## RESOLUTION 2025-003 ## A Resolution to Amend Section 12 Utilities of the Townsend Municipal Code WHEREAS, the Town of Townsend is authorized under its Charter and Delaware law to enact and amend ordinances for the health, safety, and welfare of its residents; and WHEREAS, Section 12 of the Townsend Municipal Code governs the provisions and regulations related to utilities within the Town limits; and Whereas, the Town Council has determined it is necessary and appropriate to update Section 12.16.020 to reflect current utility policies and operational practices; and WHEREAS, the Town Council also finds it prudent to re-add Section 12.12.050, which was previously repealed in 2020, to re-establish specific regulatory language beneficial to the proper management of municipal utility services; NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Townsend is adopting the below proposed Sections. 1. Section 12.16.020 -Street Lighting Fee, of the Townsend Municipal Code, is hereby amended and relabeled as "Street Light Tax" as follows: - a. The Town Council may establish a set rate for a yearly Municipal Street Lighting Tax which rate shall be based upon reasonably anticipated costs for operation, maintenance and repair of such street lights. - b. The municipal street lighting tax shall be assessed as a tax on the owner of real property and shall be billed annually and included on the annual billing of real estate property taxes. - c. As all classes of property derive the same benefits, all classes of property will pay the same tax rate. 2. Section 12.12.050 - Collection Service Fee, is hereby re-added to the Townsend Municipal Code with a new Title of "Trash Service Tax" as follows: - a. The Town Council may establish a set rate for a yearly Municipal Garbage Tax which rate shall be based upon reasonably anticipated costs for operation, maintenance and repair of such garbage service. - b. The municipal street garbage tax shall be assessed as a tax on the owner of real property and shall be billed annually and included on the annual billing of real estate property taxes. - c. This tax shall be applicable to all properties zoned as residential. 3. The Town Clerk is directed to codify the amended and re-added sections into the official Townsend Municipal Code and ensure public access to the updated text. 4. This resolution shall become effective immediately upon adoption by the Town Council.
