## CITY OF WARMAN BYLAW 2021-04 A BYLAW TO AMEND BYLAW 2013-27, KNOWN AS THE ANIMAL CONTROL BYLAW
The council of the City of Warman in the Province of Saskatchewan enacts to amend Bylaw No. 2013-27 as follows:
- Part 3, Section 1, Subsection (e) shall be added and include the following: (e) Shall not leave an animal in a vehicle below -10 Celsius or above +15 Celsius without
- adequate water and heat or ventilation. If an animal control officer deems an animal is in distress, a bylaw officer may enter a vehicle or property.
2. Part 3, Section 6 "Off-Leash Areas" shall be added and include the following:
- (1) Parking lots are not considered part of off-leash areas, and all dogs must be leashed when entering and exiting any off-leash area.
- (2) Any person bringing a dog into the off-leash area assumes the legal responsibility, with the owner of the dog for any damage, disease or injury to persons, other dogs, property, caused by the dog. All persons using an off-leash facility, by entering it, agree to indemnify the City of Warman and hold the City harmless from any harm resulting from using the off-leash area.
- (3) Rules and regulations for off-leash areas:
- a. All dogs must have a valid license, and license tags must be displayed on dog(s).
- b. Dog owners are legally responsible for the behavior of their dog(s) at all times.
- c. Dogs prohibited from off-leash area include:
i. dog(s) that have been declared dangerous by a court order; and
- ii. female dogs that are in heat.
- d. Dogs must be leashed while entering and exiting the off-leash area.
- e. Dog owners must remove feces (dog droppings) left by their dog(s).
4. Dog owners shall not allow their dog(s) to become a nuisance to other people or animals in an off-leash area, activities that constitute a nuisance include, but are not limited to, the following:
- i. allowing a dog(s) to run at a distance from the owner where the dog(s) cannot respond to voice or sight commands;
- ii. dog(s) doing any act that injures another person or another animal;
- ili. dog(s) chasing or otherwise threatening a person or another animal;
- iv. dog(s) biting;
- v. excessive barking, howling or otherwise disturbing any person or other animal; and
- vi. dog(s) causing damage to property.
- g. In order to prevent a dog(s) from become a nuisance in an off-leash area, the owner of a dog(s) must:

- i. accompany the dog(s) in the off-leash area at all times; and
- il. carry a leash not longer than two meters in length for the dogs.
- h. If a dog(s) does become a nuisance, it must be leashed and removed from then off-leash area immediately. Failure to leash and remove dog(s) may result in seizure and impounding of dog(s).
- i. Dog owners must obey the orders of the Animal Control/Bylaw Officer.
3. Part 4, Section 3, Subsection (c) shall be amended as follows.
6. (c) All cats and dogs seized pursuant to this bylaw shall be impounded at the animal pound for a period of three (3) days, excluding the day of the impounding.
4. Part 4, Section 4, subsection (a) shall be amended as follows.
8. (a) Where a cat or dog which has been seized and impounded is not claimed by the owner within three (3) days as set out in this Bylaw, or where the owner has failed or refused to comply with the terms of this Bylaw within the same period for the redemption of said cat or dog, the Manager, bylaw officer or animal control officer may authorize the disposal of said cat or dog as set out in Schedule "H" of this Bylaw.
5. Part 7, Section 12, subsection (B) shall be added as follows:
10. (b) If evidence is received by the Animal Control/Bylaw Officer showing an animal attack on a person or other animal, the Animal Control/Bylaw Officer may require the animal be muzzled when not on private property.

This Bylaw shall come into force and take effect upon the date of adoption thereof.
