainly by the middle digit of each foot - Examples include but are not restricted to horses, asses, mules, zebras, tapirs, rhinoceroses; - m) "Poultry" shall mean domesticated birds kept for eggs or meat - Examples include chickens, turkeys, ducks, geese, quail, guinea, fowl, pheasants, pigeons, ostriches; - n) "Rodent" shall mean a mammal with strong incisors and canine teeth - Examples include but are not restricted to rabbit, chinchilla. - o) "Running at Large" shall mean when the animal, is beyond the boundaries of the land occupied by the owner, possessor or is a person harboring the said animal, or beyond the boundaries of said lands where it may be with the permission of the owner or occupant of the said land and when it is not under control by being: - a) Securely confined within its enclosure; or - b) Securely fastened so that it cannot roam at will. 2. All animals must wear a collar that can be identified if the animal is found running at large. 3. The animal must be on a leash if the animal is taken off the property where it is outside the boundaries of any lands where it may be within the permission of the owner or occupant of the lands. 4. No animal shall be permitted to run at large within the limits of the Resort Village of Saskatchewan Beach. 5. No person shall permit an animal to be: - a) Within three (3) meters of the public beach; - b) In areas posted as prohibited. - c) Section 5 shall not apply to a person who owns and is physically reliant on a registered guide dog trained and used to assist such persons. 6. No person shall keep more than two (2) of any type of permitted animal within the limits of the municipality. 7. A person who owns, possesses or a person harboring an animal found running at large shall be deemed guilty of an infraction of this bylaw. 8. It shall be unlawful for any person to own, keep or harbor any animal which is in the habit of howling, barking, yelping or chasing motor cars or other vehicles, or in any other manner or way, creates a disturbance to the annoyance or discomfort of other persons residing in the resort village or to the public at large, or cause injury to any person. 9. If an animal defecates on any public or private property other than the property of its owner, the owner shall remove the defecation immediately. 10. An owner or occupant of private property must not allow animal feces to accumulate on their property which unreasonably interferes with the use and enjoyment of adjoining premises by owners and occupants. 11. A Bylaw Enforcement Officer may serve an owner or occupant of private property with a notice to remove all animal feces from the property within 72 hours of service of notice. 12. The owner of an animal shall ensure that such animal shall not: - a) Bite a person or persons, whether on the property of the owner or not. - b) Do any act to injure a person or persons, whether on the property of the owner or not. - c) Chase or otherwise threaten a person or persons, whether on the property of the owner or not, unless the person chased or threatened is a trespasser on the property of the owner. - d) Cause damage to property or other animals. 13. No person shall keep prohibited Animals as listed on Schedule A of this bylaw at any time within the limits of the Municipality. 14. A person who contravenes any of the provisions of the bylaw or fails to comply therewith, or with any notice or order given thereunder shall be guilty of an offence. The first offence in any calendar year a warning shall be issued. Upon conviction, this person shall be liable to a penalty as listed below: - a) Second offence in any calendar year shall result in the penalty of one hundred dollars ($100.00) - b) Third shall result in the penalty of two hundred dollars ($200.00) and subsequent offences in any calendar year shall result in the penalty for each offence to quadruple. - c) A violator of this bylaw, upon being served with a Notice of Violation, may, during office hours, voluntarily pay the penalty at the Municipal Office, and upon payment as so provided, that person shall not be liable to prosecution of the offence. If this Notice of Violation is not paid, the violator may be charged under a summary conviction. 15. Bylaw No. 88 and Bylaw No. 135 are hereby repealed. 16. Certified a true copy of Bylaw #01/2023 passed on \_by resolution of Council ## Schedule A to Bylaw 1/2023 RESORT VILLAGE OF SASKATCHEWAN BEACH PROHIBITED ANIMALS The following is a list of animals the keeping of which is prohibited within the Resort Village of Saskatchewan Beach. - a) all Arachnids dangerous to humans (such as scorpions and tarantulas, except tarantulas of the genera Aphonopelma, Avicularia and Grammostola); - b) all Artiodactylus Ungulates (such as goats, sheep, cattle, pigs and llamas); - c) all Bats; - d) all Candids, except the domestic dog; - e) all Crocodilians (such as alligators, crocodiles and caimans); - f) all Edentates (such as anteaters, sloths and armadillos); - g) all Elephants; - h) all Felids, except the domestic cat; - i) all Hyaenas; 10. all Marsupials (such as kangaroos and opossums); - k) all Mustelids (such as skunks, weasels, otters and badgers) except the domestic ferret; - 1) all non-human Primates (such as gorillas and monkeys); - m) all Perissodactylus Ungulates (such as horses, donkeys, mules and asses); - n) all Pinnipeds ( such as seals, fur seals and walruses); - o) all Procyonids (such as raccoons, coatis and cacomistles); - p) all Raptors, diurnal and nocturnal (such as eagles, hawks and owls); - q) all Ratite Birds (such as ostriches, rheas and cassowaries); - r) all Galliformes (such as chickens, turkeys, grouse, quails and pheasants); - s) all Anseriformes (such as ducks and geese); - t) all snakes of the families Pythonidae and Boidae; - u) all Ursids (bears); - v) all venomous Reptiles and Amphibians; - w) all Viverrids (such as mongooses, civets and genets). Examples of animals of a particular prohibited group are given in parentheses. They are examples only and shall not be construed as limiting the generality of the group.
