## ORDINANCE NO.: A05-9
## AN ORDINANCE ADOPTING THE LAND USE AND DEVELOPMENT CODE LAND USE PLAN FOR THE TOWN OF BRIDGEVILLE
WHEREAS, the Commissioners of Bridgeville have, as required by Section 702, Chapter 7 of Title 22, of the Delaware Code, as amended, adopted a comprehensive development plan for the purposes set out therein; and
WHEREAS, the Commissioners of Bridgeville have determined that to better implement the comprehensive development plan, it must revise and update its ordinances relating to land use, subdivision, planning and zoning; and
WHEREAS, the Commissioners of Bridgeville are of the opinion that it promotes the health, safety, morals, beauty and good appearance of Bridgeville and provides for the orderly growth, development and future of the Town and its inhabitants by implementing a new land use and development ordinance;
## NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSIONERS OF BRIDGEVILLE:
Section 1. The Code of Bridgeville, Chapter 234, entitled "Zoning", is hereby repealed in its entirety and in lieu thereof, the "Land Use and Development Code", dated September 7, 2005, together with the text, maps, and other exhibits all of which are attached hereto and made a part hereof as is more fully set out herein, is adopted as Chapter 234 of the Code of Bridgeville.
Section 2. If any provision of the Land Use and Development Code or the application thereof to any person or circumstances shall be held invalid, such invalidity shall not affect the other provisions or applications of the other provisions or applications of the Land Use and Development Code which can be a given effect without the invalid provision or application.
Section 3. This Ordinance shall be effective upon its adoption by a majority of all members elected to the Commissioners of Bridgeville.
