Ordinance #3 -- Village of Arden, Delaware
Transfer of Local Services
Adopted September, 1968
An ordinance providing for the transfer of responsibility for certain local service functions (as
such term is defined in Title 9, Delaware Code, Section 1102) from the Village of Arden to
New Castle County.
Responsibilities for the following local service functions (as such term is defined in Title,
Delaware Code, Section 1102) provided and performed with respect to all persons and property
within the Corporate limits of the Village of Arden be and is hereby transferred from the
Village of Arden to New Castle County in accordance with the provisions of Title 9, Part II,
Chapter 11, Sub Chapter I:
1. Adoption and enforcement of ordinances and regulations for the protection of persons and
property from hazards in the use occupancy, condition, alteration, maintenance, repair,
sanitation, removal and demolition of buildings and structures or any parts therefor and grounds
appurtenant thereto, in the operation of equipment therein, and of out-door signs including but
not limited to zoning ordinances and regulations thereunder, building codes and regulations
thereunder, plumbing codes and regulations thereunder or other such codes; police protection;
public works including but not limited to, maintenance and operation of sanitary and storm
sewers, drainage systems, sewage disposal facilities, refuse disposal facilities, including trash
and garbage collection disposal.
2. Transfer of local service function of the police protection shall not limit the power and
authority of the Village of Arden to employ a police force and to enact and enforce motor
vehicle codes and other safety measures applicable to the Village, nor shall such transfer
supersede, abrogate or nullify any existing ordinance adopted by the governing body of the
Village of Arden providing for a motor vehicle code or like safety measure.
This measure shall take effect upon the date of the adoption of a concurring ordinance by
the County Council of New Castle County.
