## VILLAGE OF HAINES JUNCTION BYLAW 232-08
## A BYLAW FOR THE VILLAGE OF HAINES JUNCTION TO REGULATE NOISE WITHIN THE COMMUNITY BOUNDARIES.
WHEREAS the Municipal Act, being Chapter 154 of the Revised Statutes of the Yukon, 2002 and amendments thereto, Section 265 (a) and (c) allows a Municipality to pass bylaws for the "health & welfare of people" and
WHEREAS Council deems it proper and expedient to consider excessive and or loud noise as a negative factor regarding the "health & welfare of its residents', temporary or permanent, therefore in accordance with the objectives, policies and practices approved by Council,
NOW THEREFORE, THE Council for the Village of Haines Junction duly assembled, herein enacts as follows;
## SHORT TITLE
2. Everyone who makes or causes noises or sounds in or on a highway or elsewhere in the Village of Haines Junction, which disturbs or tends to disturb the quiet, peace, rest, enjoyment, comfort or convenience of the neighbourhood or of persons in the vicinity, shall upon warning from any Peace Officer, cease making or causing such noises forthwith, or shall be deemed to have contravened the provisions of the Bylaw.
1. This Bylaw shall be cited as the Haines Junction Noise bylaw. INCESSANT NOISES
3. Construction equipment shall not be operated between the hours of eleven o'clock at night (11.00 pm) and seven o'clock in the morning (7:00 am) except with the written permission of the Village of Haines Junction.
## NOISE MAKING DEVICES
- No person shall use a megaphone or other noise making devices in, or at, or on the streets or other public places, within the Municipality of Haines Junction, without first having obtained a permit from the Village of Haines Junction.
## PENALTIES
5. Any person who violates the provisions of this bylaw commits an offence punishable on summary conviction and is liable to a fine not exceeding:
2. (a) five hundred dollars ($500.00) where proceedings are commenced pursuant to the Summary Convictions Act of the Yukon.
## ENACTMENT
6. This Bylaw shall come into full force and effect on the final passage thereof.
