Ordinance NO.: 425 AN ORDINANCE TO REQUIRE THE INSTALLATION AND MAINTAINING OF HANDICAP SIGNS AND PROVIDING FOR THE ENFORCEMENT OF HANDICAP SIGN REQUIREMENTS BY THOSE REQUIRED WITHIN THE TOWN OF BLADES WHEREAS, the 142nd General Assembly of the State of Delaware enacted legislation to require the three counties and all of the municipalities of Delaware to enact legislation to provide for the enforcement ofhandicapped parking sign laws; and WHEREAS, the Town Council of the Town of Blades wishes to comply with the mandates of the State of Delaware, NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF BLADES, IN COUNCIL MET, IN THE MANNER FOLLOWING, TO WIT: Section 1:. All individuals and artificial entities required by ordinances ofthe Town of Blades, ordinances of Sussex County, or the laws of The State of Delaware to designate parking spaces or parking zones for use by vehicles operated by disabled persons shall also be required to erect and maintain signs marking those parking spaces or zones. After the receipt of a complaint regarding the lack of a required sign, the Town Manager, or a Code Enforcement Officer, or a member of the Blades Police Department shall mail a written warning to the individual or artificial entity at its address shown on the tax rolls. If after thirty (30) days the violation is not remedied, the Town Manager, or a Code Enforcement Officer, or a member of the Blades Police Department may issue a summons or apply for a warrant with a court of competent jurisdiction in the name of the offending individual or artificial entity; each day of non-compliance shall constitute a separate offense and the penalty for each offense shall be one hundred dollars ($100), and the individual or artificial entity shall pay the cost of prosecution. The Town Manager, or a Code Enforcement Officer, or a member of the Blades Police Department may also pursue civil remedies, including injunctive relief.
