## NUISANCE ORDINANCE - a. For purposes of this ordinance, the term "nuisance" shall mean any condition or use of the premises (interior or exterior) which is detrimental to the property of others or which causes or tends to cause substantial diminution in the value of other property in the neighborhood in which such premises are located, or which causes or tends to cause injury or harm to the life or health of any person. A nuisance includes, but is not limited to, the keeping or the depositing on, or the scattering over the premises of any of the following: - (1) Lumber, junk, trash or debris; - (2) Abandoned, discarded or unused objects or equipment such as automobiles, furniture, stoves, refrigerators, freezers, 4. cans or containers. - b. No person owning, leasing, occupying or having charge of any premises shall maintain or keep any nuisance thereon. - c. Enforcement of this ordinance may be accomplished by the Town in any manner authorized by law, including, but not limited to, an action to enjoin or otherwise abate an existing violation. - (1) If the Town gives reasonable notice to the owner, lessee, occupant or person in charge of any premises to abate a nuisance, and it is not abated within a reasonable time, the Town may remove the personalty constituting or causing nuisance, the expenses therefor to be billed to the owner, lessee, occupant or person in charge, jointly and severally, said bill to be recoverable in an action at law. - (2) Any personalty removed and placed in storage by the Town shall be sold by the Town at a public sale after reasonable notice thereof. If the proceeds of such sale are 9. insufficient to pay the costs of the abatement, the owner, ## ORDINANCE NO. 32 NUISANCE ORDINANCE PAGE TWO Lessee, occupant or person in charge shall be jointly and severally liable to the Town for the balance of such costs, to be recoverable in an action at law. If the proceeds of such sale exceed the costs of abatement, the balance shall be paid to the owner, lessee, occupant or person in charge. This ordinance shall be in full force and effect from and after its passage as provided by law.
