Bylaw No. 33/2012
A Bylaw to Regulate the Operation of Snowmobiles within the Corporate Boundaries of the
City of Yorkton
Whereas, Section 8 of The Cities Act authorizes a Council to regulate and control any
activities within the City of Yorkton; and
Therefore, the Council of the City of Yorkton in Council assembled enacts as follows:
Title and Purpose
1. (a) This Bylaw may be referred to as "THE SNOWMOBILE BYLAW".
(b) The purpose of this Bylaw is to promote the safety, health and welfare of people and the
protection of people and property in the City of Yorkton, as well as regulate and control
the access and provisions respecting the operation of snowmobiles within the City of
Yorkton.
2. No person shall operate a snowmobile within the Corporate limits of the City of Yorkton
except as specified in Schedule 'A' which is attached and forms part of this bylaw. This
schedule sets out the points of access and egress for snowmobiles within the City of Yorkton.
The snowmobile routes are to be used solely for the purpose of entering and exiting the
corporate limits of the City of Yorkton. The new access points as indicated by the green line
on the map specifically running west of Highway 9, to Fourth Avenue North, then running
south, down Fourth Avenue North, and then running west of Fourth Avenue and North of
York Road East, and then South along the right of way, to 263 Myrtle Avenue, be limited
only to trail groomer equipment as operated by the Yorkton Sno-Riders Club.
3. Nothing in this bylaw negates or contravenes any of the rules and regulations for the
operation, registration and licensing of snowmobiles as set out in The Snowmobile Act, or any
amendments thereto.
4. Section 21.1 of The Snowmobile Act sets out the rules and operation of a snowmobile at night
or under dangerous conditions. In addition, no one is to operate a snowmobile on the routes
designated in this bylaw, between the hours of 11:00 p.m. and 7:00 a.m.
5. No person shall operate a snowmobile at a speed greater than 40 km per hour on the routes
designated or at a speed greater than the maximum speed indicated by any sign that is erected
by the trail manager, or at a speed greater than is reasonable and safe having regard to all
circumstances including the nature of the terrain and the existing conditions at the time.
6. Nothing in this bylaw allows the operation of any snowmobile within 60 metres of any
residence.

7. Members of the City Detachment of the RCMP or the City of Yorkton Bylaw Officers are
hereby authorized and empowered to seize and impound for a period of up to 30 days; any
snowmobile unlawfully operated, kept or placed in contravention of this bylaw.
a) No impounded snowmobile shall be released unless the impound charge and any
applicable storage charges, if any, are first paid in full.
8. No person shall obstruct or hinder any person acting under the authority of this Bylaw, or fail
to comply with any provisions of this bylaw.
a) Any person that fails to comply with the above is guilty of an offense and liable on
summary conviction:
a) In the case of an individual, to a fine of not more than $10,000.
b) In the case of a corporation, a fine of not more than $25,000.
c) In the case of a continuing offense, to a maximum daily fine of not more
than $2,500.00 per day.
9. Bylaw No. 20/95 providing for the regulation and operation of snowmobiles within the City
of Yorkton, passed on the 18th day of September 1995 and all amendments thereto are hereby
repealed.
10. This Bylaw shall come into force and take effect on the day of final passing thereof.
