## VILLAGE OF MAYO ## BY-LAW NO. 215 A by-law to establish and enforce regulations regarding excessive noise within the boundaries of the municipality of Mayo. WHEREAS Section 265 (m) of the Municipal Act, Chapter 154, RSY 2002, states that a Council may pass by-laws for municipal purposes respecting nuisances and noise, and WHEREAS the Council for the Village of Mayo deems it desirable to preserve the public peace through the limitation of the hours when residents are not required to be quiet, in accordance with the Noise Prevention Act of the Yukon Territory; NOW THEREFORE, the Council for the Village of Mayo in open meeting assembled, HEREBY ENACTS AS FOLLOWS: ## Short Title: 1. This by-law may be cited as the "Noise By-law". ## Interpretation: 2. "sound amplification device" includes, but its not limited to, radios, televisions, record players, tape players, disc players, electronically amplified musical instruments, and public address systems. "premises" includes the land appertaining to a building or other structure and land that does not have any building or other structure located on it. ## General Regulations: 3. Between the hours of 11:00 p.m. and 7:00 a.m. within the Village of Mayo no person shall; by operating any sound amplification device, or by fighting, screaming, shouting, swearing, singing, or using insulting or obscene language, make in any premises or vehicle noise that disturbs the peace, quiet, rest, enjoyment, comfort or convenience of persons in the neighbourhood or vicinity in which the noise is made. 2. Construction equipment shall not be operated within the Village of Mayo between the hours of 11:00 p.m. and 7:00 a.m. 5. Village of Mayo, First Nation of Na-Cho Nyak Dun and other community special events i.e. Canada Day, Mayo Midnight Marathon, dances, etc. shall be excluded from the provisions of this by-law. 2. The provisions of this by-law shall not apply to peace officers acting in the course of their duties. 7. The Council for the Village of Mayo hereby provides for the appointment of the Royal Canadian Mounted Police officers as enforcement officers as provided under Section 339 of the Municipal Act. ## Penalties: - Penalties under Section 2 of this by-law shall be - a) for a first offence a written or verbal warning; - c) for a third offence a fine not to exceed $100.00; - b) for a second offence a fine not to exceed $50.00; - d) subsequent offences will be subject to fines as deemed appropriate by the RCMP. 9.
