<!-- image --> <!-- image --> ## Village of Teslin ## By-Law # 26-261 A By-Law to provide Village of Teslin authorization to enter into an agreement with Government of Yukon for the provision of Regional Solid Waste Management Services outside the municipal boundary. WHEREAS Section 229(1) of the Municipal Act provides that Council may adopt bylaws to establish and provide a municipal service that considers necessary or desirable for the residents of its municipality; and WHEREAS Section 232 of the Municipal Act states, if it is in accordance with an agreement authorized by bylaw under section 229, a municipality may provide outside its boundaries a municipal service that it has power to provide in its boundaries; and WHEREAS Section 230(1) of the Municipal Act provides that a Council may, by bylaw authorize its municipality to enter into an agreement with the Government of Yukon for the provision of providing a municipal service within an area over which the Government of Yukon has jurisdiction; and WHEREAS Village of Teslin bylaw #16-219 provides Collection, Storage, And Disposal of Solid Waste and Recyclable Materials. NOW THEREFORE, the Council of the Village of Teslin, in open meeting assembled, hereby ENACTS AS FOLLOWS: SHORT TITLE 1. This bylaw may be cited as the "Regional Landfill Operation Bylaw" DEFINITIONS ## 2. In this bylaw: a) "Council" means the elected Council of the Village of Teslin, b) "Municipal service" means a utility service, or a non-utility service, that is provided by a municipality in accordance with a bylaw adopted under section 229; c) "Solid waste" means all waste including controlled waste; residential waste; institutional, commercial, or industrial waste; compostable material; recyclable material and reusable material; d) "Solid Waste Facility" means a site used by the public for the handling and disposal of waste and includes any land, transfer stations or buildings associated with the facility and any machinery, equipment, devices, tanks or other works used on the site to handle or dispose of the solid waste; e) "Utility service" means a system, which includes any facilities or works required for the operation of that system, that provides or makes available to the public (heat, electricity, water, sewage treatment and disposal, solid waste management, or waste heat). ## APPLICATION 3. Agreement to operate waste management facility outside Municipal boundaries The Village of Teslin is authorised to enter into formal agreement for the provision of Regional Solid Waste Management Services at the Solid Waste Facility located outside the municipal boundary. ENACTMENT This By-Law shall come into full force and effect on final passing thereof. Read a first &amp; second time this 12th day of January, 2026.
