1 Resort Village of Sunset Cove BYLAW NO. 2019 - 92 A BYLAW TO RESTRICT THE USE OF WATER IN THE RESORT VILLAGE OF SUNSET COVE SECTION I - PROVISIONS: PURPOSE: The purpose of this bylaw is to prohibit excessive amounts of water being applied to the surface lands within the Resort Village of Sunset Cove, with the intent to lower the susceptibility of any erosion or ground slumping within the Resort Village of Sunset Cove. The Council of the Resort Village of Sunset Cove in the Province of Saskatchewan enacts as follows: 1. Short Title: This Bylaw may be cited as "The Water Restriction Bylaw". 2. Application: All of the provisions and enactments set forth in this Bylaw relate to and will be in full force and effect within the boundaries of the Resort Village of Sunset Cove. 3. Interpretation: In this Bylaw, the expression(s): a) "Administrator" shall mean the Administrator of the Resort Village of Sunset Cove. b) "Bylaw Enforcement Officer" shall mean the Bylaw Enforcement Officer appointed by Council designated for the Resort Village of Sunset Cove. c) "Council" shall mean the Council of the Resort Village of Sunset Cove. d) "Resort Village" shall mean the Resort Village of Sunset Cove, in the Province of Saskatchewan. 4. Definition: a. Other words and expressions used in this Bylaw shall have the same meaning as given to them within the Saskatchewan Municipalities Act. b. Pooling is defined as water remaining on the surface of any land for a period exceeding 5 minutes. 2 5. Validity: If any section, clause or provisions of this Bylaw is for any reason declared by a court of competent jurisdiction to be not valid, the same shall not affect the validity of the Bylaw as a whole or any part thereof, other that the section, clause, or provisions. SECTION II - GENERAL PROHIBITIONS: 1. The use of water for the watering of lawns and gardens is hereby restricted according to the terms of this Bylaw. 2. The Mayor or any member of Council may further restrict the use of water during any emergent situations. 3. No person shall permit their water use to create the pooling or flowing of water on any roadway or any property within the Resort Village of Sunset Cove. 4. Persons removing or pumping surface water from their property must ensure it is not deposited in a manner that may negatively affect any other property located within the Resort Village of Sunset Cove. 5. No part of this bylaw is intended to interfere or hinder any person(s) or firefighting service attempting to extinguish or prevent any fire. In such emergent situations, the prohibition section of this bylaw (Section II) is suspended. SECTION III - PENALTIES: 1. First infraction of the provisions of this Bylaw shall result in the property owner being issued a written warning of contravening this bylaw. 2. The second infraction of the provisions of this Bylaw shall result in the property owner be subject to a fine of two hundred fifty dollars ($250.00), payable to the Resort Village of Sunset Cove. 3. The third and any subsequent infraction of the provisions of this Bylaw shall result in the property owner be subject to a fine of $500.00 dollars payable to the Resort Village of Sunset Cove. 3 SECTION IV - EFFECTIVE DATE: 1. This Bylaw shall come into force and be in effect on the final passing thereof.
