A BYLAW OF THE CITY OF WEYBURN
TO REGULATE TRAFFIC AND
CONTROL THE USE OF PUBLIC
HIGHWAYS
Whereas The Cities Act, S.S. 2002, c. C-11.1, in section 12, gives cities direction,
control and management of all streets within the city;
And whereas The Cities Act, in section 306, requires cities to keep every street or other
public place that is subject to the direction, control and management of the city,
including all public works in, on or above the streets or other public place put there by
the city of by any person with the permission of the city, in a reasonable state of
repair;
And whereas The Cities Act, in section 8, authorizes the city to pass bylaws in relation
to, amongst other matters, the safety, health and welfare and protection of people and
property, transport and transportation systems, including carriers of persons or goods,
subject to The Traffic Safety Act, the use of vehicles and the regulation of pedestrians,
and streets and roads, including temporary and permanent openings and closings;
And whereas The Traffic Safety Act, S.S. 2004, c. T-18.1, in Part XVI and The
Highways and Transportation Act, 1997, H-3.01, provides rules of the road which
apply throughout the province;
Now, therefore, the Council of the City of Weyburn in the Province of Saskatchewan
enacts as follows;

PART I
INTERPRETATION
Title
1 This Bylaw may be referred to as the Traffic Bylaw.
Purpose
2 The purpose of this bylaw is to fulfil the statutory responsibilities of the
municipality over its streets and roads and to promote their safe use by motorists
and pedestrians.
Authority
3 The authority for this bylaw is The Cities Act, in particular sections 8, 12, and 100,
and subsection 381(3).
Definitions
4 (1) In this bylaw, words shall be given the following meaning, this meaning shall be
superseded by definitions contained in The Traffic Safety Act if there are is any variation:
"Highway" means a street, alley or other road designed and intended for or used by
the general public for the passage of vehicles, but does not include any privately or
publicly owned area primarily intended to be used for the parking of vehicles and the
necessary passageways on that area;
"Median" means the strip of land dividing any street into two or more lanes for
traffic going in opposite directions;
"Parking" means the standing of a vehicle, whether occupied or not, on a public
highway, otherwise than temporarily for the purpose of and while actually engaged in
loading or unloading or in obedience to traffic regulations, signs or signals;
"Peace officer" means: (a) a member of a police service in Saskatchewan;
(b) a person or class of persons designated by the Lieutenant Governor in Council as
traffic officers; or (c) any person appointed pursuant to The Police Act, 1990 as a
special constable for the enforcement of this Act;
"Pedestrian" means any person on foot or confined to a wheelchair, whether powered
by human power or by motor;
"Recreational vehicle" means a vehicle, portable structure, trailer or water craft that
can be towed, hauled, carried on a vehicle or trailer, or driven and which is designed to
be used for travel or recreational purposes, including:
(a) a motor home, camper, travel trailer, fifth wheel trailer, tent trailer, truck
camper, boat, canoe, kayak, snowmobile, all-terrain vehicle, motorcycle or other
similar vehicle; or
(b) a trailer designed to carry an item listed in (a).
"Stop" means: (a) when required, a complete cessation from movement; and
(b) when prohibited, any stopping, even momentarily, of a vehicle, whether occupied
or not, except when necessary to avoid conflict with other traffic or in compliance with
the directions of a police officer or a traffic control signal;
"Traffic control device" means any sign, signal, parking meter, pavement marking,
barricade or other device erected, placed or marked on, at or above a public highway
pursuant to The Traffic Safety Act and Uniform Traffic Control Devices for Canada for
the purposes of regulating, warning or guiding the public;
"Vehicle" includes a combination of vehicles and any load on the vehicle or
combination of vehicles;

(2) In this bylaw, the following words shall be given the meaning stated below:
"Alley" means a street or lane intended primarily to give access to the rear of
a property.
"City Manager Designate" means the person or persons designated by the
City Manager of the City of Weyburn who have been given authority over
sections of this Bylaw.
"Chief of Police" means the person appointed as Chief of Police of Weyburn
or the police officer acting as Chief of Police during the absence of the Chief of
Police;
"City" means the City of Weyburn;
"Council" means the Council of the City;
"Dangerous goods" means dangerous goods within the meaning of The
Dangerous Goods Transportation Act 1992 (Canada);
"Dangerous goods vehicle" means any vehicle designed to haul dangerous
goods and required to have a dangerous goods placard, including a vehicle
pulling a trailer with such dangerous goods pursuant to The Dangerous Goods
Act, 1992 (Canada), its Regulations or any successor legislation;
"Director" means the Director of Engineering of the City or such other person
employed by the City as department head whose responsibilities include streets
and traffic or any authorized person employed by the City to act on behalf of
the Director;
"Downtown" means from the south side of Bison Avenue to the south side of
Railway Avenue; and the east side of Government Road to the west side of 4th
Street NE;
"Driveway" means an approach, paved or unpaved, that provides access for
vehicles and pedestrians from a boulevard, curb, or sidewalk to a lot or a
carport, garage, parking pad, loading berth, or structure located on the lot;
"Heavy vehicle" means:
(a) a motor vehicle with a gross weight registration exceeding 9,000
kilograms; or
(b) any vehicle, including any combination of motor vehicle, trailer and
any load, with a weight exceeding 9,000 kilograms; or
(c) any vehicle, including any combination of vehicle and trailer, which
exceeds ten meters in length.
"Lane" means a street or alley intended primarily to give access to the rear of
a property.
"Parking lane" means that portion of longitudinal division of a highway of
sufficient width to accommodate parking of a single line of vehicles adjacent to the
curb and where parking is permitted;
"Pilot car" means a vehicle identified in conformity with the Escort
Vehicle Equipment Requirements of the Saskatchewan Ministry of
Highways and Transportation Weights and Dimensions Administration
Manual, as amended;
"Recreational Area" means any area designated by Council for use for
recreation.
"Slow-moving vehicle" means any vehicle or equipment which:
(a) is designed for use at speeds less than 40 kilometers per hour;
(b) normally travels at speeds less than 40 kilometers per hour; or
(c) is not capable of sustained speed greater than 40 kilometers per hour for
greater certainty, includes a bicyclist, person on horseback or horse drawn
carriage.

Traffic Signs
5 (1) Installation of signs: The Director is hereby authorized to install and maintain
traffic control devices for the purpose of the control, warning, stopping, yielding,
guidance, information and direction of traffic conformity with this Bylaw, Uniform
Traffic Control Devices of Canada or any traffic warrants approved by Council.
(2) Inventory of Signs: The Director shall keep an inventory of the location of all
traffic control signs and the information shall be open to inspection at the office of
the Director of Engineering during normal business hours.
Directing Traffic
6 (1) A peace officer having jurisdiction in Saskatchewan is hereby authorized to
direct traffic on any highway:
(a) in conformity with this Bylaw and The Traffic Safety Act; or
(b) notwithstanding any other provision of this Bylaw, as the peace officer or a
firefighter responding to an emergency deems necessary to expedite traffic,
safeguard pedestrians, prevent accidents or meet any unforeseen conditions
in the event of a fire, traffic collision, traffic signal light malfunction or
other emergency.
(2) No person shall fail to comply with a direction or signal given by a peace
officer or a firefighter under authority of this section.
Traffic Control Devices
7 (1) The Director is authorized to have traffic control devices placed on or by
highways for the purpose of the regulating, warning or guiding traffic in
conformity with this Bylaw or any traffic warrants approved by Council.
(2) Traffic control devices shall, in so far as reasonably possible, be designed and
placed in conformity with the Manual of Uniform Traffic Control Devices for
Canada.
Traffic Warrants
8 (1) The Director may, subject to available budget for the work, have traffic control
devices placed at locations where such traffic control device meets traffic warrants
approved by Council.
(2) Council, in approving traffic warrants, shall provide criteria, such as traffic
counts, incidence of collisions, or petitions from the public, which warrant the
traffic control device.
Traffic Inventory
9 The Director shall keep an inventory of:
(a) the location of all permanent traffic location devices installed by the City;
(b) the location of all signed or marked parking and stopping restrictions in the
City;
(c) the location of all public parking lots provided by the City.
Traffic inventory shall be open to public inspection at City Hall during normal
business hours.

RESTRICTED USE OF HIGHWAYS
Temporary Road Closure
10 (1) The Director and the Chief of Police are authorized as the designated officers
with authority to temporarily close the whole or a part of a street at any time for
any purpose considered necessary, as provided by section 14 of The Cities Act.
(2) No person shall drive a vehicle on any street which has been temporarily
closed, except where permitted by the designated officer who closed the street.
(3) Notwithstanding any other provision in this Bylaw, the Director shall have
authority to temporarily close to vehicular traffic or restrict parking or stopping on
any public highway as follows:
(a) to enable work to be carried out by or on behalf of the City, including road
maintenance, street cleaning, snow removal and sewer or water line
construction, repair or improvements;
(b) to facilitate the moving of any building, structure, machine or other object;
(c) to facilitate the construction, repair or demolition of a building, structure or
other object;
(d) to facilitate public gatherings.
(4) Notwithstanding any other provision in this Bylaw, the Chief of Police shall
have authority to temporarily close to vehicular traffic or restrict parking or
stopping on any public highway for the purpose of a parade or assembly of
persons.
(5) Where a public highway is temporarily closed, the Director shall cause the
highway to be marked with a sign or barricade indicating the closure and the
hazards, if any, that would be encountered in its use.
Snow Removal Route
11 (1) No person shall park or stop a vehicle or permit a vehicle to be parked or
stopped on any street or portion of any street identified as a snow route in Schedule
"H" to this Bylaw.
(2) Subsection (1) applies when the City Manager or their designate declares
snow routes to be in effect.
(3) A declaration announcing snow routes to be in effect shall remain in effect for
a period of 24 hours unless sooner terminated or extended by further declaration of
the City Manager or their designate with such 24 hour period commencing and
being effective from the time specified in the declaration.
(4) The City Manager or their designate shall inform the general public of the
existence of the snow route declaration using whatever means he or she may
deem advisable.
(5) All vehicles parked on designated snow routes while a declaration is in effect
may be moved, without notice, for such distance as is necessary, or impounded by
the City at the expense of the registered owner of the said vehicle.
No Unauthorized Work on Highways
12 No person shall:
(a) interfere with the use of any highway;
(b) do any roadwork or snow removal on a highway;
(c) dump snow on a highway or within any road allowance
except as may be authorized by the Minister of Highways or the City or as
otherwise allowed by law.

Obstructions
13 (1) No corner obstructions are permitted on any site except in accordance with the
requirements of the City of Weyburn Zoning Bylaw as approved by the City of
Weyburn Council.
(2) The Director and Chief of Police are authorized to have removed any offending
obstruction at the cost of the person who caused the obstruction to be placed there
and to destroy or otherwise dispose of the obstruction.

PART IV
TRAFFIC ROUTES & RESTRICTIONS
One-Way Streets
14 The highways identified in Schedule "A" to this Bylaw are designated as one-way
streets or alleys.
Truck Routes
15 The routes shown on maps appended to this Bylaw as Schedule "B" are designated
as truck routes.
Offence to Drive Off of Truck Route
16 No person shall drive or park a heavy vehicle on any highway not designated as a
truck route, except:
a) is making collection or delivery, in which case the vehicle must follow the
direct route to and from the nearest Truck Route;
b) is proceeding to or form the business premises of the owner or operator of the
vehicle, in which case the vehicle must follow the direct route to and from the
nearest Truck Route;
c) Is proceeding to or from a garage for the purpose of repairs, servicing, or
refueling, in which case the vehicle must follow the direct route to and from
the nearest Truck Route
d) Is being operated by or on behalf of the City of Weyburn;
e) Is under escort by a marked vehicle operated by a member of the Weyburn
Police Service or the City of Weyburn
f) Where the owner or operator of the vehicle has obtained a permit to do so
from the Director and then only according to the terms of that permit and
provided the permit is in the vehicle and available for inspection by the police
Weight Restrictions
17 (1) No person shall operate any vehicle within the City of Weyburn that exceeds
the legal allowable weight limitations of a road or is in contravention of the
Province of Saskatchewan Vehicle Weights and Dimensions Regulation.
(2) Any person transporting any oversize load (weight or dimensions) shall
provide to the Director of Engineering copies of any permits issued by the
Province of Saskatchewan a minimum of 72 hours in advance of the load being
moved through or about the City of Weyburn.
(3) A vehicle may be weighed by a peace officer by means of portable weigh
scales, or stationary weigh scales, approved by the Director of Engineering.
(4) In order to determine the weight of a vehicle pursuant to subsection (3), the
peace officer may, where weigh scales approved by the Director of Engineering
are within 10 kilometers, require the person in charge of the vehicle to take the
vehicle to that weigh scale.
Engine Retarder Brakes
18 No person operating a vehicle shall use engine retarder brakes in the City, except
to avoid or reduce the impact of a collision or in the case of such other emergency.

PARKING AND STOPPING
Signs
19 (1) Where a sign indicates parking or stopping restrictions by directional arrow,
that restriction shall continue in the direction of the arrow to the next street
intersection unless interrupted by a similar sign with a directional arrow or by
signs permitting parking.
(2) Time limits for parking shall apply within the street block where parking is
limited such that the restriction shall continue to apply to any vehicle which is
moved but remains on the same side of the same block of the street.
Parking at Curb
20 No person shall park a vehicle on a street except:
(a) at the right-hand curb on a two-way street;
(b) at either curb on a one-way street;
(c) parallel to or alongside the curb unless angle parking is indicated by signs
or markings;
(d) in the direction of traffic on that side of the street.
provided such parking is not otherwise prohibited by this Bylaw.
Parallel Parking
21 (1) No person shall park a vehicle on a street where parallel parking is provided:
(a) with the front or rear wheel nearest the curb more than 0.6 meters from that
curb;
(b) within 0.6 meters of any vehicle previously parked in front of or behind the
vehicle.
(2) Notwithstanding subsection (1), where the vehicle is a solo motorcycle, the
motorcycle shall be parked at an angle of 45 degrees to the curb with the rear
wheel no more than 0.6 meters from the curb.
Angle Parking
22 (1) No person shall park a vehicle on any street where angle parking is provided
except:
(a) in accordance with signs or markings designating a parking stall;
(b) where the angle of the parking stall is less than 90 degrees with the leading
edge of the vehicle's bumper within 0.6 meters of the curb; and
(c) where the vehicle measures less than seven meters in overall length.
(2) No person shall back a vehicle into a parking stall intended for angle parking.
Parking Lots
23 The Director of Engineering has set out parking stalls in the public parking lots
which are listed in Schedule "F".
(a) No vehicle shall be left or parked in any public parking lot which is listed
in Schedule "F" unless it is wholly within the boundaries of a parking stall
as described in section 23 of this bylaw and is not oversized as described
per section 27 (1) of this bylaw;
(b) No vehicle shall be left or parked in any public parking lot which is listed
in Schedule "F" for more than forty-eight (48) consecutive hours.

Parking with Engine Running
24 No person shall park a vehicle on any public highway with the engine running
unless the vehicle remains in charge and under the control of an operator or is
completely locked.
Parking Restrictions on Highways
25 No person shall park a vehicle on any highway:
(a) where parking is prohibited by display of an authorized sign;
(b) for a longer time than allowed, where the time period for parking is limited
by display of a sign;
(c) for longer than 48 hours, where no other time limit is posted;
(d) in a parking stall marked as reserved for the handicapped, unless the
vehicle bears a valid sticker or placard issued by the Saskatchewan
Abilities Council or Canadian Paraplegic Association;
(e) within one meter of the edge of a driveway and no vehicle shall be parked
such that it obstructs the access, egress
(f) within three meters of a fire hydrant, measured parallel to the curb;
(g) within three meters of an alley or lane intersection;
(h) within fifteen meters of a railway track;
(i) within ten meters of the nearest edge of asphalt of an intersecting street,
unless parking is permitted by an authorized sign;
(j) within three meters of a painted pedestrian crosswalk;
(k) on any traffic lane;
(l) on any center median or boulevard, except where parking is allowed by
sign or markings;
(m) where the posted speed limit exceeds 50 kilometers per hour;
(n) which has been temporarily closed to traffic;
(o) where the vehicle does not display a current license plate registered to that
vehicle;
(p) where the vehicle displays "for sale" signs.
Parking Prohibited off public highway
26 No person shall park a vehicle on any:
(a) alley, except that a vehicle may be parked on an alley when continuously engaged in
loading or unloading and for no more than sixty minutes;
(b) sidewalk;
(c) side boulevard or other part of the road allowance not intended for parking;
(d) municipal property not intended for use as a parking lot;
(e) private property without the permission of the owner or occupant.
Oversized Vehicle Parking
27 (1) No person shall park a vehicle longer than one hour on a highway where the
vehicle has:
(a) a gross registered weight or actual weight exceeding 5,500 kilograms;
or/and
(b) an overall length of more than 8.5 meters;
(2) Subsection (1) shall not apply to:
(a) vehicles engaged in authorized road works;
(b) recreational vehicles.
Dangerous Goods Vehicle Parking
28 No person shall park a dangerous goods vehicle within 150 meters of any place of
public assembly, except when:
a. making a pickup or delivery of dangerous goods; and
b. the dangerous good vehicle and the pickup or delivery process is under
constant supervision during the period of time that the dangerous good vehicle
is parked.

No Unattached Trailer Parking
29 No person shall park a trailer that is unattached from a towing vehicle without first
obtaining a permit from the Weyburn Police Service.
No Stopping
30 No person shall stop a vehicle on any highway:
a. where stopping is prohibited by display of an authorized sign.
b. in a traffic lane, except where required by traffic, a traffic control device or
as directed by a peace officer.
Repair of Vehicles on Public highway
31 (1) No person shall wash, repair, dismantle or otherwise work on a vehicle on a
highway, except in case of emergency and then only in the curb lane of the street.
(2) When a vehicle breaks down on a highway, the operator shall immediately
move the vehicle off the road or into the parking lane.
(3) No person shall leave any vehicle for more than three hours on any highway
when that vehicle has been placed on a jack or blocks.

PART VI
MOVING VIOLATIONS
Speed Limits
32 No person shall operate a vehicle in excess of the speed limit set by this Bylaw.
General Speed Limit
33 (1) The general speed limit within the City is set at 40 kilometers per hour, unless a
different speed limit is provided in Schedule "C" to this Bylaw, which speed limits
should be posted.
(2) This general speed limit does not apply to any provincial highway which has a
higher posted speed limit under The Traffic Safety Act.
(3) The general speed limit for lanes and alleys within the City is set at 20
kilometers per hour, unless a different speed limit is posted.
(4) The Director of Engineering in consultation with the Police Chief may
designate a speed zone that overrides the general speed limit within the City.
School Zone/Designated Recreational Area Speed Limit
34 (1) The speed limit in any school zone is 30 km/hour between the hours of 7:00
a.m. and 7:00 p.m.
(2) The speed limit in a designated recreational area, as specified in Schedule
"D", marked by the appropriate signage is 30 km/hour between the hours of 7:00
a.m. and 7:00 p.m.
U-Turns
35 (1) No person operating a vehicle shall turn the vehicle on a highway so as to
proceed in the opposite direction except:
a. at a street intersection not controlled by a traffic signal light, pedestrian
signal, activated pedestrian corridor, or a school safety patrol.
b. at a break in the center median.
Provided that there are no signs prohibiting U-Turns.
(2) No person operating a vehicle, having turned or turning the vehicle to proceed
in the opposite direction, shall proceed until it is safe to do so.
Slow-moving Vehicles
36 No person shall operate a slow-moving vehicle on any highway from one-half hour
before sunset and one half hour after sunrise, except where the slow-moving
vehicle:
a. is equipped with operating headlights and tail lights; or
b. is preceded and followed by pilot cars.
Farm Machinery and Road Construction Equipment
37 No person shall operate any farm machinery, road construction equipment or
tracked vehicle or equipment on a highway from one-half hour before sunset and
one half hour after sunrise, unless preceded and followed by pilot cars.
Obstructing Traffic
38 (1) No person shall obstruct, interfere with or interrupt the free passage of
vehicular traffic on any highway.

(2) No person shall obstruct, interfere with or interrupt the free passage of
pedestrian traffic on any sidewalk or crosswalk.
(3) No person shall block or close the whole or a part of a street at any time for any purpose
without receiving a permit from the Director of Engineering
Leaving Stationary Position
39 No person operating a vehicle, shall, when moving from a stationary position in
the curb lane or at the side of the highway into the flow of traffic, fail to yield the
right of way to traffic in the driving lanes.
Open Doors
40 No person shall:
a. open a vehicle door into the path of a vehicle, including a bicycle;
b. leave a vehicle door open where it intrudes into the adjacent driving lane or
sidewalk, except for the time required to get out of or into the vehicle.
Tracking Mud onto Highway or Causing Damage to Highway
41 No person operating a vehicle or other equipment shall do so in a manner which
tracks mud or debris onto a highway or causes damage to a highway.
Splashing Pedestrian
42 No person operating a vehicle shall:
a. splash any pedestrian;
b. project dirt or water at or onto any pedestrian or other vehicle by spinning
tires or accelerating quickly.
Hitchhiking
43 No pedestrian standing or walking on the street, median, sidewalk, or boulevard
shall solicit a person who is in a vehicle, whether moving or stopped, including for
a ride or donation.
Soliciting from Vehicle
44 No person in a vehicle shall:
a. solicit business from the vehicle, except where permitted to so by the City;
b. annoy any person by soliciting or enticing a person to the vehicle.
Curb/Sidewalk Crossing
45 No person operating a vehicle shall drive the vehicle across a curb or sidewalk
except at a curb crossing unless a Temporary Curb Crossing Permit has been
obtained from the Director.
Crossing Fire Hose
46 No person operating a vehicle shall drive the vehicle across or stop a vehicle on
any fire equipment, including water hose, which is in use or intended to be used
by members of the Weyburn Fire Department

PART VII
BICYCLISTS
Rules of the Road apply
47 Every cyclist shall operate their bicycle in accordance with the rules of the road as
set out in this Bylaw and The Traffic Safety Act.
Restrictions on Bicyclists
48 (1) No person shall operate a bicycle:
a. with a wheel diameter of 40 centimeters or more on any sidewalk or
pedestrian mall, except where permitted by sign;
b. without at least one hand on the handle bars;
c. while riding more than two abreast of another cyclist and within the same
traffic lane;
d. while carrying more persons than the number for which it is designed and
equipped;
e. carrying a load in excess of that for which the bicycle is designed and
equipped;
f. between one-half hour before sunset and one-half hour after sunrise unless
the bicycle is equipped with a lighted headlamp visible from the front of
the bicycle and a red tail light that is visible from the rear of the bicycle.
OTHER VEHICLES
In-line Skates, Roller Skates, Skateboards
49 No person shall travel:
a. on that portion of the highway intended for vehicles;
b. on any sidewalk in the downtown, as defined in section 4;
when using in-line skates, roller skates, a skateboard or similar device.
Motorized Wheelchairs, Medical Scooter and Segway
50 Persons using motorized wheelchairs, medical scooters, segways or similar
devices:
a. are considered to be pedestrians and may use the sidewalk or, where no
sidewalk is available, the curb lane of residential streets;
b. shall show reasonable consideration for other pedestrians, including
slowing when overtaking pedestrians to avoid collision;
c. maintain a position on the right half of sidewalk when approaching
pedestrians to avoid collision; and
d. maintain a position on the right of the curb lane of residential streets where
no sidewalk is available to avoid collision.

PART VIII
PERMITS
51 The Chief of Police or the Director of Engineering is authorized to issue the
following permits in a printed form as he may determine, provided the applicant
meets the criteria set out in Schedule "F" to this Bylaw for issuance of the permit,
including any prescribed permit fee:
a. parade permit, allowing the applicant to hold a parade on an approved route
or public gathering on a temporarily closed highway;
b. refuse bin permits, allowing the applicant to have a refuse bin which
requires mechanical collection to be placed at a specified location in the
curb lane for the permitted time;
c. residential parking permits, which allows residents to park their vehicles on
the block on which they reside for longer than the time normally allowed
provided the permit is properly displayed;
d. visitor parking permits, which allows visitors to park all day at a two (2)
hour parking location without payment provided the permit is properly
displayed.

PART IX
ENFORCEMENT
Penalty for Violation
52 (1) Subject to subsections (2), (3), (4) and (5), any person who contravenes any
provision of this Bylaw is guilty of an offence punishable on summary conviction
by a fine in an amount not exceeding:
a. $2,000 in the case of an individual;
b. $5,000 in the case of a corporation;
or, in default of payment by an individual, by imprisonment for a period of time
determined in accordance with section 29 of The Summary Offences Procedure
Act, 1990.
(2) When a peace officer or other person authorized by the Chief of Police or the
Director to enforce this Bylaw has reason to believe that a person or vehicle has
contravened any provision of this Bylaw specified in Schedule "G", that peace
officer or other person may issue a Notice of Violation to the person or place the
Notice of Violation on the vehicle. The Notice of Violation shall indicate that the
City will accept voluntary payment in an amount as prescribed in the Schedule "G"
at the Weyburn Police Service office.
(3) Where the voluntary payment of the prescribed amount in Schedule "G" is
received before a parking summons is issued, the person receiving the Notice of
Violation and the owner of the vehicle shall not be liable to prosecution for the
alleged contravention.
(4) Where a parking summons is issued for a violation of any provision of this
Bylaw specified in Schedule "G", a person may make a voluntary payment of the
specified penalty sum listed in Schedule "G" for that violation if they do so before
the specified date set out in the parking summons.
(5) The amount prescribed for each violation set out in Schedule "G" is designated
as the specified penalty sum for that violation for the purposes of entering a default
or deemed conviction pursuant to Part V.1 of The Summary Offences Procedure
Act, 1990.
(6) Nothing in subsections (2) or (3) shall be construed to prevent any person from
exercising his or her right to defend a charge of contravention of this Bylaw.
(7) When a peace officer issues a Summary Offence Ticket Information for a
violation of any provision of this Bylaw specified in Schedule "G", that peace
officer may enter on the ticket an amount as prescribed in the Schedule that the
Provincial Court will accept as advance voluntary payment."
Notice of Violation
53 (1) The Chief of Police or Director of Engineering may:
a. approve a form for use as a notice of violation which may be issued by
authorized persons to vehicles found in violation of designated offences for
which voluntary payment as provided in Schedule "G" to this Bylaw.
b. authorize any person to issue notice of violation to any vehicle which
appears to be in violation of a provision of this Bylaw.
(2) Any person who receives a notice of violation for a designated offence may
avoid prosecution by making voluntary payment at Weyburn Police Service within
fifteen days of issuance of the notice of violation.

Removal of vehicle or obstruction from highway
54 Any peace officer or any person authorized by the Chief of Police or the Director
of Engineering may move or remove or cause to be moved or removed any:
a. vehicle that is unlawfully parked or left on any highway or other property;
b. obstruction, encumbrance or encroachment created or left on any highway,
sidewalk or boulevard at the cost of the person who created or left the
obstruction, encumbrance or encroachment and may destroy or otherwise
dispose of the object without further notice.
Impoundment
55 (1) Where a vehicle is removed under authority of this Bylaw, the vehicle shall be
impounded and stored for a period of up to thirty days during which the owner, on
providing proof of ownership, may recover the vehicle by paying the cost of
removal and storage fees.
(2) Any impounded vehicle not redeemed within thirty days may be sold or
otherwise disposed of and the proceeds from such sale or disposal applied to the
cost of removal and storage fees or to any unpaid fines imposed on the owner
under this Bylaw.
Cancellation of Tickets
56 The Chief of Police may cancel any Notice of Violation where, in the opinion of
the Chief of Police or the Director that Notice of Violation was issued improperly
or in error.

SEVERABILITY
57 If any section, subsection, clause or other portion of this Bylaw is for any reason
found to be invalid, that portion shall be deemed a separate, distinct and
independent provision and shall not affect the validity of the remaining portions of
the Bylaw.
ADOPTION AND REPEAL
Effective Date of Bylaw
58 Bylaw No. 2016-3346, being The Traffic Bylaw of the City of Weyburn, is hereby
repealed and replaced by this Bylaw which comes into effect upon passing of third
reading or, where required, upon approval of The Highway Traffic Board.
