CITY OF WEYBURN
BYLAW NO. 2023-3469
ABYLAW OF THE CITY OF WEYBURN REGULATING THE COLLECTION,
REMOVAL OR DISPOSAL OF SOLID WASTES, RECYCLABLE MATERIAL,
AND OTHER REFUSE

Council of the City of Weyburn, in the Province of Saskatchewan,
enacts as follows:
1.
DEFINITIONS
For the purposes of this Bylaw, the expressions:
1-1)
"Carts" means recycling and garbage
carts;
1-2)
"City"means City of Weyburn;
1-3)
"CityWaste Senlice" means garbage service, recycling service or such other
service that the City may provide, from time to time, for collection of waste from
designated
properties for transportation to a disposal site;
1-4)
"Council" means the Municipal Council of the City of Weyburn;
1-5)
"Director of Engineering" means the Director of Engineering for the City of
Weyburn or anyone acting under their instructions in carrying out the provisions of this
Bylaw;
1-6)
"Director of Finance" means the Director of Finance for the City of Weyburn or
anyone
acting under their instructions in carrying out the provisions ofthis Bylaw;
1-7)
"Public Health Inspector" means a Public Health Inspector appointed under the
provisions of the Public Health Act or the Health Services
Act;
1-8)
"Apartment Block" means a building which is occupied or intended to be occupied
by five or more households
living independently
of one another upon the same premises
and includes, but is not limitedto:

Five or more units which share common hallways,
1-8-2)
Units which are contained on a single parcel of land and house five or more
households
living independently
of one another;
1-9)
"Ashes" means the residue of the burning of any substance
commonly used as
fuel or in connection with any premises whether residential or commercial, industrial or
institutional premises, for the purpose of heating or cooking or disposing
of material,
including residue from incinerators'
Cinders or ashes that are produced in large
quantities at steam generating plants, factories, foundries,
laundries, manufacturing
or
other like premises are not included within the meaning of the word "ashes";

"Garbage" means putrescible animal and vegetable
wastes
resulting from
the handling, preparation, cooking and consumption
of food;
1-11)
"Litter"means any and all miscellaneous
materials of all sorts including, but not
limited to, match sticks, empty packages,
cigarette butts, loose paper, bags, boxes,
shavings,
gum wrappers, paper cups, bottles, broken glass and any or all material which
when discarded, dropped,
placed, blown or carried onto any sidewalk, street, boulevard,
lane, park, public place or private premises,
contributes to untidiness and detracts from
City cleanliness;

"Nuisance" means premises or part thereof kept in an untidy or other condition
which is or may become injurious or dangerous
to health, or which presents or hinders in
any manner the suppression
of disease;

"Occupant" means as de?ned in The Cities Act

"Offal"means the waste part of any animal killed for food;

"Owned means as de?ned in The Cities Act

"Person" includes any person, ?rm, company, association, society, corporation or
group owning or occupying any building or place or having the management or
supervision or control of any building or place to which this Bylaw applies, and includes
the owner;

"Public Place" includes any place to which the public has access as of right or
by invitation, expressed or implied;

"institutional Premises" or "Sites" means premises or sites principally used inthe
provision of services to the publicincluding but not limited to govemments, government
crown agencies,
corporations, schools, churches,
hospitals, municipal corporations,
nursing homes,
railway companies and associations;

"Premises" in the case of residential property, any self-contained dwelling place
occupied or intended to be occupied
as a separate
place of residence
and shall include
a single unit home, mobile home, townhouse,
apartment and dwelling places within a
duplex, triplex or fourplex.

"Wastes" means and includes the following:

LiquidWastes
consisting
of discarded matter containing animal, mineral
or vegetable
matter in solution or suspension;
-19-2)
Solid Wastes
consisting
of refuse and other discarded solid matter,
including waste materials resulting from domestic, industrial, commercial or agricultural
activities;

Rubbish" means non-putrescible wastes
consisting of both combustible and non-
combustible solid wastes
such as paper, cardboard, tin cans, wood, glass, bedding,
crockery and comparable materials.
Building Refuse" means solid waste material (earth, stones,
etc.) from cellar or other
excavations,
debris resulting from the prefabrication, construction, remodelling,
repair,
maintenance,
demolition, operations for houses, commercial buildings or other
structures,
including any residue from the burning or partial burning of such debris from
any portion of a building or structure destroyed
by ?re or by any other cause.
'industrial Refuse" means wastes,
rejected materials, discarded machinery,
etc., from
manufacturing
processes, factories,
foundries,
or otherworks,
wastes,
and condemned
matter from canneries,
stockyards,
slaughter
houses,
meat packing plants, vegetable
oil
plants, or similar industries, including shells, husks, cobs, peelings,
manure, slaughter
house offal and dead animals, distillery and brewery mash, or cinders from steam
generating or power plants.
'Commercial Refuse" means wastes generated
from but not limitedto institutional premises
or sites, businesses,
apartments, cafes, hotels, or other premises,
except liquidwastes
where food is served, wastes from market gardening, condemned food products, tires
and similar waste products such as may be produced in garages
and service stations.
'BulkRefuse" means all trees,
shrubs,
stumps, scrap lumber, scrap metal, large boxes and
crates, oil drums and similar unwieldy materials, discarded furniture and ?xtures
including, but not limited to, davenports,
tables, mattresses,
bed springs, and other bulky
items of house furnishings,
water heating tanks, stoves,
furnaces,
heating system
components,
fences and gates, except where such materials are clearly "Building
Refuse", "Industrial Refuse" or "Commercial Refuse".
"Dead Animals" means and includes all or any portion ofa carcass of any and all animals.
"Hazardous
Refuse" means any and all kinds of materials that may be dangerous
for
collectors to handle including, but not limited to, explosives, detonators,
ammunition,

volatile inflammable materials.poisons, acids, caustics and infected materials.

"Automated Collection" means the collection of Residential Waste or Recycle by a
system of mechanical lifting and tipping of containers into specially designed vehicles.

"Residential Waste Cart" means a cart supplied by the City which is designed to
hold Residential Waste and be rolled to a collection point where itwillbe emptied by an
Automated Refuse Truck.

"industrial waste" means waste generated
by commercial or industrial activities
that presents
health, safety or environmental concerns,
and includes, but is not limited
to, lime, sulfur, asbestos,
contaminated soils, empty chemical containers and drums,
carbon, acids, caustics,
sludge, and industrial sump water, but excludes garbage,
household
hazardous
waste and biomedical waste;

"Recyclable material" means the materials as set out in the recycling contract
between the City and designated
recycle service provider
-21)
"Recycling cart" means the cart that is provided by the City to designated
properties for the storage of recyclable materials;
-22)
"Recycling service" means the city waste service for collection of recyclable material
from designated
properties for transportation
to a disposal site;
CONTROL
1)
The Director of Engineering
is hereby designated
as the official responsible for the
control and supervision
of the provisions of this Bylaw.

No person shall dispose
of refuse in the City of Weyburn except in accordance
with the
provisions of this Bylaw.

The Director of Engineering
shall prepare, issue and publish, by posting in their office,
regulations
for the effective administration of this Bylaw, including the approximate
time of pickups by the City of all ashes, garbage
and refuse and recycle and may
change the same from time to time.
The decision of the Director of Engineering shall be final as to quantities
and classes
of material to be removed and as to the number of waste and recycle receptacles
required to contain the entire normal accumulation of wastes
originating from any
premises.
Notwithstanding anything in this Bylaw, in the event of circumstances
beyond the
control of the City, city waste services may be temporarily suspended.
City waste services shall occur on a collection schedule and a collection frequency as
set and amended
bythe Director of Engineering,
from time to time.
PRE-COLLECTION
PRACTICES
The City of Weyburn shall provide all designated
properties with a Residential Waste
and Recycle Cart for garbage and recycle collection and it is the occupants
responsibility to maintain, in good condition, the residential waste carts.
The cart is to
contain the entire accumulation ofthe waste from such householders
building or
premises during the period between collections and shall place and keep all waste
from such buildings or premises
in such carts.
The cart is the property
of the City of
Weyburn
and must be left at the property even ifthe homeowner moves or sells the
property.
EventResidential Waste Cart, excluding "commercial receptacles" as referred to in
Section 3-4-3 of this Bylaw, intended to be picked up and dumped shall, togetherwith
its contents, weigh not more than one hundred and fifty--four(154) kilograms fcrthe
360 Litre cart.

the time between collections and must not be stored beyond the front of the house.

Wherever a commercial receptacle
is required, it must be placed on a suitable base
and be accessible for collection and disposal

The residential waste and recycle carts must be placed on the street with the wheels
facing the curb or edge of roadway. There must be a minimum 1.0m (3 feet) of

around the refuse cart. The carts must be out by 7:00a.m. on the day

for collection by the Director of Engineering, and the occupant of the
premises shall be required to return the said retusecarts
from the street or edge of
road way to the property after collection of the waste is made within 24 hours.

Evewoccupant in the City of Weyburn shall keep the carts which they are responsible
for in a clean and sanitary condition by means of washing and the use of such
disinfectants as may be required.
Where collections are required from locations other than the front of the lot on the
street, a charge may be made for such service, the amount of such charge to be as set
out by the Director of Engineering or by Resolution of Council.
No person shall permit any refuse or rubbish or recycle to be or remain upon any lands
or premises
owned or occupied by them, save in carts as herein prescribed,
where
from the size or volume of any rubbish such as tree branches, grass cuttings or waste
garden produce or plants, it is impracticable
to place such rubbish in containers,
and
the same shall be placed in an appropriate area as designated
by the Director of
Engineering.
Allsuch material shall be bundled or packaged so that the length, width
or height does not exceed 0.6 metres (two feet) or weight exceed 23 kilograms (fifty
pounds) and then may be placed in the automated refuse cart for pick up.
Ashes shall not be mixed with other refuse but shall be placed in suitable non-
combustible containers as the Director of Engineering may specify, and maybe placed
into Residential Waste Carts providing the ashes are sealed and cool to the touch, for
any other reason, the provisions of this Section cannot reasonably
be complied with,
ashes and containers shall be placed where the Director of Engineering
may
designate.
The collector shall not be required to pick up hot ashes.
The removal of refuse from places placarded by the Public Health Inspector
by reason
of communicable disease
shall be performed under the direction and supervision
of
the Public Health inspector.
No person other than a lawful user thereof or the authorized collector of the City shall
open any carts or remove anything therefrom or in any manner disturb any refuse or
recycle put out for collection and removal.
No person shall operate any indoor incinerator unit unless a permit to operate the
indoor incinerator unit has been issued by Saskatchewan
Environment and

14) Every permit issued by Saskatchewan
Environment and Resource Management
for
the operation of an incinerator unit shall be posted on or near the incinerator unit, and
the permit shall be available for inspection by the Director of Engineering at all
reasonable
times.
15) Rubber, leather, tar paper or other offensive refuse or matter not completely
combustible or which gives off offensive odour when burning shall not be disposed
of
by burning in incinerator units referred to inSection 3-15.
16) No person shall place or mix with any material for removal as refuse any material
de?ned in any statute or regulation as:
i.
hazardous waste
ii.
dangerous
goods
iii.
radioactive material
iv.
hazardous
substance
v.
hazardous
product
vi.
an explosive
vii.
any used lubricating oil, used oil ?lters and used oil containers
viii.
vehicle or equipment tires, and
ix.
industrial waste
except upon written approval from the Director of Engineering.

Clippings from shrubs and trees shall be compacted
and securely tied in bundles
not exceeding 0.6 meters (two feet) in length.
17) No person shall burn any burnable items without ?rst obtaining permission
or a permit
from the Fire Chief of the City of Weyburn.

8) Every person receiving city waste services shall ensure their waste meets the following
requirements:
a)
Garbage,
broken glass, crockery or food containers from household refuse shall
not be mixed with other refuse but shall be placed together
in the garbage
receptacle.
b)
Garbage
shall be thoroughly drained of all liquid and shall be securely wrapped in
paper before it is placed in waste receptacles
for removal.
Garbage
and refuse may
be placed in the same container.
(c) Allgarbage shall be bagged or bundled inthe container.
(cl)All recyclable material shall be unbagged
in the container except shredded
paper
shall be placed in clear plastic bags.
(e) Allgeneral medical waste, animal waste, dust particles and powdered materials
shall be packaged
in securely tied, double plastic garbage
bags.
COLLECTION
PRACTICES
1)
The Director of Engineering is hereby authorized to arrange schedules
for the
collection of refuse and recycle in the various sections of the City.
2)
The following wastes
are excluded from City collection at the expense of the City at
large:
Wastes from tax exempt premises;
Waste from commercial properties;
Waste from apartment blocks;
Wastes
not properly prepared for collection;
Wastes
not placed in proper receptacles;
Wastes
exceeding the size and weight limitations specified herein;
Wastes
otherwise contrary to the requirements
of this Bylaw;
Ashes, refuse and garbage
in excess of one (1) 360L Residential Waste Cart per
weekly or biweekly per designated

Allashes, garbage or refuse disposed of contrary to the requirements
of this
Bylaw.

may be removed by the City at the expense of the occupant of the premises. Liquid
wastes,
or semi-liquids,
hazardous
refuse, and waste material not suitable, in the
opinion of the Director of Engineering, for disposal
by the sanitary land?ll method, will
not be collected by the City.

of but not limited to all building refuse, industrial refuse, commercial refuse,
bulk rubbish, junk, dead animals, liquid wastes
and hazardous
refuse will be required
to make their own arrangements
for removal and disposal

2-3)Notwithstanding
any other provision ofthis Bylaw, the following shall not be placed in a
Residential Waste Cart:
a)
items more than 2 feet (60 centimetres)
in length or individual items over 50
pounds or (23 kilograms) in weight
b)
a tire, or any kind of automotive part or automotive fluids;
c)
the whole or any part of a fence or gate or furniture, or any lumber, drywall
or any other kind of building material
d)
metal pipe, tubing or any large appliance
or plumbing fixture such as a toilet,
sink, tub, refrigerator or range;
e)
hazardous waste;
f)
dirt, rocks, sod, bricks or concrete
g)
paint or flammable liquids

health or safety of collectors at risk, including without limitation:
i)
broken glass, needles,
razor blades, or other sharp objects
ii)
an animal carcass, or human or animal feces;
iii)
sawdust, ashes or any other kind of powdery material
The City shall not undertake to collect liquid wastes.
Liquid wastes shall be disposed
of in locations speci?ed from time to time by the Director of Engineering.
The City will not undertake the collection of hazardous waste materials.
Persons
responsible
for hazardous
waste materials shall be responsible
for transporting
the
materials to such locations as may be designated
in writing for disposal by the Director
of Engineering in suitable transportation
containers and provide proper safety
safeguards
during transportation
and shall make suitable arrangements
for disposal of
the material as may be required by the Director of Engineering.
The rates for refuse collection shall be as set out in Schedule A attached hereto.
The Council ofthe City of Weyburn
may, by resolution, provide a complete or partial
collection and/or disposal service to any speci?ed
premises not covered by this Bylaw,
upon such terms and conditions as to payment or otherwise, as may be set forth in
such resolution.
The Council may, from time to time by resolution, require the owner, agent, lessee or
occupier of any building or other erection, or of any lot within the City, to remove
thereout or therefrom any ashes,
dirt, filth or rubbish, including lumber, wood sheds,
shacks, machinery or small structures
or things, and to dispose
of the same at their
own expense
at the City Waste Disposal Grounds or as may othen/vise be specified.
Such notice may also designate
a time limit in which to remove said items.

owner, agent or lessee does not, within the period designated
in the notice,
comply with the said notice, then Council may proceed
to have the work done and
charge the costs to the owner, agent or lessee.
A Residential Waste and/or Recycle Cart set out for collection shall conform to set out
standards
established
by the Director of Engineering
from time to time, which are

necessary,
in the opinion of the Director of Engineering to promote:
a)
efficiency in collection of Residential Waste and Recycle
b)
the safety of residents, motorists, pedestrians and City residential waste
collectors;
c)
the safe and efficient use of the Automated Collection trucks; and protection
of the environment.
4-9) Only Residential
Waste
and Yard Waste may be placed in a Residential Waste Cart.
4-10) A Residential Waste and Recycle Cart shall:
a)
not be filled in such a manner so that the manufacturers
rated weight limit is
exceeded;
b)
not be filled higher than the upper rim or in a manner which prevents full
closure of the lid;
c)
not have contents compressed
in such a manner that it inhibits the waste
from falling freely from the cart during the regular tipping process;
d)
not contain any material which might adhere to the Carts, unless such
material is separately
wrapped or disposed
of within individual disposable
wrappings prior to being placed in the Carts;
e)
be maintained in a reasonably clean and sanitary condition;
f)
be kept on the premises
for which the cart was supplied when not set out for
collection; and
g)
be kept with the lid closed except when depositing the Residential Waste
and/or recyclable material in order to reduce odours and prevent litter.
11) Every person to whom the City provides a Residential Waste and Recycle Cart shall.
a)
clean up spillage originating from the cart;
b)
notify the City forthwith ifthe cart is damaged
or stolen;
c)
pay the applicable fees set out in Schedule "A"to this Bylaw.
12) Parking during collection days should accommodate the automated system. No vehicle
shall park within 1.0m (3 feet) of a Residential Waste or Recycle Cart set out for

13) Any person to whom the City provides a Residential Waste and Recycle Cart who
does not comply with the direction otthe
Director of Engineering;
sets out for collection any Residential Waste at a place, in a manner or in a
container that contravenes
a provision ofthis Bylaw, including any set out
standard established
by the Director of Engineering.

or thing that is not Residential Waste or
Yard Waste or that is not collectable under the provisions of subsection

14) An occupant ofa designated
property
can apply to have an additional refuse and/or
recycle cart subject to the following terms:

The occupant must have and use a recycle bin to obtain an additional refuse
bin.
The occupant must have suf?cient space on property to store the bin as per
the conditions outlined in this bylaw.
The occupant's additional refuse/recycle
is not related to a home based
business/commercial
activity
The occupant willonly be allowed 1 additional refuse bin and 1 additional
recycle bin.
The occupant
willbe required
to have the additional bin for a minimum of
one year.
The occupant willpay the fees as outlined in Schedule
A.
The additional cart is subject to approval
by the Director of Engineering
based
on availability of carts and/or capacity of the route.
STREET CLEANING
No person shall allow any material whatsoever
that has dropped from a vehicle in their

control to remain on any street, lane or public place in the City of Weyburn.
2)
No person shall convey in or through any part of the City any manure, garbage,
waste organic matter or other obnoxious matter except in properly covered vehicles
approved of by the Director of Engineering or Public Health inspector.
3)
No person delivering and unloading fuel to any place withinthe City shall allow any
material resulting from the unloading to remain on any sidewalk or roadway,
but shall
entirely remove such materials immediately after such unloading
has been completed.
4)
No person shall deposit any material, except street dirt, in any street gutter or adjacent
to any curbing in the City of Weyburn.
5)
No person shall deposit or permit, employ or direct any other person to deposit any
refuse, dirt, water, liquidwastes or any offensive matter on or in any street, lane or
public place.
6)
No person carrying on building operations
or alterations shall deposit on any street,
lane or public place any earth, rubbish, surplus materials or other refuse.
7)
No person shall deposit or permit, employ or direct any other person to deposit on or in
any street or lane any snow or ice which has been removed from private property.
LITTERING
1)
No person shall discard or deposit or permit any servant, agent or employee to discard
or deposit in or on any street, lane, sidewalk, boulevard, walkway, bridge, watercourse,
park, school yard or any other public or private property any handbill, circular, card,
advertising
matter, paper or plastic bag or container, candy bar wrapper, cardboard or
paper box, bottle (glass or plastic), metal can, newspaper, tinfoil, cellophane
or any
refuse or any like material in a manner that does or is likely to litter the City of
Weyburn.
5)
With the exception of parking tickets deposited or attached
by the Chief of Police or
any member of the Police Department
authorized by the Chief of Police or by City
Council, no person shall deposit on or in or attach to any vehicle parked inthe City of
Weyburn any material whatsoever.
No person shall attach to any power or telephone poles, including traf?c light or light
standards
located within the City of Weyburn,
any material whatsoever.
No person shall deposit or leave shopping carts, bicycles, tricycles, baby carriages,
wagons or other such articles on City streets or in public places in such a manner as to
be a nuisance or an obstruction to persons using such streets, parks or public places.
All places of business selling confectionary, ice cream, popcorn, cigarettes, candy and
like material shall provide on their premise a receptacle for material that othenlvise
would tend to litter the City of Weyburn ifdiscarded
indiscriminately.
Further, all
businesses
that sell confectionary,
ice cream.popcorn, cigarettes,
candy and like
material from a vehicle shall provide attached to said vehicle a receptacle for material
that othen/vise would tend to litter the City of Weyburn if discarded
indiscriminately.
Further, all automatic vending machines shall have attached thereto a receptacle for
material that otherwise would tend to litter the City of Weyburn if discarded
indiscriminately.
Allshopping centres,
drive-in business establishments and private parking lots shall
provide receptacles
approved by the Director of Engineering as to design and number
for the deposit of all material that would otherwise tend to litter the City of Weyburn
if
discarded
indiscriminately.
The owner of any property shall be responsible for picking up all material that
accumulates on their premises
that litters or tends to litter the City of Weyburn and it
the said owner refuses to pick up said material upon being directed to do so by the
Director of Engineering
or a duly authorized employee of the City of Weyburh acting on
their behalf, the said owner shall be subject to the penalty provided in Schedule
A
(item number 4) attached hereto.

8)
All persons shall place material that would otherwise tend to litterthe City of Weyburn
in a private or public receptacle
provided for such material and shall do so in a manner
to prevent it being carried or deposited
upon any street, sidewalk or public place or
upon any private property in the City of Weyburn.
Further, if no public or private
receptacle is available, every person shall retain the said material on their person and
shall not discard said material except in a public or private receptacle for such
material.
No person shall operate any vehicle transporting ashes,
garbage,
refuse or other
debris of any kind on any highway, street, lane or bridge in the City of Weyburn, unless
the load is completely enclosed or covered with a securely fastened
tarpaulin covering
the load in such a mannerthat
it shall be impossible for any part ofthe load of the said
vehicle to become dislodged.
9--1)Noperson shall store, convey or cause to be conveyed
on any street any garbage,
offal from slaughter houses or butcher shops, swill or any waste of any offensive
nature in a vehicle or container that is not properly constructed
and covered so as to
prevent the contents
thereof from escaping.
9-2) The vehicle or cover shall be constructed in such a manner as to protect the contents
from flies and to minimize any offensive odours therefrom.
9-3) No person shall allow any such vehicle or container to stand on any street, highway,
lane or bridge for more than thirty (30) minutes except in the case of an emergency.

to the person in charge of such site and complying with the instructions given by such
person.

shall from time to time be determined by Resolution of Council, and shall be posted at
the Waste Disposal Grounds.
Hours of operation may be obtained on request from
the Director of Engineering's department.
No delivery shall be made except during
such hours.
7 6)
No unauthorized person shall remove or take away any material, object or thing from
the Waste Disposal Grounds without written permission
from the Director of
Engineering.
The City shall own and have sole right to dispose
of all wastes
collected
by City forces and all wastes delivered to the Waste Disposal Grounds
for disposal.

No person shall start a ?re unless authorized to do so by the Director of Engineering.

No person shall be permitted to enter the Waste Disposal
Grounds except a person operating a vehicle for the purpose of conveying refuse into
the disposal site and such person or persons shall be permitted to remain on the
disposal site only so long as reasonably
may be required to unload the refuse
contained In the vehicle.
A person delivering any waste to the Waste
Disposal Grounds for disposal shall pay to
the City a fee for disposal in accordance
with Schedule B.
The fees must be paid at
the disposal site unless other arrangements have been made with the Director of
Engineering.
No unauthorized person shall enter upon the City's Waste Disposal Grounds for the
purpose of removing anything therefrom nor for the purpose of examining or in any
way disturbing or handling any refuse therein.
The Director of Engineering may permit any person or business
who is not a resident
of the City to dispose
of refuse in the disposal site subject to such terms and
conditions as the Director of Engineering
may deem expedient.

City Council may enter into agreements
with municipalities to dispose
of refuse in
the disposal site subject to such terms and conditions as City Council may
deem expedient.
No person, except with the written permission of the Director of Engineering, shall burn
any refuse or cause any fire to be set at the disposal site, nor shall any person deposit
any combustible or flammable refuse at the disposal site except as directed.
No one shall dispose
of the carcass of any dead animal, fowl or any form of livestock
at the disposal site save upon notification to the Director of Engineering and upon such
terms as to disposal. Animal carcasses
must follow the Special Waste Disposal
Procedure and requires
a Special Waste
Disposal Permit. The fee for such disposal
shall be as set out in Schedule B attached hereto and may be changed from time to

7-14) Disposal charges
for wastes not covered under Schedule B shall be as authorized by
the Director of Engineering and shall include, but not be limited to, liquidwastes,
combustible or flammable wastes,
hazardous wastes,
dangerous
goods, radioactive
material or explosive wastes.
Wastes
in this category may only be accepted with the
approval of the Director of Engineering.
7-15) Subject to payment of the applicable fee, any person may deliver waste to the land?ll
for disposal by the City so long asthat
waste is permitted in the City's Permit to
Operate a Disposal Ground issued by the Province of Saskatchewan.
8-1)
Charges
or fees payable by owners or occupants of land or buildings for the
collection, removal or disposal of solid wastes
or other refuse are those charges
or
fees as set out in Schedule A attached hereto, or such as shall from time to time be
determined by Resolution of Council to amend Schedule A.
8-2)
The accounts for such charges
or fees shall be made out and sent monthly or at such
other intervals as may be determined from time to time by Resolution of Council and
shall be due and payable at the office of the Director of Finance when rendered.
8-3)
Where, pursuant to this Bylaw, the whole or any part of a sum payable to the City of
Weyburn for the collection, removal or disposal of solid wastes,
recycling services,
and other refuse that remains unpaid on December 315'of the year in which the sum
became payable, is to be added to, and thereby torm part of, the taxes on the land
and buildings in respect of which the collection, removal or disposal
is done.

Every owner or occupant
of a designated
property shall pay the daily recycling
service fee even where the owner or occupant
does not set out any recyclable
material for collection.
The recycling services fee is a ?xed monthly rate which is not based
on volume of
recyclable material collected, processed
or disposed of.
PENALTIES
AND ORDERS
The Director of Engineering shall issue such orders as they deem necessary
for the
effective application
and enforcement of any provision of this Bylaw.
Where a
condition of a premises is in contravention of this Bylaw, the Director of Engineering
shall issue orders to resident occupants, with copies to the registered and assessed
owners.
The Chief of Police or any member of the Police Department
and/or a Bylaw Of?cer
authorized
by the Chief of Police or by City Council, shall have and is hereby granted
power to issue citations for contraventions of Section 6 of this Bylaw, and the penalty
provisions of Section 93 of this Bylaw shall apply to such violations.
Any person who violates any of the provisions of Section 6 ofthis Bylaw shall be
guilty of an offence and liable on summary
conviction to a fine as set out in Schedule
A (item number 2a) attached hereto or such as shall from time to time be determined
by Resolution of Council.
9-3-1)All ?nes, penalties and forfeitures mentioned in this Bylaw may be recovered and
enforced with costs by summary conviction before a judge and, in default of payment,
the person convicted may be imprisoned for a term of not more than 90 clays,
unless the ?ne or penalty is paid sooner.

9-3-3) Conviction of a person for a contravention of any provision of this Bylaw does not
relieve himfrom compliance with the Bylaw, and the convicting judge orjustice
of the
peace shall, in addition to any ?ne imposed,
order the person to perform, within a
specified period, any act of work necessary
for the proper observance
of the Bylaw or
to remedy the contravention of the Bylaw.
9-3-4)A person who fails to comply with an order made pursuant to Section 9-3-4 within the
period specified
in the orderis
guilty of an offence and liable on summary
conviction
to a fine as set out in Schedule A (item number 2c) attached hereto or such as shall
from time to time be determined by Resolution of Council.
9-3-5) Nothing in this Bylaw relieves a person from complying with any federal or provincial
law or regulation, other bylaw or any requirements of any lawful permit, order,
consent
or other direction.
9-4)
Any person or persons guilty of an infraction ofthis Bylaw except Section 6 shall be
liable to the penalties
imposed by the City Bylaw No. 2005-3051 (General Penalty
Bylaw) through Schedule
A (item number 2b) attached hereto, and to such further
?ne, order, or penalty as the convicting Magistrate may impose under Section 338 of
The Cities Act or as the same may from time to time be amended.
9-5)
Allfines imposed under Section 9-3-1 ofthis Bylaw may be paid by a person
ccntravening
the Bylaw to the of?ce of the City Finance Department
within seven (7)
days of being served with a Notice of \?o|ation
in Form A attached hereto, and on
payment as so provided, that person is not liable for prosecution for the offence.
9-6)
A decision of a court that one or more of the provisions of this Bylaw are invalid in
whole or in part shall not affect the validity, effectiveness
or enforceability of the other
provisions or parts of the provisions of this Bylaw.
9-7)
That Bylaw No. 2018-3391 of the City of Weyburn
is hereby repealed.
