## TOWN OF WAWOTA
## BYLAW NO. 5/2010
## A BYLAW TO REGULATE ALL TERRAIN VEHICLES
The Council of the Town of Wawota in the Province of Saskatchewan enacts as follows:
1. In this bylaw, including this section:
2. (a) "all terrain vehicle" and/or "ATV" means all terrain vehicle as defined in The All Terrain Vehicles Act:
3. (b) "highway" means a highway as defined in The Traffic Safety Act; and includes a road, parkway, driveway, square of place designated and intended for or used by the general public for the passage of vehicles, but does not include any area, whether privately or publicly owned, that is primarily intended to be used for the parking of vehicles and the necessary passageways on that area;
4. (c) "private land" means land other than public land as defined in The All Terrain Vehicles Act:
5. (d) "public land" means Crown land or any land vested in the municipality, as defined in The All Terrain Vehicles Act;
6. (e) "traveled portion" means part of a highway designed for vehicle travel including the shoulder of the road;
7. (t) "un-traveled portion" means the part of a highway not designed for vehicle travel including the ditch and the center median;
8. (g) "vehicle" means a vehicle as defined in The Traffic Safety Act.
2. A person is authorized to operate the following class of an all terrain vehicle on the traveled portion of any highway within the municipality, for purposes stated below:
10. (a) for the sole purpose of transportation to and from the outside limits of the municipality, and where the ATV is stored;
11. (b) for all non-pleasure purposes including snow removal, chemical spraying, and similar type uses, etc.;
12. (c) all other uses as so allowed by the municipality;
13. (d) at a speed no greater than forty (40) kilometers per hour;
14. (e) only during the hours between 6:00 a.m. and 11:00 p.m. in accordance with the municipality's Noise Bylaw.
3. No person shall operate an all terrain vehicle on any public land within the corporate limits of the municipality.
4. Any person who contravenes any of the provisions of this bylaw shall be liable to the penalty imposed by section 32 of The All Terrain Vehicles Act.
5. The provisions of The All Terrain Vehicles Act shall apply to the operators of ATV's.
6. This Bylaw shall come in to force and take effect when adopted by council.
