## TOWN OF FREDERICA ORDINANCE NO. 22-10 ## AN ORDINANCE AMENDING CHAPTER 305-7 OF THE FREDERICA CODE RELATING TO SOLID WASTE DISPOSAL BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF FREDERICA IN COUNCIL MET: - Section 1. That Chapter 305, Article II, § 305-7 (d.) of the Frederica Code be amended to read as follows: - d. All garbage, trash, or rubbish containers must be removed from the collection area and returned to a point to the side or rear of the structure by 7:00 p.m. on the collection day, and in such a manner as to prevent the creation of a nuisance or health hazard. - Section 2. That Chapter 305, Article II, § 305-7 (g.) of the Frederica Code be omitted - When not at the curb for collection, trash containers shall be stored as stated in the Land Development Ordinance. - Section 3. Severability. The provisions of this Ordinance are severable and if any of its provisions or any sentence, clause, or paragraph shall be held unconstitutional or violate the Laws of the State of Delaware by any court of competent jurisdiction, the decision of such court shall not affect or impair any of the remaining provisions. - Section 4. Effective Date. The Clerk shall certify to the adoption of this Ordinance and cause the same to be published as required by law; and this Ordinance shall take effect and be in force thirty days from and after its approval by Council. - Section 5. Repealer: All ordinances and parts of ordinances inconsistent with the provisions of this Ordinance are hereby repealed.
