ORDINA NO .--=3:::;....:(j~,~__ THE TOWN COUNCIL OF THE TOWN OF BLADES MET IN THE MAT'I'ER FOLLOWING TO WIT: NUISANCES AND THE PUBLIC HEALTH Section 1 That any person depositing ashes, trash, dirt, or other rubbish in the street~ or sidewaJ.ks shall be fined not less than $10.00 nor more than $100.00 plus court costs and/or imprisoned not less than 10 days nor more than 30 days nor more than 30 days. or both. ~.ion 2 No person, firm or corporation shall keep, raise, or maintain any live­ stock upon ar~ property owned or occupied. by such person, firm, or corporation within the corporate "J.irnits of the town of Blades. Any person violating this section shall be guilty of a misdomeaner and upon convicti.on sha]~ be punished by a fine not less than $10.00 nor more than $100.00 plus court costs and/or imprisoned not less than 10 days nor more than 30 days, or both. Section 3 That residence and property owners shall within twelve hours after a snow fall shall cease to fall shall remove at his own expense the snow from the sidewalks. Any person violating this section shall be guilty of a misdomeaner and upon conviction shall be punished by a fine not less than $10.00 nor more than $100.00 plus court costs and/or imprisoned not less than 10 days nor more than 30 days, or both. Section 4 Whoever shall be drunk and/or disorderly, drinking intoxicating liquors, curses. ani SNears or uses abusive language, fight, blow automobile horns unnecessarily, any siren, exhaust, compression or spark plug whistle, or be disorderly within limits of the town of Blades, shall be guilty of a misdomeaner and upon conviction shall be punished by a fine of not less than $10.00 nor more than $100.00 and court costs, and/or imprisoned for not less than 10 days nor more than 30 days, or both. Section 5 That if the owner or tenant of any lot shall allow weeds to grow or rubbish to collect there on and shall neglect or refuse to remove the same after five days notice from the town council, such person shall be guilty of a common nuisance and upon conviction before the alderman shall forfeit and pay a fine of not less than $10.00 nor more than $100.00 and court costs and further shall forfeit and pay an additional penalty of $5.00 for each and every day such nuisance is ,Permitted to re­ main after the expiration of the time set forth in said notice, and/or be imprisoned not less than 10 days nor more than 30 days, or both. Section 6 The keeping of bees wi.thin the corporate limits of the town of Blades is hereby decl&red to be unlawful and to constitute a nuisance and upon conviction be­ fore the alderman shall forfeit and pay a fine of not less than $10.00 nor more than $100.00 and/or be imprisoned not less than 10 days nor more than 30 d9J,ys, or both. Section 7 That it is unlawful for any person or persons or corporation, partner­ ship or business to store or leave in any place accessable to small children within the town limits of Blades any unused or vacant refrigerators, ice boxes or any like devices used for storage and preservation of food stuff, unless locks or latches are off doors. The violation of this ordinance is punishable by a fine of not less than $;25.00 nor more than $100.00 or 10 days imprisonment and not more than ~O days imprisonment, or both. Section 8 That it shall be unlawful to set fire to and burn leaves, brush, and other combustable matter within the limits of the town of Blades without a special permit from the town council. Any person violating this provision shall be fined not less tha.nJ$lO.OO nor more than $100.00 plus court costs and/or be imprisoned not less than 10 days nor more than 30 days, or both. l Section 9 It shall L~ unlawful to operate any boat P'- ered b;y an outboard motor be­ tween the hours of 9 p.m. and ~ a.m. on the waters of ~ lake lying within the COD­ porate limits of the town of Blades. Any person violating the provision of this ordinance shctll forfeit and pay a fine of not less than $10.00 nor more than $100.00 plus court costs and/or be imprisoned not less than 10 days nor more than 30 days, or both. ~ection 10 ASSAULT AND BATTERY. The alderman for the town of Blades, Delaware may punish by a fine not exceeding $--100.00 and costs and/or imprisonment of not less than 10 days nor more than 30 days or both, all assault and battery, when the offense is not of a high or aggrivated nature. Section 11 Any person who shall, except in lawful self defense, discharge any fire arms within the corporate limits of the town of Blades shall be deemed guilty of a misdomeaner and u~8 couviction shRll be DYQished bv a fine of not Jess than ~10 00 nor more ~nan~~luu. 0 p~us cou-~ cOSEs. anG/or lmprLSOnmen~ 0 no~ less ~nan lO days nor more than 30 days, or both. Section 12 That any person or persons standing, idling, or loitering on corners, pavements, sidewalks, or crossings, congregated with others on any pavement, sidewalk, crossing, or corner or in any of the squares or lanes, or alleys of any door step as to obstruct or hinder the free and convenient passage of persons walking, riding, or driving over or along any such pavement, sidewalk, street, square, lane or alley or to the alliloyance of passersby or the occupiers of adjacent premises and shall fail to make way, remove or step aside after a reasonable warning by any person or a police: ~~-_ officer, shall be deemed guilty of a common nuisance and upon conviction before the alderman shc:ll be fined not less than $10.00 nor more than $100.00 and/or imprisoned not less than 10 days nor more than 30 days or both and shall pay the costs of prosecution. Sec;io~ Whoever unlawfully, mischieviously, malici9usly destroys or causes to be destroyed or injures any real or personal property belonging to any person resident or owners of the property in the town of Blades or belonging to the town of Blades shall be guilty of a misdomeaner and shall be fined not less than $10.00 nor more than $100.00 plus court costs or imprisonment of not less than 10 days nor more than 30 days, or both and shall pay the costs of prosecution. Section 14 It shall be unlawful for any person to solicite for orders, sales, sub­ scriptions of business of any kind for the delivery of supplies or articles of services a~Ler 6 O'clock in thearening and 10 o'clock in the morning, or to canvass for information fram any resident of the town of Blades unless licensed from the State of Delaware v-rithout first having obtained a permit from the wwn clerk of the town of Blades in the amount of $25.00 and posted a bond for a period of one year from the date thereof to the town of Blades and the amount of $500.00 with a surety authorized to do business in the State of Delaware containing a warrant of address to convenience .iudgement in the amount of the bond condition upon the delivery of the goods of service of a greatly represented to the purchase to the time that the orders of ordinances were given by the purchaser and set the time or times agreed upon. Excepting persons selling their own products (example: Farmer selling Butterbeans). Violation of this section shall be punishable by a fine of not less than $10.00 nor more than $100.00 plus court costs and/or be imprisoned not less than 10 days nor more than 30 days, or both. Section 15 Any person who acts in any way as to interfere with any police officer of the town of Blades when such police officer is performing his duties or is attempting to make an arrest whether the person to be arrested himself or some other person or any person who encourages or insites another to resist arrest shall be guilty of a misdomeaner and upon conviction shall be punished by a fine not exceeding $100.00 and court costs and shall be imprisoned not less than 10 days nor more than 30 days or both. ;)04 CC<W1ru~ Section 16 It shall' unlawful for anyone to attach . lceir sleds on the back of cars during a snow tL Jugh the streets of the town of .....ades and if found guilty of the violation of this ordinance and upon conviction shall be fined not less than $10.00 nor more than $100.00 plus court costs and/or be imprisoned not less than 10 days nor ~re than 30 days. and pay the costs of the prosecution. Siedion 17 It shall be unlaTdful for any person. firm or corporation within the corporate limits of the town of Blades to dwnp or deposit or to cause to have dumped or deposited any foreign matter in the surrounding waters of Blades. Violaters of this section shall be deemed guilty of a misdomeaner and upon conviction shall be fined not less than $10.00 nor more than $100.00 or impr::tsoned not less than 10 days nor more than 30 days, or both, and shall pay the costs of prosecution. section 18 It shall be unlawful for any person to loiter. lounge, or prowl in the night time on ffiiy public street. in any public place, or on any private property within the corporate limits of the town of Blades without any valid reason for being there. Any person violating this provision shall be deemed guilty of a misdomeaner and upon conviction shall be fined not less than $10.00 nor more than $100.00 or imprisoned not less than 5 days or more than 30 days. or both, and shall pay the costs of prosecution. ~ion 19 VAGRANCY. A vagrant is defined by common law as the act of going about from place to place by a. person without visible means of support, who is idle and who, though able to work for his or her maintenanace. refuses to do so, but lives withoutlabor or on charity of others. Also it may be held that the act of prowling about and creeping up on parked autom0biles and their occupents at night, under circumstances indicating an intent to commit a crime, constitutes vagrancy. It has ame been held that although traveling by automobile, a person may be nevertheless a vagrant. and even though he travels without stop or hesitation for a considerable distance, he may still come within a statute punishing one "Tho "wanders about" at late hours. Any person found guilty of the above act or acts, by an alderman of the town of Blades, or a magistrate of the state of Delaware, shall be imprisoned not more than ten days. Section 20 Any person mounting a pony, horse, donkey, mule or any related animal shall abide by the following: 1. Shall not trespass on any sidewalk or privat property within the town l:i.mits of Blades. 2. Shall not be allowed in the town of Blades on Friday or S-a±,urday unless b;y permit of the town clerk of the town of Blades, or by anyone designated by him. 3. Shall not be allowed in town after sundown. 4. Must ride on right side with traffic and obey all traffic laws. 5. All sections are void in the event of a parade or any special event sanctioned by any organization of the town of Blades. Any person found guilty of the above act or acts. shall be fined $10.00 plus costs nor more than $50.00 plus costs, or imprisoned not less than 5 days nor more than 30 days, or both.
