## TOWN OF WATROUS BYLAW NO. 21-2013
## A BYLAW OF THE TOWN OF WATROUS TO PROVIDE FOR THE LICENCING, REGULATING AND CONTROL OF DOGS AND CATS
The Council of the Town of Watrous in the Province of Saskatchewan enacts as follows:
1. This Bylaw shall be known as the "Dog & Cat Control Bylaw"".
## 2. DEFINITIONS:
In this Bylaw the following definitions apply:
- a) "BYLAW ENFORCEMENT OFFICER" - means the person or persons appointed or contracted by the Council of the Town of Watrous for the purpose of enforcing the provisions of this Bylaw.
- b) "CAT" - means any cat, male or female, neutered or spayed of the feline family over the age of three (3) months.
- c) "CLERK" - means the administrator for the municipality.
- d) "COUNCIL" - means the Council of the Town of Watrous.
- e) "DOG" - means any dog, male or female, neutered or spayed of the canine family over th age of three (3) months.
- f) "DANGEROUS DOG" - means
- i) Any dog whatever its age with a known propensity, tendency or disposition to attack without provocation, to cause injury or to otherwise threaten the safety of persons or domestic animals;
- i) Any dog, that without provocation, in a vicious or menacing manner, chased or approached a person or domestic animal in an apparent attitude of attack;
9. ii) Any dog that, without provocation, has bitten, inflicted injury, assaulted or otherwise attacked a person or domestic animal;
10. iv) Any dog which is owned primarily or in part for the purpose of dog fightin or is trained for fighting.
- g) "OWNER" - includes
12. il) the person responsible for the custody of a minor where the minor is the owner of a dog or cat.
- i) a person, persons, partnership, association or corporation who keeps, possesses, harbours, or has care of or control of a dog or cat;
14. "POUND" - means such premises and facilities as may be designated by the Council of the Town of Watrous for the purpose of safely lodging and securing animals seized pursuant to the Bylaw.
15. "RUNNING AT LARGE" - means when the dog or cat is beyond the boundaries of the land occupied by the owner, possessor or harbourer or keeper of the said dog or cat, or beyond the boundaries of any lands where it may be with the permission of the owner or occupant of the said land and is not under control by being;
16. ii) securely confined within an enclosure; or
17. in direct and continuous charge of a person competent to control it; ot
18. ili) securely fastened so that it cannot roam at will.
## 3. LICENCING:
- a) Every owner of a dog or cat within the Town of Watrous shall cause each such dog or ca to be registered with and obtain a licence for it from the Town Office. When applying fo a licence, the applicant shall provide the Town Office with a physical description of the dog or cat, the breed in the case of a dog and any other relevant information required wit respect to the dog or cat for which the licence is sought and shall provide the name address and telephone number of the owner of the dog or cat
- b) The licence year for dogs and cats shall be from the first day of January to the thirty-first day of December of the same year.
- c) Every owner of a dog or cat three months old or older shall no later than March 1 in each year obtain a license for the said dog or cat from the Town Office, and failure to do so

shall constitute an offence under this bylaw.
- When issuing a licence for a dog or cat, the Town shall supply the applicant with a tag, the form of which and lettering or numbers inscribed or imprinted thereon as may be determined by the Town and a receipt for payment of the licence.
- e) The annual licence fee for a dog or cat licence shall be as set out in Schedule "A" attached hereto and which may be amended from time to time by resolution of Council.
- The sum payable for a licence required after the thirty-first day of August in a calendar year shall be calculated at fifty percent (50%) of the annual fee and shall expire on the thirty-first day of December in the same calendar year.
- Any dog or cat licence issued pursuant to the provisions of this Bylaw by the Town of Watrous shall not be transferable to any other dog or cat.
- h) If a dog or cat licence number plate or tag is lost, destroyed or so defaced as to be illegible, the owner, possessor or harbourer of the dog or cat to which the licence was issued shall forthwith apply to the Town Office for a replacement which shall be issued upon payment of a fee as set out in Schedule "A" attached hereto and which may be amended from time to time by resolution of Council.
- i) 'A dog which is used as a guide or "seeing eye" dog by a blind person shall be registered and licenced with the Town and the Town shall issue a licence without the prescribed fee.
- The owner of a dog or cat shall ensure that the dog or cat wears a collar to which is attached a current licence tag whenever the dog or cat is off the premises of the owner, provided that this provision shall not apply while a dog or cat is participating in a recognized show, obedience trial or field trial. No person other than the owner of a dog or cat licenced under this bylaw shall remove its collar or tag and to do so shall be an offence under this bylaw.
- k) Every applicant, at the time of making an application for a licence for a neutered dog or cat, may be required to provide the Town Office with a certificate from a veterinary surgeon that such dog or cat has been neutered.
- I) The provisions of this section shall not apply to the dogs and cats kept, in the ordinary course of business by the proprietors of the following premises:
- ii) a public pound;
- i) a veterinary hospital, clinic, boarding kennel or grooming parlor;
- iii) a shop whose business included the sale of pets and is licenced as such;
- iv) a shelter operated by an association or society incorporated for the purpose of the protection and humane treatment of animals.
- The owner or possessor of a kennel whose kennel is registered in the Register of The Canadian Kennel Club may in lieu of procuring a licence for each dog as herein before required, pay the Town the sum of $100.00 as the license fee for all dogs in such kennel.

## 4. RUNNING AT LARGE:
- a) The owner of a dog or cat shall not at any time allow the dog or cat to run at large within the Town of Watrous.
2. b). When a dog or cat is found to be running at large, its owner is deemed to have failed o refused to comply with the provisions of this section
- c) Where a dog or cat is found to be running at large, the owner or occupant of that propert on which the dog or cat is running at large may make a written complaint to the Bylav Enforcement Officer.

## 5. LIMITS - DOGS AND CATS:
- a) No person within the Town of Watrous shall harbour or keep more than three (3) dogs o any one property. If an owner fails or refuses to comply with the provisions of this section he/she shall be subject to the penalties as set out in Schedule "C" attached hereto and which may be amended from time to time by resolution of Council.

## 6. SEIZURE AND IMPOUNDING:
- a) A Bylaw Enforcement Officer or Peace Officer may seize and impound any dog or cat observed to be at large.
- b) A Bylaw Bnforcement Officer or Peace Officer may enter onto land surrounding any building in pursuit of any dog or cat which has been observed to be at large.
- c) The Bylaw Enforcement Officer is hereby authorized to seize and capture, by the use of : tranquilizer gun or other method authorized the Council of the Town of Watrous, and impound any dog or cat running at large contrary to the provisions of this Bylaw.

- e) No person, whether or not he is the owner of a dog or cat which is being or has been pursued or seized shall:
- i) Interfere with or attempt to obstruct a Bylaw Enforcement Officer who is attempting to seize or has seized any dog or cat in accordance with the
7. iii) Removed or attempt to remove any dog or cat from the possession of the Bylaw Enforcement Officer.
## 7. POUND:
- a) The Council of the Town of Watrous shall appoint a Pound Keeper.
- b) Il dogs and cats impounded in the Pound shall be so confined therein for eriod of 72 hours from the time of capture during which time the own thereof shall have the right to repossess the said dog or cat upon paying to the Town Office the amount set forth in Schedule "B" to this Bylaw as amended from time to time by resolution of council.
- c) No unlicenced dog or cat which is impounded shall be released to its owner or to any other person until the appropriate pound fee is paid and a licence has been purchased for it.
- d) When a dog or cat impounded is wearing a collar to which is attached a licence tag valid for the current year, the Town Office shall promptly attempt to contact the owner of the dog or cat as shown in the records made when the licence was purchased at the addres shown therein, that unless the said dog or cat is claimed and the fees as provided for in this Bylaw are paid within 72 hours from the date of the impounding, the said dog or cat shall be dealt with pursuant to the provisions of the Bylaw.
- e) All impounded dogs or cats which are not claimed within 72 hours as aforesaid, may be sold by the Town Office to any person paying for such dog or cat, a sum of not less tha

## confinement in the Pound.

## 8. LITTÉR - DOGS AND CATS:
- a) if a dog or cat defecates on any public or private property other than the property of th wner, possessor or harbourer of the said dog or cat; the owner, possessor or harboure the dog or cat shall cause such defecation to be removed immediately and disposed of in sanitary fashion. Failure to cause such removal shall be an infraction of this Bylaw.
## 9. NUISANCE:
- a) Nuisance - Dogs 1) The owner, possessor or harbourer of a dog shall not allow the animal to anyone or any domestic animal, chasing vehicles or bicycles and any owner, possessor or harbourer who contravenes this section commits an offence under

## 10. RABIES AND OTHER DISEASE:
- a) Any dog or cat suspected of having rabies shall not be killed but shall be secured and isolated for 7 days and the matter immediately reported to the Veterinary Clinic for the Town of Watrous, whose instructions shall be complied with.
- b) An owner, possessor or harbourer of a dog or cat who neglects or refuses to comply wit! any order of the Veterinary Clinic shall be guilty of an infraction of this Bylaw.
## 11. DANGEROUS DOGS:
- a) Where a complaint is received by the Town Office that a dog within the Town of Watro is dangerous, Sections 374 to 380 of The Municipalities Act shall apply.
## 12. GENERAL PENALTIES:
- a) A person who contravenes any provision of this Bylaw or neglects or refuses to comply therewith shall be guilty of an offence and liable upon summary conviction to a fine of r less than $50.00 and not more than $2000.00.
## 13. PENALTIES:
- a) Tickets shall be issued by the Bylaw Enforcement Officer for the Town of Watrous for offences against this Bylaw the penalty amounts set forth in Schedule "C" to this Bylav · as amended from time to time by resolution of Council

- c) If the Town of Watrous receives voluntary payment of the prescribed penalty within ven (7) days from the date the ticket was issued, the person receiving the ticket shall · liable for prosecution for contravention in respect of which the ticket was giv

14. Bylaw No. 25-95 and Bylaw No. 03-00 are hereby repealed.
15. This Bylaw shall come into force and take effect on January 1, 2014. INTRODUCED AND READ a first time this 21d day of December 2013.
