## THE MAYOR AND COUNCIL OF ODESSA
## ORDINANCE NO. 83-7
AN ORDINANCE TO REQUIRE THE PROPER CONTROL OF DOGS WITHIN THE TOWN LIMITS OF THE TOWN OF ODESSA, DELAHARE.
THE MAYOR AND COUNCIL OF ODESSA, DELAWARE DO HEREBY ORDAIN THAT:
Section 1. It shall be unlawful for any dog to run at large within the Town Limits of the Town of Odessa at any time, regardless of whether or not such dog is registered by the laws of the State of Delaware,
Section 2. Whoever being the owner, custodian or possessor of any dog or dogs allowing same to run at large within the Town Limits of the Town of Odessa shall be fined not more than ten dollars ($10.00) and costs for the first offense, not more than twenty-five dollars ($25.00) for the second offense and not more than fifty dollars ($50.00) for each offense thereafter. Each dog of any owner shall constitute a separate offense.
Section 3. It shall be unlawful for any owner, possessor or person to. keep any dog or dogs which by frequent habitual or long continued noise that disturbs any person or neighborhood and such action is hereby declared to be a public nuisance.
Section 4. Any omer, possessor or person who keeps such dog or dogs and who is notified of such nuisance and who then fails to abate said misance shall be fined not more than ten dollars ($10.00) and costs for the first offense, not more than twenty-five dollars ($25.00) for the second offense and not more than fifty dollars ($50.00) for each offense thereafter. Each dog of any owner shall constitute a separate offense.
Section 5. This Ordinance shall take effect immediately upon its enactment by The Mayor and Council of Odessa.
Section 6. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
