## AN ORDINANCE TO AMEND CHAPTER 128 OF THE CODE OF BRIDGEVILLE RELATING TO FEES
## THE COMMISSIONERS OF BRIDGEVILLE HEREBY ORDAIN:
Section 1. That Chapter 128, §128-1 of the Code of Bridgeville be amended by striking Subsection F in its entirety and by substituting in lieu thereof a new Subsection F to read as follows:
## F. Sewer Impact Fees for any Commercial, Institutional or Industrial Structures
## 1.) Definitions:
As used in this section, the following terms shall have the meanings indicated:
- a. "Equivalent Dwelling Unit (EDU)" shall be defined hereinafter as a term used to express the load produced on a sanitary sewerage system approximately equal to one (1) dwelling place or 300 gallons per day.
- b. "gpd" or "GPD" means gallons per day.
- c. Production Days means any day that a commercial, institutional or industrial facility is open for business.
- d. "SE" means square footage.
5. 2.) For any commercial, institutional or industrial structure there shall be a sewer impact fee of $1,500 per equivalent dwelling unit (EDU), which is based on water consumption or sewer metering, with a minimum of one EDU.
The number of EDU's for structures pursuant to subsection F shall be estimated by the Town Engineer in accordance with the below listed table. After one (1) year of operation, each structure with water usage in excess of 2500 gpd shall be re-evaluated and the number of EDU's recalculated based on the following formula:
Sewage flow per year in gallons+ (Production Days x 300 gal/day/EDU).+
The results will be rounded up to a full number. This impact fee adjustment shall be billed refunded at the time of the next regularly scheduled billing

- 3.) If two or more dwellings, apartments, stores, offices of industrial units are connected through a single lateral, impact fee payable under the foregoing schedule shall be computed as though each such store, office, or industrial unit were a separate property or user with a separate connection to the sewer.
- 4.) In the event that the Town of Bridgeville is not provided, upon request, with accurate information, including supporting documentation, to determine the number of employees or pupils using any property, or such other data as may be necessary to determine a user classification or rate, the Town of Bridgeville's estimate or determination thereof shall be conclusive.
- 5.) The Town of Bridgeville reserves the right to change commercial user flow data table from time to time, or add or delete user classifications, and, in cases of dispute, to determine the proper classification of a given property.
