BYLAW NO. 2017-3369
A BYLAW OF THE CITY OF WEYBURN IN THE PROVINCE
OF
SASKATCHEWAN
TO REGULATE
THE OPERATION
OF SNOWMOBILES
WITHIN THE CORPORATE
BOUNDARIES OF THE CITY OF WEYBURN
WHEREAS, itis deemed advisable to regulate the operation of snowmobiles within the
corporate boundaries of the City of Weybum;
NOW THEREFORE, in accordance with TheSnowmobile Act, the Council of the City of
Weybum enacts as follows:

Notwithstanding Subsection 2 and Schedule "A" of this Bylaw, no person shall
drive or operate a snowmobile, whether it is licensed or not, or whether it is
capable of being licensed or not in any of the following:
a.
Street, lane avenue, highway, boulevard, park or playground within the
corporate limits of the City of Weybum;
b.
Any public reserve either owned or leased and controlled by the City of
Weybum;
c.
Any parking lot, parking area, or vacant land owned or leased and controlled
by the City of Weybum unless the City of Weybum has given its prior
approval to designate a snowmobile trail on City owned land.
The operation of licensed snowmobiles shall be permitted in accordance with the
provisions of TheSnowmobileAct, between the hours of 7:00 a.m. and 11:00 p.m.
on the routes designated in Schedule "A" attached hereto and forming pan of this
bylaw.
a.
It shall be lawful to operate a snowmobilewithin the corporate limits of the
City of Weybum by approval of both City Council and the Saskatchewan
Snowmobile Association on the following as set out in Schedule "A":
i.
From east city limit, west to 16"'Street along 1"Avenue NE;
ii.
From west city limit, east to Government Road S, along 6"'
Avenue S;
iii.
From west city limit, south ditch of Highway 39, east to
Government Road S;
iv.
From east city limit, along the north side of Ebel Road to 220
metres west.
b. No person shall operate
a snowmobile at a speed greater than forty (40)
kilometres per hour on the routes designated as set out in Schedule "A".
c.
The snowmobile routes designated in Schedule "A" shall be used solely for
the purpose of entering and exiting the corporate limits of the City of
Weybum.
d. Snowmobile operators
must follow the rules of the road in accordancewith
the provisions of TheHighways and Transportation Act, I99 7.
e.
It shall be unlawful for any operator of a snowmobileto cross Provincial
Highway No. 13, ProvincialHighway No. 35 or Provincial Highway No. 39
within the corporate
limits of the City of Weybum, except as designated and
set out in Schedule "A" of this bylaw.
f.
It shall be lawful to operate a snowmobile on City owned land subject to an
agreement
between the City of Weybum and the Saskatchewan Snowmobile
Association to be reviewedannually.
Notwithstanding Subsection 2 and Schedule "A", no snowmobile shall be
operated or otherwise used within 60 metres of any residence.
All Snowmobile trails within the corporate limits of the City of Weybum as set
out in Schedule "A" of this bylaw shall be maintained and property signed by a
snowmobileclub or other recognized organization.
Members of Weybum Police Service and the City Bylaw Enforcement Licensing
Officer are hereby authorized and empowered to seize and impound for a period
of up to thirty (30) days, any snowmobile unlawfully operated, kept or placed in
contravention of this bylaw.

a.
No impounded snowmobile shall be released unless the impounding charges
and storage charges, if any, are first paid.
6.
Any person who contravenes
any provisions of this bylaw is guilty of an offence
and liable on summary conviction:
a.
For the ?rst offense, a ?nd of not less than One Hundred Dollars ($100) and
not more than Five Hundred Dollars ($500) and in default of payment to
imprisonment for a term of not less than ?ve (5) days and not more than thirty
(30) days;
b.
For the second and any subsequent offense, a fine of not less than Two
Hundred Dollars ($200) and not more than One Thousand Dollars ($1,000)
and in default of payment to imprisonment for a term of not less than five (5)
days and not more than thirty (30) days;
c.
Where damage is done to property by an unlawful act under this Bylaw, the
presiding Justice of the Magistrate's Court or the Justice of the Peace may
adjudge payment of all damages occasioned by the unlawful act and the same
shall be applied for the reparation and reconstruction of the property damaged
or destroyed.
7.
that Bylaw 2003-3018 of the City of Weybum is hereby repealed.
This Bylaw shall come into force and take effect upon approval of City of Weybum
Council.
