I). Amendments noted where applicable.] ## Section 1. Applicability; compliance required. The following rules and regulations shall be applicable to the collection of garbage and rubbish by the town of Camden, and said rules and regulations are hereby established and compliance therewith is hereby required by all persons, firms, associations and corporations using the facilities of the Town of Camden for the collection of said garbage and rubbish. ## Section 2. Definitions. As used in this chapter, the following terms shall have the meanings indicated: GARBAGE AND CUMBUSTIBLE REFUSE - All solid and semisolid kitchen refuse subject to decay or putrefaction and all market waste of animal and vegetable matter which h. was intended to be used as food. It shall also include animal offal, carcasses of dead animals, waste animal matter from butcher stores and all combustible substances from public and private establishments and residences. For the purposes of this chapter, saw dust, scrap lumber, paper, cardboard and cardboard cartons and other combustible refuse shall be considered as garbage. RUBBISH - Includes all wastes not subject to decay or putrefaction from all public and private establishments and residences. It shall include ashes, brush, trees and garden clippings, dirt sweepings, tin cans, glass articles and al other incombustible substances. ## Section 3. Collection rules. On collection days, all garbage and rubbish shall be placed in receptacles on the sidewalk or alley from which the collection thereof is to be made. - A. Trash containers must not be larger than 96 gallon capacity, must be in good condition with handles and no sharp edges, must have tight fitting lids in order to keep out animals, must not be so full that contents spill when handles by collectors. - B. Trash containers must be visible and easily accessible for collectors, placed on the curbside, and may not be placed out earlier than two (2) hours before sunset the evening prior to collection, and must be placed curbside no later than 7:00 a.m. on the day of the collection. 3. Household garbage must be placed in sealed, leakproof bags or containers. Loose garbage will not be permitted to remain out-of-doors, and garbage that is wet or improperly packaged will not be collected. - D. Tree limbs or shrubbery to be removed on a regular trash day must be cut into four-foot lengths and bundled; appliances than contain Freon must be drained and tagged by a certified technician; syringes used for medical purposes must be recapped after use for disposal; and broken glass or sharp objects must be safely packaged before disposal so as to prevent injury to trash collectors. - E. The following items will not be collected: construction debris, i.e., lumber, shingles, drywall, etc.; soil, sod or dirt in cans or bags; bricks or concrete in garbage or trash cans; and tires. 6. All trash and recycling containers must be removed from street and sidewalks and alleys by 7:00 pm on day of collection. Failure to comply a violation will be served. See section 9. ## Section 4. Collection days. - A. Household trash will be removed on Friday of each week and recycling is Tuesday of each week using the 65 gallon container with the gray lid. - B. Bulk trash will be removed on the last Friday of each month by appointment. If bulk service day falls on a Town-observed holiday, bulk trash removal will occur on the following day. ## Section 5. Responsibility for compliance; out-of-town residents. Town to dispose of their trash. It is the responsibility of property owners to make tenants aware of thee rules. ## Section 6. Accumulation of garbage prohibited. It is unlawful to allow garbage, refuse, rubbish or other noxious matter to accumulate on any premises or vacant lot, except for the purpose of being collected. ## Section 7. Burning garbage. It shall be unlawful to burn any garbage and combustible refuse except in accordance with the regulations and laws of the Department of Natural Resources and Environmental Control of the State of Delaware. ## Section 8. Trash and recycling service. Allied Waste will be altering its trash service to the residents of the Town of Camden. Tuesday will be the recycling day and Friday will be the trash day. Every resident will receive a 65gallon cart with a light gray top for recycling. On the top of the container, it will explain what can be recycled. The following are examples of recycled material: - . Newspapers, Brown Paper Bags - Magazines/Catalogs - Telephone/Soft Cover Books - Junk Mail/Envelopes (all types) - Paper - . Paperboard (cereal/tissue boxes) - Cardboard - Narrow-Neck Plastic Bottles - Plastic Grocery Bags - Milk Jugs, Bleach/Detergent, Shampoo Bottles - Glass Bottles/Jars (any color) - Metal Cans (tin/steel/aluminum) In addition, every resident will receive a 96-gallon cart with a blue lid for trash. By September 1, 2008, only materials in the trash cart will be picked up. Bulk items can be placed out and picked up the last Friday of every month. Refrigerators, air conditioners or other items with hazardous materials cannot be picked up. During a week of a holiday, every pick up day after the holiday will be pushed back one day. For example, September 1st is Labor Day. Recycle pick up will be Wednesday and trash pick up will be Saturday. In summary every resident will receive 2 carts. Small one with gray lid will be for recycles and picked up on Tuesdays. Larger one with blue lid is for trash and will be picked up on Fridays. Bulk pick up will be the last Friday of every month. ## Section 9. Violation and penalties. 'Any violation of the provisions of this chapter shall be subject to a fine of $50 for first offense, $100 second offense and $200 for third offense. For unpaid violations after 60 days service may be suspended. All unpaid violations will be billed on Owner property tax for payment. ## Section 10. Trash Collection Fees. An ordinance of the Town of Camden relating to trash collection fees. The Mayor and Town Council of the Town of Camden ordain Ordinance #28 establishing rates for the collection of garbage and rubbish within town limits of the Town of Camden are as follows: ## Amount of trash collection fee The trash collection fee shall be $225.00 per year for each trash collection customer. ## Review of trash collection fee The amount of the trash collection fee shall be reviewed on a regular basis and/or on an as needed basis in association with contractual necessity and may be adjusted as part of the budgetary process. ## SYNOPSIS This ordinance establishes trash collection fees. Repealed: All ordinances and parts of ordinances inconsistent with the provision of this Ordinance and resolution (Tax Base for Refuse Service on July 1, 1996) are hereby repealed. Date of Effect: The Mayor shall certify to the adoption of this Ordinance and cause the same to be published as required by law; and this Ordinance shall take effect and be in force from and after its approval by Council.
